RESOLUTION NO. 962
A RESOLUTION COMMITTING THE CITY OF CANTON TO PARTICIPATION IN
THE WESTERN ILLINOIS POLICE TRAINING UNIT AND APPROVING AN INTER-
GOVERNMENTAL AGREEMENT BETWEEN THE CITY OF CANTON AND THE WESTERN
ILLINOIS POLICE TRAINING UNIT.
WHEREAS, the City of Canton Police Department is subject to
certain reoccurring, mandated, annual training requirements; and,
WHEREAS, it appears to the Canton City Council that participation
in the Western Illinois Police Training Unit would be advantageous
to the City in that certain of the costs of required police training
would be paid by the State of Illinois as in Public Act 82-674 set
forth.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CANTON, Fulton County, Illinois as follows:
1. That the Canton City Council hereby commits the City of
Canton, Fulton County, Illinois to participation in the Western
Illinois Police Training Unit for a twelve (12) month period from
the date of these presents and at a total cost to the City of Canton
not to exceed $731.30.
2. That the Mayor and City Clerk are hereby authorized and directed
to execute and deliver duplicate original copies of a certain agree-
ment, Exhibit A hereto attached and herein incorporated by reference,
entitled, "Intergovernmental Contract - Western Illinois Police
Training Unit," upon terms and conditions substantially in conformity
with the tenor of this Resolution.
3. That this Resolution shall be effective immediately upon its
passage by the City Council of the City of Canton, Fulton County,
Illinois, and approval by the Mayor thereof.

WESTERN ILlI"~OIS POLICE TRAINING UNIT
The undersigned units of local ;overnTent, charged with the duty of enforcing the
law and with providing train;n; for :~~~ law enforcement officers employed by each
of them, recc~ynize that none ~: to=^- individually has the resources, nor the volume
of trainees to support an i~:-servir_e training p-~ogram of the quality or at the cost
that could be provided in a joint ef;"crt with the financial assistance available
through the Intergovernmental Law Enlorcerr~ent Officers In-Service Training Act
(hereinafter called Act).
For and in consideration of the payT,ents and contributions herein set forth, and
the mutual covenants and obligations of the parties hereto, it is agreed by and
among the parties as follows:
1. AUTHORITY. The parties hereto enter into this contract pursuant to
the authority vested in them by Article V, Section 10, of the Constitu-
tion of the State of Iiiinois, and the Intergovernmental Cooperation
Act (III.Rev.Stats. 1e8;, Ch. 127, Sec. 41 et seq. for the joint
exercise of this pow=r to employ peace officers and to train therm,
in accordance with th= :r;tergovernmental Law Enforcement Officers
Training Act (III.Rev_c-ats., 1981, Ch. 85, Sec. 561 et seq.) as
any of them raay new cr r.ereafter be amended.
II. PURPOSE. The purpos? o` this contract is to create a multi-juris-
dictional unit to b~ known as the Western Illinois Police Training
Unit (hereir,~=?~r cal'~~ '„I~TU) which shall analyze and determine
the law enfr,- - :•f,> -P,:- ink needs of its members and provide
appropriate i~.-~~rvice -raining to its members° law enforcement
personnel and to law e~=•~cerrent employed by the state, by units of
local goverment or by tie federal government, or their agencies and

departments in the administration of justice. WIPTU will cooperate
and coordinate its efforts with the Illinois Local Governmental la~~
Enforcement Officers Training Board (hereinafter called the Police
Training Board) to the end of providing high quality, cost effective
training and participating in the financial assistance available
through the Act.
III. DEFINITIONS.
A. "Board" means the board composed of representatives of the Members
of WIPTU described in Article VII hereof.
B. "Member" means any unit of local government which ,by official action
of its governing body agrees to participate in WIPTU as provided
herein and is either an initial party to this contract or is added
as provided in Section IY(B) below.
C. "Units of local government" means counties, municipalities, town-
ships, special districts, and units designated as units of local
government by law, which exercise limited governmental powers or
powers in respect to limited governmental subjects, Dut does not

such question will be voted on has been mailed to each repre-
sentative on the Board not less than ten days prior to said meeting.
V. DURATION. This contract shall be effective on September 2l, 1982,
upon its execution by at least one county and one municipality and
shall continue until terminated as provided herein.
VI. DUTIES. WIPTU shall have as its duties and responsibilities those
which are prescribed in the Act and those which are set forth in this
contract. The WIPTU shall limit its operations to in-service training
of law enforcement personnel employed by the state, by units of local
government, or by the federal government, or their agencies and
departments in the administration of justice.
VII. BOARD.
A. The Board shall be composed of the County Board chairman and the
sheriff of each county which is a member and the chief executive
officer and the chief of police of each municipality which is a
member and the chief executive officer and the head of the law
enforcement agency of any other unit of local government which may
be a party, and either the executive director or the chairman of
the Police Training Board. Each such representative shall be a
representative by virtue of his office, and upon his termination,
his succf~s~or in the office shall replace him as a representative.

sit in his place on the Board. Such designation shall be
effective from the time it is delivered in writing to the

chairman of the Board until it is superseded by another
written designation or the representative making such
designation ceases to be a representative on the Board.
The presence of the regular representative on the Board
shall suspend the designation on file while the regular
representative is present.
a. Each representative shall have one vote on all matters coming before
the Board. ;io proxy voting shall be permitted except as provided
in Section VII(A)(1) above.
C. Twenty-fi.ve percent of all of the authorized representatives or
their designees shall constitute a quorum for the ,conduct of
business at any meeting.
0. The Board shall be responsible for overseeing the operation of
WIPTU and its powers and duties shall include, but not be limited to:
1. adopting by-laws and operating procedures.
Z. designating a financial officer who must be an elected local
government financial officer.
3. employing a qualified person or contracting with a qualifiedi
institution to srrrve as coordinator and approving the emplo}ment
of such other full or part-time staff as might be requires.
4. developing and approving the total budget for the WIPTU annually.
5. overseeing the development of training programs, the delivery of
training and the proper expenditure of funds.

operation of the WIPTU, including contracting for services and

7. soliciting, receiving gifts, bequests, etc.
8. establishing tuition, fees and charges for services of 41IPTU.
9. fixing an appropriate surcharge, discount, rebate- or other
device to equitably adjust the payments by non-members who
might send personnel to utilize the services of WIPTU in
relation to the payment by members.
10. exercising all other powers and duties that are reasonable to
fulfill its functions in furtherance of the purposes of this
Contract.
VIII. STAFF. The staff of the WIPTU shall consist of a coordinator appointed by
the Board who shall be the chief executive officer of WIPTU and such clerical
employees and other personnel as shall be authorized by the Board to be
necessary for the operation of WIPTU.
The powers and duties of the coordinator shall include:

to each fiscal year, a detailed proposed operating budget and a detailed
schedule of proposed training for the upcoming year.
E. securing and keeping in force at all times a policy or policies of
insurance in amounts to be deterrnined from time to time by the Board
to protect the Members and the Board against liabilities arising out
of the operation of WIPT!.1.

IX. OPERATIONS..
A. The fiscal year for WIPTU will be July 1 through June 30.
B. Members shall be given preference in registration of their employees
for a]1 services offered by WIPTU. All non-member fees and charges
shall be payable upon registration, except that delivery of contri-
butions of goods and services, conforminy to the rules of the
Police Traininy I;czard, and approved by the Board in lieu of cash,
may be scheduled by the coordinator,
X. FUtIGI~1G_. All participating members will pay dues as set by the Board
within 60 days of their assessment. Dues will be assessed on a per capita
basis based on the most recent census recorded by the U.S. Census Bureau.
XI. TERMINATION.
A. Any member may terminate its participation voluntarily only at the
end of any WIPTU fiscal year with sixty days advance written notice to
the Board.
B. Any member who fails to make any required payments within a reasonable
time after billing, ray he involuntarily terminated as a member, upon a
majority vote of ~';; cf tt~~r representatives of the Board. This shall be
in addition to any rs;'rtr rE~r,edies WIPTU may have for the collection or
past-due accounts.
C. In the event a m:erber is involuntarily terminated pursuant to this
contract, all of that member's rights to the services and privileges
of membership ir; :WIPTU shall immediately cease and abate; and any p~~yr~ents

IN WITNESS WHEREOF, the undersigned unit of local government has caused this
Agreement to be duly executed and has attached hereto a copy of the ordinance
or resolution authorizing the signing official to execute this Agreement.
