" AN ORDIN4NCE VACATING AN ALLEY
f
WHEREAS, it appears the City Council of the City of Canton, Illinois, That 65
ILCS/5/11-91-1 provides impertinent part that whenever the Corporate authorities of any
municipality in the State of Illinois determine that the public interest will be subserved by
vacating any street or alley, or part thereof, within their jurisdiction and any incorporated
area, that said municipality may vacate that street or alley, or part thereof, by ordinance;
and
WHEREAS, the Corporate authorities of the City of Canton, Fulton County,
Illinois, have determined that the aublic interest will be subserved by vacating an alley
ten (10) feet in width lying between Lofs 1, 2 and 3 in Keeling and Bilby's Addition to the
City of Canton running North and South one hundred and seven (107) feet from the
North line of Olive Street, situated in the County of Fulton, State of Illinois; and
WHEREAS, the alley described herein and the Frope,~ties contiguous thereto are
wholly within the jurisdiction and corporate limits of the City of Canton, Illinois, and;
WHEREAS, the Corporate authorities of the City of Canton, Illinois, have
determined That the relief to the public from further burden and responsibility of
maintaining the alley described herein constitutes a public use or public interest
authorizing the vacation.
NOW THEREFORE, AND BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, FULTON COUNTY, ILLINOIS:
1. That the City Council of the City of Canton, Fulton County, Illinois, hereby
finds the foregoing recitals to be fact.
2. That the following alley shall be vacated by the City:
a. All That part of a 10 foot wide alley lying between Lofs 1, 2 and 3 in
Keeling and Bilby's Addition to the City of Canton, Illinois as recorded

~' in Book 49 on Page 368 in the Office of the Fulton County Recorder of
= Deeds. (See attached -Exhibit "A'~
3. That the City Clerk of the City of Canton, Illinois, is hereby directed to
cause a certified copy of this Ordinance to be 1:tled wifh the ofttce of the
Fulton County Recorder of Deeds immediately upon the passage and
approval of this Ordinance.
4. This Ordinance shall be in full force and effect immediately upon his
passage bythree-fourths (3/4) majorify vote of the alderman holding office
in the City of Canton, Fulton County, Illinois, at a regular meeting thereof
on the 21St day of June, 2005, upon role call vote is follows:
AYES: A7-dermen Schenck, Reed, Carl, West, Sarff, Berardi,
Hartford .
NAYS: None,
ABSENT.' Alderman Meade.
