ORDINANCE N0. ~
AN ORDINANCE AMENDING CERTAIN SECTIONS OF TITLE 6, CHAPTER 3 OF THE CANTON
MUNICIPAL CODE CONCERNING MISDEMEANORS AND REPEALING CERTAIN SECTIONS OF
TITLE 6, CHAPTER 3 OF THE CANTON MUNICIPAL CODE CONCERNING MISDEMEANORS.
WHEREAS, the Legal & Ordinance Committee of the City of Canton,
Illinois has determined that it is necessary, desirable and to the best
interests of the City of Canton to modify and amend certain sections of
Title 6, Chapter 3 of the Canton Municipal Code concerning misdemeanors
and to repeal and delete certain sections of Title 6, Chapter 3 of the
Canton Municipal Code concerning misdemeanors; and
WHEREAS, the City Council of the City of Canton, Illinois has made
a similar determination.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CANTON, ILLINOIS, AS FOLLOWS:
1. That Title 6, Chapter 3, Section 1-9 of the Canton Municipal Code
be, and the same is hereby amended to read as follows:
"6-3-1-9: CARRYING CONCEALED WEAPONS:
Whoever shall, within the city, wear or carry con-
cealed about his person any pistol, revolver, sling-
shot, metallic knuckles, bowie knife, dirk, razor or
other dangerous or deadly weapon, or whoever shall
display or flourish any such weapon in a boisterous
or threatening manner, shall be fined not less than
twenty five dollars ($25.00) nor exceeding five hun-
dred dollars ($500.00) for each offense; provided,
that the provisions of this Section shall not be
held to apply to any policeman, constable or other
police officer while in the discharge of his duty,
nor to any person summoned by any officer to aid
him in making an arrest or preserving the peace."
2. That Title 6, Chapter 3, Section 1-10 of the Canton Municipal Code
be, and the same is hereby amended to read as follows:
"6-3-1-10: PUBLIC DRINKING:
It shall be unlawful for any person or persons to
drink any intoxicating liquors, in any public street,
alley, lane, avenue, public square, vacant lot or
any unoccupied building within the City, and any
person found guilty thereof, shall be fined in
any sum not less than twenty five dollars ($25.00)
nor more than five hundred dollars ($500.00)."

3. That Title 6, Chapter 3, Section 1-11 of the Canton Municipal Code
be, and the same is hereby repealed and deleted from the Canton Municipal
Code.
4. That Title 6, Chapter 3, Section 1-12 of the Canton Municipal Code
be, and the same is hereby amended to read as follows:
"6-3-1-12: ADVERTISING DEVICES:
No person shall make, cause, permit or allow to be
made, any noise of any kind by means of any whistle,
bell, rattle, gong, clapper, loudspeaker, hammer,
drum, horn, megaphone, amplifier, phonograph, grapho-
phone or similar mechanical device or devices, or
by voice, at any time, for the purpose of advertising
any goods, wares or merchandise, or of attracting the
attention or inviting the patronage of any person to
do any business whatsoever anywhere in the City, under
a penalty of not less than twenty five dollars ($25.00)
nor more than five hundred dollars ($500.00) for each
offense; and such person shall be deemed guilty of
a separate and distinct offense for every day during
which such person shall continue such violation."
5. That Title 6, Chapter 3, Section 1-13 of the Canton Municipal Code
be, and the same is hereby amended to read as follows:
"6-3-1-13: KEEPING DOGS TIED:
It shall not be lawful for any person in the City
to keep any dog, whelp, bitch, calf or other animal
shut up or tied up in any yard, house or other place,
which, by barking, howling or by other noises shall
disturb the peace and quiet of any family, individual
or neighborhood, and any person violating any pro-
vision of this Section shall, upon conviction, be
fined not less than twenty five dollars ($25.00)
nor more than five hundred dollars ($500.00) for
each offense."
6. That Title 6, Chapter 3, Section 1-14 of the Canton Municipal Code
lie, and the same is hereby repealed and deleted from the Canton Municipal
Code.
7. That Title 6, Chapter 3, Section 2-1 of the Canton Municipal Code
be, and the same is hereby amended to read as follows:
"6-3-2-1: INDECENT EXPOSURE, LEWD ACTS:
Whoever shall, in the City, make an indecent ex-
posure of his or her person, or shall appear in
any public place exposed in his or her person in
an indecent or lewd dress, or in a state of nudity,
or shall be guilty of any other indecent or lewd
act, shall be fined not less than twenty five

dollars ($25.00) nor more than five hundred dollars
($500.00) for each offense."
8. That Title 6, Chapter 3, Section 2-2 of the Canton Municipal Code
be, and the same is hereby amended to read as follows:
"6-3-2-2: INDECENT CARTOONS, POSTERS:
Whoever shall, in any public place or places, open
to the public view, within the City, write or draw,
cut or make, print or paste any lewd or indecent
work, sentence, design, figure, poster, shall in
either case be subject to a fine of not less than
twenty five dollars ($25.00) nor more than five
hundred dollars ($500.00)."
9. That Title 6, Chapter 3, Section 2-8 of the Canton Municipal Code
be, and the same is hereby repealed and deleted from the Canton Municipal
Code.
10. That Title 6, Chapter 3, Section 3-1 of the Canton Municipal Code
be, and the same is hereby repealed and deleted from the Canton Municipal
Code.
11. That Title 6, Chapter 3, Section 3-2 of the Canton Municipal Code
be, and the same is hereby repealed and deleted from the Canton Municipal
Code.
12. That Title 6, Chapter 3, Section 3-3 of the Canton Municipal Code
be, and the same is hereby amended to read as follows:
"6-3-3-3: PLAYING BALL IN STREETS:
No person shall play at ball or raise or fly any kite
in any part of the City devoted to business purposes,
under a penalty of not less than five dollars ($5.00)
nor more than twenty five dollars ($25.00) for each
offense."
13. That Title 6, Chapter 3, Section 3-4 of the Canton Municipal Code
be, and the same is hereby amended to read as follows:
"6-3-3-4: DANGEROUS PLACES GUARDED:
Whoever shall leave open or insufficiently covered
and protected, any cellar window, door, vault, well,
cistern, excavation, coal hole, ditch or other like
hole, upon or adjoining any street, alley or sidewalk,
without securing or protecting the same, so as to pre-
vent the danger of persons or animals from falling
therein, shall be subject to a penalty of not less
than ten dollars ($10.00) nor more than one hundred
dollars ($100.00) for each offense; and every twenty

four (24) hours which such place shall remain un-
protected after notice to protect the same by some
officer of the City shall be deemed a separate offense."
14. That Title 6, Chapter 3, Section 3-5 of the Canton Municipal Code
be, and the same is hereby amended to read as follows:
"6-3-3-5: PLAYING ABOUT RAILROAD TRACKS:
It shall be unlawful for any person to play upon or
about any railroad track, depot, locomotive or car
within the City; or climb upon or jump from any car
or train of cars, or from one car to another while
the same may be in motion and every person violating
any provision of this Section shall be fined not less
than ten dollars ($10.00) nor more than one hundred
dollars ($100.00) for each offense. It is hereby
made the duty of the several members of the police
force to vigorously enforce the several provisions
of this Section, and all railroad employees shall
be empowered to arrest all persons found violating
the same."
15. That Title 6, Chapter 3, Section 3-6 of the Canton Municipal Code
be, and the same is hereby amended to read as follows:
"6-3-3-6: THROWING WATER:
Whoever shall wilfully turn a stream of water from
any fire hose or hydrant upon any person, or upon
any private premises without the consent of the owner
thereof, or upon any person or premises upon the
occasion of any exhibition or tournament, or other-
wise, except in case of afire, shall be liable to
a fine of not less than ten dollars ($10.00) nor
more than one hundred dollars ($100.00) for each
offense."
16. That Title 6, Chapter 3, Section 3-7 of the Canton Municipal Code
be, and the same is hereby amended to read as follows:
"6-3-3-7: THROWING OF STONES:
No person shall purposely, maliciously or heedlessly
cast or throw any stone, brick or other missile from
or into any public place, or at, or against or into
any building or shade or fruit tree, or other pro-
perty, or shall in any way, cut, mark, scratch, in-
jure or deface any building, fence, gate or tree,
or shall meddle with or injure any public or private
well, cistern, hydrant, or pump, within the City,
under a penalty, in each case, of not less than
ten dollars (.$10.00) nor more than one hundred
dollars ($100.00)."
17. That Title 6, Chapter 3, Section 3-8 of the Canton Municipal Code
be, and the same is hereby amended to read as follows:

"6-3-3-8: BARBED WIRE FENCES:
Whoever shall erect any fence six feet (6') high or
less along any street or alley or other public place
within the corporate limits of the City, of which
barbed wire, or any other sharp pointed or dangerous
material forms a part, shall be fined not less than
ten dollars ($10.00) nor more than one hundred
dollars ($100.00), and whoever shall suffer or
permit any such fence to remain along any pro-
perty owned or controlled by him, and separating the
same from any street, alley or other public place
within the City, after being notified to remove
same by a member of the Police Department, shall
be fined a like sum for every forty eight (48)
hours thereafter that it shall so remain."
18. That Title 6, Chapter 3, Section 3-9 of the Canton Municipal Code
be, and the same is hereby repealed and deleted from the Canton Muni-
cipal Code.
19. That Title 6, Chapter 3, Section 3-10 of the Canton Municipal
Code be, and the same is hereby repealed and deleted from the Canton Muni-
cipal Code.
20. That Title 6, Chapter 3, Section 3-11 of the Canton Municipal
Code be, and the same is hereby repealed and deleted from the Canton
Municipal Code.
21. That the remainder of Title 6, Chapter 3, Misdemeanors, of the
Canton Municipal Code remain in full force and effect.
22. That this ordinance shall be in full force and effect upon its
passage by the City Council of the City of Canton, Illinois and approval
by the Mayor thereof.
