ORDINANCE N0. J ~
AN ORDINANCE INITIATING AND COOPERATIVELY DESIGNATING AN ENTERPRISE ZONE
WHEREAS, the Illinois Enterprise Zone Act was certified and officially became
law as Public Act 82-1019 on December 7, 1982; and
WHEREAS; the City of Canton intends to cooperate with the County of Fulton
in designating an Enterprise Zone under the provisions of the Illinois Enterprise
Zone Act; and
WHEREAS, on December 21, 1982, the County of Fulton and the City of Canton
each held a public hearing within the proposed zone area on the question of whether
to create the zone, what local plans, tax incentives and other programs should be
established in connection with the zone, and what the boundaries of the zone should
be; and
WHEREAS, it is necessary that a formal application be made for approval of the
said designation to the Illinois Department of Commerce and Community Affairs by
December 31, 1982, said application to contain information on the proposed Enterprise
Zone and the cooperating entities plans for the zone.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON,
Fulton County, Illinois, as follows:
1. That the City of Canton hereby initiates and designates, subject to the
approval of the Department of Commerce and Community Affairs, and supports the
intent of the County of Fulton to initiate and designate as an Enterprise Zone,
the area described in Appendix A attached;
2. That the City of Canton finds that the designated Enterprise Zone area
is a contiguous area, comprises not less than one-half square mile and not more
than ten square miles in total area, exclusive of lakes and waterways, is a
depressed area, satisfies any additional criteria established by regulation of
the Department of Commerce and Community Affairs, and is entirely located within
the County of Fulton and partially located within the City of Canton as is reasonably
necessary for the establishment of such zone, thereby in all respects meeting the
qualifications of Section 4 of the Illinois Enterprise Zone Act;
3. That the City of Canton hereby provides for those tax incentives or
reimbursement for taxes set forth in Appendix C attached;
4. That the Enterprise Zone shall be in effect for twenty calendar years
and shall terminate at midnight on December 31, of the final calendar year unless
altered by proper legal procedure as set forth in the Act;
5. That the City of Canton will serve as the lead agency in the application
process;
6. That the City of Canton will be responsible for the overall administration
of the Enterprise Zone Program and the mayor of the City of Canton shall serve as
the Zone Administrator;
7. That there shall be created an Enterprise Zone Advisory Committee whose
function it shall be to recommend guidelines and criteria for the administration
of the zone program, to oversee the administration of the program and to serve.

shall consist of the individuals holding the offices or positions set forth in
Appendix B attached;
8. That the City of Canton may designate one or more organizations provided
for in the Enterprise Zone Act as designated Zone Organizations;
9. That both the County of Fulton and City of Canton may, by ordinance,
delegate functions within the Enterprise Zone to the designated zone organizations,
if any;
10. That the Mayor of the City of Canton shall execute such documents as may
be necessary for making the required application and said Mayor shall be authorized
to provide such additional information as may be required by the Department of
Commerce and Community Affairs.
11. That this Ordinance shall be in full force and effect immediately upon its
passage by the City Council of the City of Canton, Fulton County, Illinois and
approval by the Mayor thereof.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at
a special meeting this 27th day of December, 1982 upon a roll call vote as follows:
AYES: Aldermen Kovachevich, Hammond, Savill, Sarff, Carl, Horr.
NAYS: None.

APPENDIX C
TAX INCENTIVES
A. Property Tax Abatement
Property Tax Abatement may be granted by the City of Canton
on individual parcels within the Enterprise Zone on a case-by-
case basis, pursuant to the provisions of Sections 162 and 162e
of the Illinois Revenue Act. The City reserves the right to
abate any and all tax that the City may impose on said real
property within the limitations established by law. Whether and
to what extent to grant tax abatement shall be determined by the
Canton City Council at such time as proper request is duly made by an
eligible property owner within the Zone.
B. Sales Tax Reimbursement
Any retailer whose place of business is within the Enterprise
Zone and is located within an incorporated area of the City and who
makes a sale of building materials to be incorporated into real estate
in such Enterprise Zone by remodeling, rehabilitation, or new construction,
may file claim for credit or refund to recover the amount of tax paid
under the Municipal Retailers' Occupation Tax Act pursuant to Section 5k
of the Illinois Revenue Act.
