A RESOLUTION APPROVING A "STIPULATION AND AGREEN~N~T'" BEI'4VEIIV THE CITY OF CANTON
AND THE COUNTY OF FULTON PERTAINING TO THE PROPERTY LOCATED AT 54 WEST MAPLE,
CANTON, ILLINOIS.
WHERF.,AS, the Canton City Council has determined that it is necessary and
in the best interest of the City of Canton to enter into an agreement with the
County of Fulton hereto attached and herein incorporated as Exhibit "A".
NOW, Tf~itEF'ORE, BE I:T RESOLVED BY THE CITY COUNCIL OF THE CITY OF CAN'T'ON,
Fulton County, Illinois, as follows:
1. That the agreement hereto attached as Exhibit "A" between the City of
Canton and the County of Fulton is hereby approved.
2. That the Mayor and City Clerk are hereby authorized and directed to
execute and deliver said agreement on behalf of the City of Canton.
3. That this Resolution shall be retroactive to, and effective as of
July 3, 1985, and in full force immediately upon its passage by the City Council
of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof.
PASSID by the City Council of the City of Canton, Fulton County, Illinois at
a regular meeting this 16th day of July. , 1985 upon a roll call vote as
follows:
AYES: Aldermen Chapman, May, Bohler, Workman, Sarff, Falcone,
Zilly, Kovachevich.
NAYS: None .
ABSENT: None .

STIPULATION AND AGREEN,ENT
This Stipulation and Agreement is made this 1st day of July,
A.D. 1985, by and between the County of Fulton, hereinafter referred
to as COUNTY, and the City of Canton, hereinafter referred to as
CITY.
WITNESSE'I'H that
1. At the request of the CI'i~Y the COUN'iY shall obtain ~.n Order
for Demolition in Fulton County Case No. 85-MR-19 pursuant to the
provisions of I11. Rev. Stat. 1983, Ch. 34, Para. 429.8 with reference
to a building situated at 54 k'est Maple Street, Canton, Illinois,
and more particularly described as follows:
Part of Lot I~'up-zber Sixty (60) in Wright' s
Addition to the City of Canton, Fu]_ton
County, Illinois bounded as follows, to-
wit: Commencing at a point on the North
line of said Lot 50 feet West of the
Northeast corner of said lot, thence
running South 50 feet, thence jdest 55 feet,
thence North 50 feet, to the North ]_ine of
said lot; and thence East 55 feet to the
place of beginning situated in the County
of Fulton, in the State of Illinois.
2. JAMES F. GRZAJZICH ar~d T~fiRCIA GRZANICH whose address is R.R.
~~1, Cs_nton, Illinois 61520 aa-e t'ne owners of record of the above-
described real estate.
3. Notwithstanding the aforementi_aned legal proceedings and the
dangerous and unsafe condition of the above-described building, JA~'~.ES
F. GR7.AJ~ICH and MARCIA GR7ANICH failed to and neglected to cause
~'er.~o].iti_on of said building,
4. That the Order for Demolition to be entered in this cause
empowers the COUNTY to demolish or cause the demolition of the above-
described buildi-r_g.
5. The CITY has agreed to undertake and pay for the demolition
of said property and the COUTITY has agreed to assign any and all lien
rights as a result of this undertaking to the CITY.
IT IS HEREBY AGREED AS FOLLOWS:
A. The COUNTY assigns to the CITY the right to demolish or
cause the demolition of the building situated on the above-described
real estate.
B. The COU73TY assigns any and all lien rights, accruing as a
result of these proceedings to the CITY.
C. The CITY agrees to assume any and all liability which
may result from the negligent, careless, or other improper demolition
of the said building, and agrees to indemx~ify and hold harmless the
COt?NTY for any liability resulting from the negligent, careless, or
other improper demolition of said building.
