AN ORDINANCE ESTABLISHING SPECIAL SERVICE AREA NUMBER SIX OF THE CITY OF
CANTON, ILLINOIS.
WHEREAS, Chapter 120, Sections 1301 through 1311 of the Illinois
Revised Statutes, 1977, as amended, authorizes the City of Canton, Illinois
to establish a special service area and to issue bonds payable from taxes
as therein provided; and
WHEREAS, the City Council of the City of Canton, Illinois has deter-
mined that it is in the public interest to establish the area hereinafter
described as a special service area for the purposes set forth herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CANTON, FULTON COUNTY, ILLINOIS, AS FOLLOWS:
Section 1. Authority. Special Service Area Number Six is established
pursuant to the provisions of Sections 1301 through 1311 of Chapter 120,
Illinois Revised Statutes, 1977, as amended (hereinafter referred to as
the "Act").
Section 2. Findings.
A. The question of the establishment of the area hereinafter described
as a special service area is considered by the City Council pursuant to an
Ordinance entitled: "An Ordinance Proposing the Establishment of a Special
Service Area in the City of Canton and Providing for a Public Hearing and
Other Procedures in Connection Therewith" adopted November 6, 1979, and is
considered pursuant to a hearing held on December 4, 1979, by the City Council
pursuant to Notice duly published in the Canton Daily Ledger, November 15, 1979,
a newspaper published in the City of Canton, at least fifteen (15) days prior
to the hearing and pursuant to Notice by mail addressed to the person or
persons in whose name the general taxes for the last preceding year were
paid on each lot, block, tract or parcel of land lying within the special
service area. Said Notice was given by depositing said Notice in the United
States mails not less than ten (10) days prior to the time set for the
public hearing. In the event taxes for the last preceding year were not

paid, the said Notice was sent to the person last listed on the tax rolls
prior to that year as the owner of said property. A Certificate of Publi-
cation of said Notice and an Affidavit of Mailing of said Notice are
attached to this Ordinance as Exhibits 1 and 2. Said Notices conformed
in all respects to the requirements of the Act.
B. That a public hearing on the question set forth in the Notice
was held on December 4, 1979. All interested persons were given an
opportunity to be heard on the question of the creation of Special Service
Area Number Six and on the question of levying taxes and on the issuance
of bonds, as set forth in the Notice. All protests and objections were
heard and determined.
C. That after considering the data, as presented at the public hearing,
the City Council finds that it is in the public interest and in the interest
of the City of Canton Special Service Area Number Six that said special
service area, as hereinafter described, be established.
D. Said area is compact and contiguous and constitutes a residential
area of the City of Canton.
E. It is in the best interests of said special service area that the
furnishing of the municipal services proposed be considered for the common
interests of said area.
F. Said area will benefit specially from municipal services proposed
to be provided. The proposed municipal services are unique and in addition
to the municipal services provided to the City of Canton as a whole.
Section 3. Special Service Area Number Six Established. A special
service area to be known and designated as "City of Canton Special Service
Area Number Six" is hereby established and shall consist of the following
described territory:
Commencing at the Northeast corner of the Southeast
Quarter of Section 15, Township 7 North, Range 4 East
of the Fourth Principal Meridian in Fulton County,
Illinois the point of beginning; thence West along the
North line of said Southeast Quarter of said Section 15
to the center line of Illinois State Route 78; thence
South to a point on said center line of Illinois Route
78, 216 feet North of the South line of the North half
of said Southeast Quarter; thence West 605 feet; thence
South 216 feet; thence East 75 feet to the Northwest
corner of the South one half of said Southeast Quarter;
thence South to the Southwest corner of said Southeast
Quarter of Section 15; thence East 50 feet; thence South

1° 8' West, 180 feet; thence East 333.60 feet to an iron
pipe marker at an existing fence; thence South 62 feet
more or less; thence East 20 feet; thence South 70 feet;
thence West 80 feet; thence South 352 feet; thence East
20 feet; thence South 78.5 feet; thence West 20 feet;
thence South 77.8 feet; thence East 23 feet; thence
South 72.8 feet; thence East 177 feet to the West
right-of-way line of Illinois Route 78; thence East to
the East right-of-way line of Illinois Route 78; thence
North along said East right-of-way line to the Northwest
corner of Lot No. 1 of Northview Manor Subdivision Section
No. 1 as recorded in Fulton County, Illinois; thence East
187.72 feet along the North line of said Lot No. 1;
thence North along the West line of Northview Manor
Subdivision 596 feet to the South line of the Southeast
Quarter of said Section 15; thence East along the South
line of said Southeast Quarter to the East line of said
Southeast Quarter; thence North along said East line to
the point of beginning.
The approximate street location of the territory is the area bounded by
North Fourth Avenue on the East, Cyprus Street on the North, Evergreen
Estates Subdivision on the South and the Canton Park District property on
the West. An accurate map of said territory is attached hereto as Exhibit
3.
Section 4. Purpose of Area. City of Canton Special Service Area
Number Six is established to provide special municipal services to said
area in addition to services provided to the City generally. Included
in said purposes shall be constructing a potable water supply system and
sanitary sewage system. City of Canton Special Service Area Number Six
is also created so that bonds may be issued, for the purposes aforesaid,
payable from taxes levied on property in the special service area in addition
to all other City taxes so levied, provided no bonds shall be issued in excess
of the principal amount of $110,000.00 or at an interest rate to exceed eight
(8%) per cent per annum and said bonds to mature within twenty (20) years
from date.
Section 5. Effective Date. This Ordinance shall be in full force
and effect upon its passage by the City Council of the City of Canton,
Illinois and approval by the Mayor thereof.
PASSED by the City Council of the City of Canton, Illinois this 20th
day of May 1980, pursuant to a roll call vote as follows:
