ORDINANCE N0 . ~.,
Rezoning certain property of B.E.J.,
Incorporated, an Illinois Corporation,
in the Cite of Canton, Illinois.
[•~HEREAS, it appears to the City Council of the
'City of Canton, Illinois, that the territory hereinafter
described is located within the corporate limits of the City
of Canton, Illinois, said premises being generally located
South of West Hickory Street adjacent to and contiguous with
an existing property known as "Skateland", and
WHEREAS, it further appearing to said City Council
a petition for rezoning was duly filed and due and proper
notice thereof was published in the Canton i~aily Ledger, a
secular newspaper having a general circulation in the City
of Canton, County of Fulton and State of Illinois, said
notice being made and published according to the Statutes of
the State of Illinois and the ordinances of the City of
Canton, Illinois, and
WHEREAS, a public hearing was held before the
planning and Zoning Commission of the City of Canton, Illinois,
on June 8, 1931, concerning the request of B.E.J., Incorporated
to rezone the hereinafter described real estate from AG-1
Zoning Configuration to a B-2 Zoning Configuration, and
T~]HER_EAS, it further appearing to said City Council
that the planning and Zoning Commission did recommend to the
City Council of the City of Canton, Illinois, that the
property hereinafter described be rezoned for a special use
permit for an open-air business in accordance with 'T'itle lfi,
Chapter 9, Paragraph 3 (B), said special use permit being a
permitted special use under a B-2 Zoning Configuration,
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
ITHE CITY OF CANTON, ILLINOIS:
Section 1. That the Territory hereinafter described

e and the same is hereby rezoned for an open-air business
said use being a special use exception permitted by
Title 10, Chapter 9, Section 3(B), of the City Code of the
City of Canton, Illinois, said special use exception being
contained within the B-2 Zoning Configuration, and said
premises being more particularly described as follows, to-
wit:
A part of the Southwest Quarter of Section
Thirty-three (33), Township Seven (7) North of the
base line Range Four East of the Fourth Principal
Meridian, situated in the City of Canton, County
of Fulton and State of Illinois and being more
particularly described as follows, to-wit:
Commencing at the Southeast Corner of Lot Ten(10)
in Jackson Subdivision, a Subdivision of the
Southwest Quarter of Section Thirty-three (33)
Township Seven (7) North of the base line Range
Four East of the Fourth Principal Meridian, thence
running South by extending the East line of said
Lot Ten (10) a distance of .500 feet to a point;
thence Southwesterly parallel with the South line
of said Jackson Subdivision a distance of 300 feet
to a point; thence North 500 feet to the Southwest
Corner of Lot Twelve (12) of Jackson Subdivision;
thence Northeast along the South line of Lots 12,
ll, and 10 of Jackson Subdivision to the place of
beginning containing 3.444 acres, more or less.
Section 2. That the City of Canton zoning maps,
documents and related regulations be and the same are hereby
amended so that the territory hereinabove described shall
be, and the same is hereby made, to conform with the Zoning
Configuration granted by Section 1.
Section 3. That this ordinance shall be in effect
from and after a majority vote of the City Council of the
City of Canton, Illinois, and approval by the Iiayor thereof.

Dear Nancy:
Find enclosed Ordinance revised in accordance with
the Council Meeting last night. This Ordinance basically
changes the Ordinance previously submitted and given a first
reading from a B-2 Special Use to a AG-1 Special Use.
I have forwarded a copy of the Ordinance to Jim
Malmgren for review. I assume that this matter will be
placed on the Council's Agenda under old business for the
first meeting in July, .July 7, 1981.
