AN ORDINANCE AMENDING CERTAIN SECTIONS OF TITLE 9 OF THE CANTON MUNICIPAL
CODE CONCERNING TRAFFIC REGULATIONS AND REPEALING CERTAIN SECTIONS OF
TITLE 9 OF THE CANTON MUNICIPAL CODE CONCERNING TRAFFIC REGULATIONS.
WHEREAS, the Legal & Ordinance Committee of the City of Canton,
Illinois has determined that it is necessary, desirable and to the best
interests of the City of Canton to modify and amend certain sections of
Title 9 of the Canton Municipal Code concerning Traffic Regulations and
to repeal and delete certain sections of Title 9 of the Canton Municipal
Code concerning Traffic Regulations; and
WHEREAS, the City Council of the City of Canton, Illinois has made a
similar determination.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CANTON, ILLINOIS, AS FOLLOWS:
1. That Title 9, Chapter 3, Section 17 of the Canton Municipal
Code be, and the same is hereby amended to read as follows:
"9-3-17: SPEED RESTRICTIONS:
It shall be unlawful to drive any motor vehicle on any
street in the City of Canton, Illinois, not under the
jurisdiction of the Illinois State Department of Public
Works and Buildings, or the County, in an urban district
within the City of Canton at a speed in excess of thirty
(30) miles per hour, or in any alley in said City at a
speed in excess of fifteen (15) miles per hour.
It shall be unlawful to drive any vehicle on any highway
outside the urban district at a speed more than fifty
five (55) miles per hour.
It shall be unlawful to drive any vehicle of the first
division towing another vehicle, outside of any urban
district, in the said City of Canton, at more than fifty
five (55) miles per hour, in an urban district at more
than thirty (30) miles per hour, or more than fifteen (15)
miles an hour in an alley.
Provided, that if the Mayor and City Council by ordinance,
set other limits as provided by Statute of the State of
Illinois (Chapter 952, paragraph 147), after an engineering
of traffic survey, then such limits shall govern the rate
of speed on the streets indicated in such ordinance.
Appropriate signs shall be posted showing such speed limits.
The fact that the speed of a vehicle does not exceed the
applicable maximum speed limit does not relieve the driver
from the duty to decrease speed when approaching and crossing
an intersection, when approaching and going around a curve,

when appoaching a hill crest, when traveling upon any narrow
or winding roadway or when special hazards exist with respect
to pedestrians or other traffic by reason of weather or highway
conditions; and speed shall lie decreased as may lie necessary
to avoid colliding with any person or vehicle on or entering
the highway in compliance with legal requirements and the duty
of all persons to use due care.
It shall be unlawful to drive any vehicle on any street or
highway within the City of Canton, Illinois, under the juris-
diction of the State Department of Public Works and Buildings
of the State of T1linois, or of the County of Fulton, at a
speed exceeding that lawfully set for such streets.
Provided further, that the speed of all vehicles of the
second division as defined by the Statute of the State of
Illinois- shall be as follows:
(A) If the vehicle is designed and used for pulling or
carrying freight and has a gross weight of eight
thousand (8,000) pounds or less (including the
weight of the vehicle and maximum load), and is
equipped with pneumatic tires, the maximum is fifty
five (55) miles per hour outside of an urban district,
thirty (30) miles per hour in an urban district,
and fifteen (15) miles per hour in an alley, but if
such vehicle is equipped with two (2) or more solid
tires, the maximum speed is ten (10) miles per hour
at all times and in all locations.
(B) Tf the vehicle is designed and used for pulling or
carrying freight and has a gross weight of more than
eight thousand (.8,000) pounds (.including the weight
of the vehicle and maximum load), and is equipped
with pneumatic tires, the maximum speed is fifty (50)
miles per hour outside of an urban district and thirty
(30) miles per hoar in an urban district, and fifteen
(15) miles per hour in an alley; but if such vehicle
is equipped with two (2) or more solid tires, the
maximum speed is ten (10) miles per hour at all times
and in all locations."
2. That Title 3, Chapter 10, Section 2 (C) of the Canton Municipal
Code be, and the same is hereby repealed and deleted from the Canton
Municipal Code.
3. That Title 9, Chapter 10, Section 2 (D) 6, 7, 8 and 9 of the
Canton Municipal Code be, and the same is hereby repealed and deleted from
the Canton Municipal Code.
4. That Title 9, Chapter 11, Section 4 of the Canton Municipal
Code be, and the same is hereby amended to read as follows:
"9-11-4: PARKING VIOLATION:
Except as provided in Section 9-11-1 of the Canton Municipal
Code, any person accused of a violation of an ordinance pro-
hibiting parking a vehicle in a designated area or restricting

the length of time a vehicle may be parked there, may
settle and compromise the claim against him or her for such
violation by paying to the City the sum of five dollars ($5.00)
for each offense within twenty four (24) hours from the time
such violation was committed. Such payment shall be made at
the City Building and a receipt shall be issued for all money
so received, and such money shall be promptly turned over to
the City Treasurer to be placed in the General Fund. If such
payment is made, the members of the Police Department and
traffic officers are hereby authorized to refrain from insti-
tuting a prosecution for said violation.
Provided that this Section shall not apply to persons parking
a vehicle so as to obstruct the entrance or exit of any
place where police or fire department apparatus or other
emergency equipment is kept or housed, or so as to block an
emergency entrance in a hospital. Nor shall this Section apply
to any person charged with parking a vehicle so as to entirely
obstruct traffic in any street or alley, or parking in such a
way as to reduce traffic on an arterial street to one-way
traffic only; nor to any person who refuses to move a vehicle
illegally parked at the request of any member of the Police
Department."
5. That the remainder of Title 9,Traffic Regulations, of the Canton
Municipal Code remain in full force and effect.
6. That this Ordinance shall be in full force and effect upon its
passage by the City Council of the City of Canton, Illinois and approval
by the Mayor thereof.
PASSED by the City Council of the City of Canton, Illinois and
