ORDINANCE N0. g~3 ~
AN ORDINANCE AUTHORIZING THE SALE OF REAL PROPERTY OWNED BY THE CITY
OF CANTON, ILLINOIS FOR PRIVATE DEVELOPMENT WHICH PROPERTY IS GENERALLY
LOCATED ON EAST PINE STREET BETWEEN SOUTH MAIN STREET AND WHITE COURT
IN CANTON, FULTON COUNTY, ILLINOIS.
WHEREAS, the City of Canton has undertaken a program for the
reconstruction and redevelopment of a Redevelopment Area known as the
Central Business District in Canton, pursuant to the Real Property
Tax Increment Allocation Redevelopment Act, appearing in Chapter 24,
Section 11-74.4-1 et seq. of the Illinois Revised Statutes of 1979,
hereinafter referred to as the "Act"; and
WHEREAS, pursuant to the provisions of the Act, the City of Canton
adopted a Redevelopment Plan and Redevelopment Project, as amended,
hereinafter referred to as the "Plan", pertaining to the redevelopment
of the Redevelopment Area, which Plan was approved by the City Council
of the City of Canton on December 27, 1977; and
WHEREAS, in order to enable the City to achieve the objectives of
the Plan in accordance with the uses set forth therein, the City has
acquired and owns the following described real property:
Parts of Lot 56 and 57 in Nathan Jones' Second
Addition to the City of Canton, Fulton County,
Illinois, described as follows:
Beginning at the Northeast corner of said Lot
56; thence West 114 feet; thence South 52 feet;
thence East 40 feet; thence South 96 feet; thence
East 74 feet to the East line of Lot 57; thence
North 148 feet to the Point of Beginning
which property is generally located on East Pine Street between South
Main Street and White Court in Canton, Fulton County, Illinois and is
currently vacant; and

WHEREAS, the corporate authorities of the City of Canton have
determined that it is no longer necessary, appropriate, or in the best
interest of the City that it retain title to said real property, and
that said real property is not required for the use of, or profitable to
the City; and
WHEREAS, pursuant to Chapter 24, Section 11-76-2 of the Illinois
Revised Statutes of 1979, notice has been given of the proposal to sell
such real property for private development and bids have been invited
for the purchase of such real property for private development, said
notice having first been published on November 16, 1979, and having been
published for three successive weeks in the Canton Daily Ledger, a news-
paper published in the City of Canton; and
WHEREAS, pursuant to said notice, bids were opened at the regular
meeting of the corporate authorities held on December 18, 1979; and
WHEREAS, the following bids for the purchase of such property for
private development have been received:

Irwin N. Rushford $26,064.00
and
WHEREAS, the corporate authorities of the City of Canton believe that
the redevelopment of said real property pursuant to the Act and the Plan
is in the vital and best interests of the City and the health, safety,
morals and welfare of its residents, and is in accordance with the public
purposes and provisions of all applicable federal, state and local laws; and
WHEREAS, the corporate authorities of the City of Canton find and
determine that the best interests of the City and its residents will be
served by the acceptance of the bid submitted by Irwin N. Rushford and
the sale of the aforesaid real property to such bidder for private devel-
opment for the amount bid of twenty-six thousand sixty-four dollars
($26,064.00) which amount represents the high bid;

NOW, THEREFORE, BE IT ORDAINED BY THE CORPORATE AUTHORITIES OF
THE CITY OF CANTON, ILLINOIS, AS FOLLOWS:
1. The corporate authorities find as facts the recitals hereinabove
set forth.
2. The bid of Irwin N. Rushford in the amount of twenty-six thousand
sixty-four dollars ($26,064.00) is hereby accepted by the corporate
authorities of the City of Canton for the sale for private development of
the following described real property:
Parts of Lot 56 and 57 in Nathan Jones' Second
Addition to the City of Canton, Fulton County,
Illinois, described as follows:
Beginning at the Northeast corner of said Lot
56; thence West 114 feet; thence South 52 feet;
thence East 40 feet; thence South 96 feet; thence
East 74 feet to the East line of Lot 57; thence
North 148 feet to the Point of Beginning.
3. The Mayor of the City of Canton is hereby authorized and directed
to sign and the City Clerk is hereby authorized and directed to attest a
contract for the sale and purchase of the aforesaid real property for
private development, which contract is incorporated herein by reference
and shall be in the form attached hereto as Exhibit A.
4. Upon satisfaction of the terms of the aforesaid contract and upon
the payment or securing of the aforesaid bid price in the manner provided
in said contract, the Mayor of the City of Canton is hereby authorized and
directed to convey and transfer the aforesaid real property to Irwin N.
Rushford and Rose M. Rushford, husband and wife, in joint tenancy and not
in tenancy in common or to a land trust designated by Irwin N. Rushford
by a proper deed of conveyance, stating therein the aforesaid consideration,
and the City Clerk is hereby authorized to acknowledge and attest such
deed and to affix thereto the seal of the City of Canton.

5. The Mayor and the Clerk of the City of Canton are hereby author-
ized, respectively, to execute and attest such other documents as may be
necessary to the conveyance herein authorized.
6. This Ordinance shall be in full force and effect from and after
its passage by a vote of at least three-fourths of the corporate authorities
now holding office, and approval in the manner provided by law.
PASSED by a vote of at least three-fourths of the corporate authorities
of the City of Canton, Illinois now holding office, and APPROVED by the
