ORDINANCE NO.~
AN ORDINANCE AMENDING CERTAIN SECTIONS OF TITLE 8, CHAPTER 7 OF THE
CANTON MUNICIPAL CODE CONCERNING CEMETERIES, ADMINISTRATION.
WHEREAS, the Legal and Ordinance Committee of the City of
Canton, Illinois has determined that it is necessary, desirable and
to the best interests of the City of Canton to modify and amend certain
sections of Title 8, Chapter 7 of the Canton Municipal Code concerning
Cemeteries, Administration; and
WHEREAS, the City Council of the City of Canton, Illinois has
made a similar determination.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, ILLINOIS, AS FOLLOWS:
1. That Title 8, Chapter 7, Section 1 (E) of the Canton Municipal
Code be, and the same is hereby amended to read as follows:
"8-7-1 (E) Organization:
It shall be the duty of the Board of Cemetery Managers
as soon as may be convenient after appointment to meet
and organize by selecting one of their number to be
President and also another of their number to be Clerk
of such Board and also to elect a Treasurer of such
Board, who may or may not be a member of said Board,
and whose salary shall be fixed by the Board, and who
before entering upon his duties as such shall execute
a bond to the People of the State of Illinois for the
use of said Board of Cemetery Managers in a penal sum
of not less than double the value of the money and
property coming into his hands as such Treasurer,
conditioned for the faithful performance of his duties
and for the faithful accounting for all money or funds
which by virtue of his office comes into his hands,
and to be in such form and with such securities as may
be prescribed and approved by the Council, to be approved
and preserved in the same manner as is the bond of the
Treasurer of the City."
2. That Title 8, Chapter 7, Section 2 (D) of the Canton Municipal
Code be, and the same is hereby amended to read as follows:
"8-7-2 (D) Superintendent, Further Duties:
It shall be the duty of the Superintendent to dig,
without delay, all graves in said cemeteries, for the
digging of which application shall be made to him by
the owners of any lot or lots, or any other person
having the right of interment therein, and such appli-
cation shall, in all cases, be accompanied by a receipt
from the Treasurer or Secretary of the Board of Managers
showing that all fees and charges for the digging of
such grave and other work incident to such interment
have been paid to the Cemetery Treasurer, and also by
a burial permit from said Clerk as required by the
provisions of this Code relative thereto. Said Super-
intendent shall attend every interment in person or by
competent deputy; he shall fill up and neatly trim all
graves as soon as possible after depositing the coffin
therein; he shall also fill up and trim all graves that
have or may hereafter settle or sink in; he shall register
the names and ages of all persons interred in said
cemeteries and the places of their interments, subject
to the inspection of any person interested, and he shall,
on or before the first Monday in each month, make out
and furnish to the Clerk a statement, in writing, showing
the number of interments made in said cemeteries during
the preceding month, with the name and age of each person
so interred; he shall also keep the alleys, walks and
avenues in said cemeteries in good order and unobstructed,
so that a free passage and access may be had to all lots,
and he shall perform such other labor and services as
may be necessary and requisite to the duties of his
office and as the Board of Cemetery Managers may order
and direct; he shall superintend the grading and ornamen-
tation of all lots, and shall perform such work and
services for individual lot owners as may be reasonable,
or the Board of Managers may require, and shall certify
all charges for such services to the Clerk, subject to
the rules of said Board."
3. That Title 8, Chapter 7, Section 2 (E) of the Canton Municipal
Code be, and the same is hereby amended to read as follows:
"8-7-2 (E) Superintendent's Fees:
The fees to be charged for the services of the
Superintendent in connection with interments in said
cemeteries, which fees shall be paid to the Treasurer
of the Board of Cemetery Managers in advance before
said work shall be performed, and receipt given therefor,
shall be set by the Board of Cemetery Managers from time
to time. A list of these charges shall be conspicuously
posted at the Superintendent's office in the cemetery.
All fees and charges paid for these services shall be
paid to the Treasurer of the Board of Cemetery Managers."
4. That Title 8, Chapter 7, Section 3 (A) of the Canton Municipal
Code be, and the same is hereby amended to read as follows:
"8-7-3 (A) Gift Authorized:
Any person or persons whomsoever, is and are hereby
authorized and empowered to give, donate, devise or
bequeath any sum of money not less than one thousand
dollars ($1,000.00), or any funds, securities, or
property of any kind and value of which shall not be
less than one thousand dollars ($1,000.00), to said
Board of Managers, in perpetual trust, for maintenance,
care, repair, upkeep or ornamentation of such cemetery,
or any lot or lots, or grave in such cemetery, specified
in the instrument making such gift, donation, devise
or bequest. Said Board of Managers are hereby authorized
and empowered to receive and hold in perpetual trust

any such money, securities, funds and property given,
donated, devised or bequeathed to it in trust. Said
Board of Managers shall have the right to convert said
property into money, and shall invest the proceeds thereof
and the money so given, donated, and bequeathed to it,
as is or may be provided by the Statutes of the State of
Illinois as proper investments of trust funds. The
principal of such trust fund shall be kept intact and
perpetually invested, and the income thereof shall be
perpetually applied for the purposes specified, in the
instrument making such gift, donation, devise or bequest,
and for no other reason or purpose."
5. That the remainder of Title 8, Chapter 7, Cemeteries,
Administration, of the Canton Municipal Code, remain in full force
and effect.
6. That this Ordinance shall be in full force and effect
upon its passage by the City Council of the City of Canton, Illinois
and approval by the Mayor thereof.
