AN ORDINANCE ESTABLISHING SPECIAL SERVICE AREA NUMBER ONE OF THE CITY OF
CANTON, ILLINOIS.
WHEREAS, Chapter 120, Sections 1301 through 1311 of the Illinois
Revised Statutes, 1977, as amended, authorizes the City of Canton, Illinois
to establish a special service area and to issue bonds payable from taxes
as therein provided; and
WHEREAS, the City Council of the City of Canton, Illinois has deter-
mined that it is in the public interest to establish the area hereinafter
described as a special service area for the purposes set forth herein.
NOia, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CANTON, FULTON COUNTY, ILLINOIS, AS FOLLOWS:
Section 1. Authority. Special Service Area Number One is established
pursuant to the provisions of Sections 1301 through 1311 of Chapter 120,
Illinois Revised Statutes, 1977, as amended (hereinafter referred to as
the "Act").
Section 2. Findings.
A. The question of the establishment of the area hereinafter described
as a special service area is considered by the City Council pursuant to an
Ordinance entitled: "An Ordinance Proposing the Establishment of a Special
Service Area in the City of Canton and Providing for a Public Hearing and
Other Procedures in Connection Therewith" adopted April 3, 1979, and is
considered pursuant to a hearing held on May 1, 1979, by the City Council
pursuant to Notice duly published in the Canton Daily Ledger, April 14,
1979, a newspaper published in the City of Canton, at least fifteen (15)
days prior to the hearing and pursuant to Notice by mail addressed to the
person or persons in whose name the general taxes for the last preceding
year were paid on each lot, block, tract or parcel of land lying within
the special service area. Said Notice was given by depositing said Notice
in the United States mails not less than ten (10) days prior to the time
set for the public hearing. In the event taxes for the last preceding

year were not paid, the said Notice was sent to the person last listed
on the tax rolls prior to that year as the owner of said property. A
Certificate of Publication of said Notice and an Affidavit of Mailing
of said Notice are attached to this Ordinance as Exhibits 1 and 2. Said
Notices conformed in all respects to the requirements of the Act.
B. That a public hearing on the question set forth in the Notice
was held on May 1, 1979. All interested persons were given an opportunity
to be heard on the question of the creation of Special Service Area Number
One and on the question of levying taxes and on the issuance of bonds, as
set forth in the Notice. All protests and objections were heard and
determined.
C. That after considering the data, as presented at the public hearing,
the City Council finds that it is in the public interest and in the interest
of the City of Canton Special Service Area Number One that said special
service area, as hereinafter described, be established.
D. Said area is compact and contiguous and constitutes a residential
area of the City of Canton.
E. It is in the best interests of said special service area that the
furnishing of the municipal services proposed be considered for the common
interests of said area.
F. Said area will benefit specially from municipal services proposed
to be provided. The proposed municipal services are unique and in addition
to the municipal services provided to the City of Canton as a whole.
Section 3. Special Service Area Number One Established. A special
service area to be known and designated as "City of Canton Special Service
Area Number One" is hereby established and shall consist of the following
described territory:
Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15,
16, 17, 18, 19, 20, 21, 22, 23 and 24 in East Locust
Street Extension Subdivision to the City of Canton,
in Fulton County, Illinois
and
Lots 6 and 8 in Eastern Star Subdivision, Block 1, to
the City of Canton, in Fulton County, Illinois.

The approximate street location of the territory is on East Locust Street
between the West line of East Locust Street Extension Subdivision and the
West curb line of North Fourteenth Avenue in the City of Canton, Illinois.
An accurate map of said territory is attached hereto as Exhibit 3.
Section 4. Purpose of Area. City of Canton Special Service Area
Number One is established to provide special municipal services to said
area in addition to services provided to the City generally. Included
in said purposes shall be reconstructing a section of East Locust Street,
including concrete curb and gutter with miscellaneous appurtenances, and
installing storm sewers, all to be constructed on existing public property
or property to be acquired by the City of Canton for these purposes. City
of Canton Special Service Area Number One is also created so that bonds
may be issued, for the purposes aforesaid, payable from taxes levied on
property in the special service area in addition to all other City taxes
so levied, provided no bonds shall be issued in excess of the principal
amount of $10,000 or at an interest rate to exceed eight (8%) per cent
per annum and said bonds to mature within ten (10) years from date.
Section 5. Effective Date. This Ordinance shall be in full force
and eff ect upon its passage by the City Council of the City of Canton,
Illinois and approval by the Mayor thereof.
