HomeMy WebLinkAboutOrdinance # 1889•~ ~- s ORDINANCE NO. 1889 AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY OF CANTON, FULTON COUNTY, ILLINOIS BELONGING TO ROBERT AND CONNIE BROWN AND LOCATED AT 20 MARLEE DRIVE, CANTON, ILLINOIS. WHEREAS, a Petition for Annexation, signed by the owner of record of the territory hereinafter described, was fled before the Planning and Zoning Commission of the City of Canton, Illinois, requesting said territory be annexed to the City of Canton and re-zoned to an R-2 (Single Family Residential District) zoning classification; and WHEREAS, the territory which is the subject of this Petition is described below: Lot 20 in Bar-Mac Subdivision of part of the North Half of Section 15, Township 7 North, Range 4 East of the Fourth Principal Meridian, according to the plat thereof recorded in Plat Book 4, page 25 as Document 371964, situated in the County of Fulton, in the State of lllinois. WHEREAS, Robert and Connie Brown are the owners of record of the territory to be annexed and there are no other owners of record and there are no electors residing within the said territory to be annexed and re-zoned other than Robert and Connie Brown; and WHEREAS, the territory to be annexed and re-zoned is part of the Copperas Creek Community Fire Protection District; and WHEREAS, proper notice of the Petition for Annexation has been given to the trustees of the Copperas Creek Community Fire Protection District as provided by law and an affidavit that service of notice has been made as provided by law has been filed with the Fulton County Recorder of Deeds; and WHEREAS, all petitions, documents and other necessary legal requirements are in full compliance with the Statues of the State of Illinois and the ordinances of the City of Canton, Dlinois and proper notice of the filing of the Petition for Annexation was given as provided by law; and WHEREAS, a public hearing was held before the Planning and Zoning Commission of the City of Canton, Illinois, on October 09, 2006, pursuant to proper notice published in the Canton Daily Ledger, a secular newspaper having a general circulation in the City of Canton, County of Fulton and State of Dlinois; and :. WHEREAS, on October 09, 2006, the Planning and Zoning Commission of the City of Canton, Dlinois, recommended to the City Council of the City of Canton, Dlinois that the territory described above be annexed to the City of Canton, Dlinois in a zoning classification of R 2 (Single Family Residential District), pursuant to the provisions of 6S ILCS 5/7-1-8 of the Dlinois Municipal Code; and WHEREAS, the highest and best use of the territory to be annexed is its use as a single family residential purpose; and WHEREAS, it is in the best interest of the City of Canton, Dlinois that said territory be annexed to the City of Canton, Dlinois, in an R-2 (Single Family Residential District), zoning classification. NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Canton, Dlinois, as follows: 1. That the City Council finds as facts the recitals hereinabove set forth. 2. That the territory described as above be and it is hereby annexed to the City of Canton, Dlinois. 3. That the described real property be and it is hereby zoned R-2, single family residential. 4. That the Zoning Administrator is directed to make the appropriate changes to the zoning maps of the City of Canton to show this annexation and zoning. 5. That Robert and Connie Brown is hereby granted to record with the Recorder of Deeds of Fulton County, Dlinois, and to file with the County Clerk of Fulton County, Dlinois, a certified copy of this Ordinance together with an accurate map of the territory annexed. 6. That this Ordinance shall be in full force and effect upon its passage by the City Council of the City of Canton, Dlinois, and approved by its Mayor thereof. PASSED by a majority vote of the City Council of the City of Canton, Dlinois, and APPROVED by the Mayor thereof this 21st day of November , 2006, upon a roll call vote as follows: AYES: ~-dermen Berardi, Hartford, West, Sarff, Meade, Carl, Schenck, I.,e~ais .
