RESOLUTION NO . 1 ~ ,/,
A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE
CITY OF CANTON AND THE CITY OF PEORIA AND DIRECTING THE MAYOR AND
CITY CLERK TO EXECUTE AND DELIVER SAID AGREEMENT
WHEREAS, the Canton City Council has determined that it is
necessary and in the best interest of the City of Canton to enter
into that certain intergovernmental agreement hereto attached and
herein incorporated as Exhibit A.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CANTON, Fulton County, Illinois as follows:
1. That that certain intergovernmental agreement hereto attached
as Exhibit A between the City of Canton and the City of Peoria is
hereby approved.
2. That the Mayor and City Clerk are hereby authorized and
directed to execute and deliver the same on behalf of the City of
Canton.
3. That this Resolution shall be in full force and effect
immediately upon its passage by the City Council of the City of
Canton, Fulton County, Illinois, and approval by the Mayor thereof.
PASSED by the City Council of the City of Canton, Fulton
County, Illinois at a regular meeting this 21st day of
August 1984 upon a roll call vote as follows:

I. AUTNGRITY
Tf~is intergovernmental contract is agreed to by and between the City of Peoria,
Illinois, a municipal corporation, (hereinafter called "PEORIA") and
Canton, Illinois ~~
(Name of County, City, Village, etc.)
(hereinafter called "USER") pursuant to the authority vested in them by
Article VII, Section 10, of the Constitution of the State of Illinois and the
Intergovernmental Cooperation Act (111. Rev. Stat., 1977, Chapter 127,
Section 741 et seq.) as it is now or may hereafter be amended.

II. PURPOSE
The purpose of this contract is to ,,-~~ake available to the

a Law Enforcement Agency of USER (hereinafter called "USER AGENCY") at a reasonable
cost such computerized law enforcement information capabilities of the Peoria
Police Department (hereinafter called PPD) as are itemized on the attached
"REQUEST FOR INVOICE" form. 1t is recognized that this quick access to law
enforcement information will be a benefit not only to USER but to PEORIA and all
law enforcement agencies in the geographic area in their common effort to prevent
and detect crime, arrest and prosecute offenders and protect persons and property.
I11. SERVICES AVAILABLE
The services which are available from PPD are described below:
A. COMPUTER SERVICES
1. LEADS service provides USER AGENCY access to State of Illinois
computerized law enforcement data incorporated in the LEADS
.system--and other interfaced systems including NCIC if USER AGENCY
is authorized by LEADS to receive such information. It is
understood that USER AGENCY must secure a LEADS identifier from
the Illinois Department of Law Enforcement and maintain in effect
- such agreements as are required by the Illinois Department of Law
Enforcement. This service also provides USER AGENCY the capability
- ~ to send and receive bona fide law enforcement messages to and from
terminals in the LEADS network and the PPD system.
2. ON LINE INFORMATION SYSTEM SERVICE (OLIS) - OLIS service provides
USER AGENCY the capability to store information on line, subject to
reasonable limitations of space and technology. OLIS service made
available to USER AGENCY is comparable to that utilized by Peoria
Police Department and includes the capability of filing all incident
reports, and of entering file lists, citations and similar type
information as we]1 as the ability to inquire into the OLIS files
of all USER•AGENCtES in the PPD system and receive replies on line
at USER AGENCY's_ terminal and/or printer. Recognizing that space

that some older OLIS data may be stored on tape. Inquiric~ into
these files will be handled by PPD personnel and replies :r,ade as
promptly as circumstances and urgency of the request permit.
PPD will give i1SER AGENCY notice at least six (6) months in
advance of USER AGENCY reaching storage capacity and will agree .
with USER AGENCY which data is to be taken off line. ~~
3. COMPUTER ASSISTED DISPATCH (CAD) - CAD service provides USER
AGENCY the capability for automatic logging of all dispatches,
automatic assignment of incident numbers, units availab~e and
the recommended unit for dispatch, a constant units status display
and unit history records.
B. MAINTENANCE
Maintenance service includes regular preventive inspection, cleaning
and maintenance and repair service on USER AGENCY'S terminals and/or
_ printers. Repair is ordinarily accomplished by replacement of
malfunctioning parts, components or entire machines with comparable
parts, components or machines of the same model. Maintenance and
repair will be provided to all USERS on an equal basis; first come,
first served; provided, however, that maintenance or repair of
terminals shall be a priority above that of printers and that, except
in unusual situations, repair priorities shall be given to CAD service,
LEADS service and OLIS service in that order. USER AGENCY shall keep
all equipment in good condition.
C. PRIL'ATE LINES
PPD will make arrangements for private dedicated telephone lines to
service USER AGENCY equipment. PPD will pay line charges to the
telephone company involved and bill USER AGENCY accordingly.
IV. TERMS AND CONDITIONS
A. MODIFICATIONS
PPD reserves the right to make modifications or add options or accessories
to its equipment for the purpose of improving service and/or function.
Any expense involved in making modifications or adding options or
accessories to USER'S equipment to maintain its compatibility with PPD
computer system shall be soley that of USER. USER AGENCY shall not make
-~ ar,y modification to any equipment without the written permission of PPD.
B. COMPLIANCE WITH REGULATIONS
1. USER AGENCY shall utilize the system only in strict compliance with
all statutes, rules, regulations, policies and contractual
obligations applicable to the type of use being made, including
compliance with LEADS and NCIC regulations and current contracts
between PPD and the Illinois Department of Law Enforcement, copies
of which will be supplied to USER AGENCY by PPD.

their agencies or subdivisions which are required to maintain
USER AGENCY's eligibility to receive information covered by this
contract and shall provide PPD with a current copy of all such
agreements. ~
3. USER AGENCY warrants that each employee who is authorized physical
access to or use of the terminal/printer has been thoroughly
- trained on the provisions of all statutes, rules, regulations,
policies and contractual obligations referred to in Paragraphs
and 2 above, including this agreement.
C. SECURITY
1. USER AGENCY shall maintain terminal(s) and printer(s) in a secure
environment to insure that n_o unauthorized person has access to
them.
2. All persons authorized physical access to or use of any terminal
or printer shall be full-time or part-time paid employees of the
USER AGENCY who are authorized to receive iaw enforcement
information. No other persons, including officials or employees
of other agencies within USER or auxiliary or volunteer officers
or employees of USER AGENCY, shall be allowed access to any
terminal or printer.
3. USER represents that it has the authority to discipline or
discharge any 1JSER AGENCY employee who violates any provision
of this contract or the laws, rules or regulations, policies
_ and other contractual obligations incorporated herein by
reference, and will promulgate, rules and regulations, which
- make violations of this agreement punishable by dismissal.
D. LOGGING
1. All USER AGENCY dissemination of information received from the
terminal and/or printer shall be logged in a form approved by
PPD and maintained for a period of not less than three (3)
years.
2. PPD shall have the right to audit for compliance with this agree-
ment and all incorporated statutes, rules, regulations and
contractual obligations all inquiries, disseminations, storage
and use of information derived from the terminal and/or printer.
3. PPD shall have the right to investigate, jointly with USER AGENCY,
complaints, including complaints of citizens, of any misuse of
information derived from the terminal and/or printer and for that
purpose to interview employees..

E. SUSPENSION
Upon notification by any State or Federal Agency that USER AGENCY
has been suspended from receiving information covered by the con-
tract, PPD will immediately suspend such service until notified 1, _
that such suspension has been lifted. '`
PPD may also suspend service upon finding that any of the terms
and conditions of this contract have not been fulfilled, including
founded breaches of statutes or regulations of the State of
Illinois or of the United States dealing with collection, storage,
use. or dissemination of law enforcement information or dealing with
- public access or restrictions to such information, which may be
discovered or complained of.
The procedure when suspending service is as follows: PPD shall send
_ to USER AGENCY a notice of the date on which PPD intends to terminate
service, which shall be at least twenty (20) days after the date
of the notice. Prior to suspension USER AGENCY may reouest a hearing
at which the Superintendent of PPD will review USER AGENCY's reasons
or explanation for non-compliance with this agreement.
At the conclusion of said hearing the Superintendent may:
1. terminate service to USER AGENCY;
2. suspend service to USER AGENCY:

5. grant USER AGENCY a period of time to comply with this agreement.
If USER AGENCY is granted additional time to comply with this agreement,
a date sfiall be set -for a subsequent hearing to review USER AGENCY
compliance. At the second hearing, the Superintendent of PPD may
exercise any option he could have exercised upon the original hearing.
V. INDEMNITY
-- USER AGENCY shall indemnify and save harmless PEORIA, its officers, agencies
and employees from any and all liability to any person, corporation,
association, organization or entity of any kind in the exercise or enjoyment
of this agree~~~ent, including cost of any legal action and punitive damages.
V1. PAYMENT
USER AGENCY shall pay PPD for the services provided under this contract as
itemized on the "REQUEST FOR INVOICE" form which is attached hereto and
made a part hereof. The parties may renegotiate the fees or add or delete
services or products at any time upon mutual agreement and by substituting
an updated "REQUEST FOR:IIJVOICE" form signed and dated by the Superintendent
of PPD and the Chief Executive of USER AGENCY.

VII. TERM
' This contract shall take effect on August 1 ~ 1c~4
and shall continue in force subject to suspension of service provisions
until terminated by either party upon written notice to the other of 1
not less than thirty (30) days or at any time upon mutual agreement.
