RESOLUTION NO. 1113
A RESOLUTION ESTABLISHING "WORK PERIODS" FOR CITY OF CANTON
LAW ENFORCEMENT AND FIRE PROTECTION PERSONNEL PURSUANT TO
AUTHORITY OF SECTION 7(K) OF THE FAIR LABOR STANDARDS ACT,
CODIFIED AT 29 U.S.C. § 207 (K)
WHEREAS, Section 7(K) of the Fair Labor Standards Act
authorizes employers to establish "work periods" for law
enforcement and fire protection personnel; and,
WHEREAS, the Canton City Council has determined that it is
necessary and in the best interest of the City of Canton to
establish "work periods" for law enforcement and fire protection
personnel employed by the City of Canton.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF CANTON, Fulton County, Illinois as follows:
1. That the City of Canton hereby establishes "work periods"
within the meaning of Section 7(K) of the Fair Labor Standards
Act, codified at 29 U.S.C., §207(K), for law enforcement and
fire protection personnel employed by the City of Canton as
follows:

2. That the City of Canton shall pay its non-exempt fire
protection and law enforcement personnel overtime, .for
respectively, all hours worked over 212 per 28 days, and, for
all hours worked over 171 per 28 days, or, for any proportionate
number of hours worked in a fewer number of days (For example:
86 hours per 14 days).
3. That this Resolution shall be, to the fullest extent
authorized by law, retroactive to and effective as of April 15,
1985, or, to such other time as may be established by law.
4. That this Resolution shall be in full force and effect
immediately upon its passage by the City Council of the City
of Canton, Fulton County, Illinois, and approval by the
Mayor thereof .
PASSED by the City Council of the City of Canton, Fulton
County, Illinois at a regular meeting this 15th day of October,
1985, upon a roll call vote as follows:
AYES: Aldermen Kovachevich, Zilly, F~.lcone, Sarff, Bohler,
May, Chapman.
NAYS: None.
ABSENT: Alderman Zaorkman.
