ORDINANCE NO. 956
AN ORDINANCE PROVIDING FOR HANDICAP PARKING ON CITY PARKING LOTS
WHEREAS, the Legal and Ordinance Committee and the Public Safety
and Traffic Committee, in conjunction with the Ad Hoc Handicap
Committee, have determined that it is necessary and in the public
interest to provide for handicap parking in parking lots owned,
controlled, or operated by authority of the City of Canton; and,
WHEREAS, the City Council of the City of Canton, Fulton County,
Illinois ha s made a similar determination.
NOW, THE REFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, Fulton County, Illinois as follows:
1. That Title 9, Chapter 5 of the Canton Municipal Code is
hereby amen ded by adding thereto Section 14 to read as follows:
"9-5-14: HANDICAP PARKING: (A) Handicap parking spaces shall
be provided in all City owned,
leased, or operated parking lots in a ratio of not
less than 4~ of the total of all parking spaces in
each such lot but with not less than two (2) such
handicap parking spaces per lot.
(B) That the use of such handicap parking spaces
shall be reserved to the exclusive use of handicap
persons subject, however, to all other restrictions
placed upon the parking of motor vehicles in such
lots. Identification of handicap persons using
such spaces shall be made in one of the following
ways:
(1) By reference to the display on a parked motor
vehicle of a handicap vehicle license plate issued by
one of the several States and displayed on a currently
registered motor vehicle; or,
(2) By reference to the display of a permanent
City of Canton handicap motor vehicle decal displayed
as hereinafter set forth; or,
(3) By reference to the display of a temporary City
of Canton handicap motor vehicle decal displayed as
hereinafter set forth.
(C) The Canton Police Department shall issue to the
registered owner of a currently licensed motor vehicle
registered to an address within the corporate limits
one (1) temporary/permanent handicap motor vehicle
decal for such handicap person's personal use and
one (1) temporary/permanent handicap motor vehicle
decal for each motor vehicle currently registered
to such person which such motor vehicle is also
currently licensed by the State of Illinois.
(D) Prior to the issuance of any such handicap decal,
the applicant shall present to the Police Department
a current certification signed by such applicant's
physician, stating that such applicant is temporarily
or permanently handicapped and stating the nature of
such handicap.

(E) A City of Canton permanent handicap motor vehicle
decal shall be issued for a period of not less than six
(6) months nor more than twelve (12) months; and, a City
of Canton temporary handicap motor vehicle decal shall be
issued for a period not to exceed six (6) months but in
no case shall such temporary decal be issued for a period
longer than the period of handicap certified by the
physician.
(F) Permanent and temporary City of Canton handicap motor
vehicle decals shall be affixed to the lower right hand
corner of the front windshield of the motor vehicle. The
only exception shall be in the case of a decal issued to a
handicap person for his personal use, which such decal shall
be prominantly displayed either on the dash or from the
inside rear view mirror of the vehicle in which such handicap
person is a passenger.
(G) Motor vehicles displaying a current City of Canton
handicap motor vehicle decal shall be allowed to park
with the rear or end of such motor vehicle facing the
front or interior end of any marked handicap parking
space.
(G) The construction and layout of handicap parking
spaces shall be in conformity with the requirements
set forth in State of Illinois, Capital Development
Board publication, "Accessibility Standards (Illustrated)"
[June 1978], as the same may be amended. Each such
handicap parking space shall be clearly marked and
identified as such.
(H) Handicap persons selling or transferring motor vehicles
shall remove the decal affixed to such vehicle prior to
the sale or transfer. No replacement decal shall be
issued unless the remains or scrapings from the prior
decal are presented to the Police Department at the time
the request for replacement is made.
(I) Use of a handicap parking space by a motor vehicle
not being then used for the transportation of handicap
persons shall subject the operator of such motor vehicle
to a fine of not less than $25.00 nor more than $200.00
for each such occurrence. The parking of a motor vehicle
not displaying a valid handicap marking as set forth in
subparagraphs B(1), B(2), or B(3), above, in a handicap
parking space shall be prima facie evidence of a violation
of this section of the Canton Municipal Code."
2. That this Ordinance shall be in full force and effect immediately
upon its passage by the City Council of the City of Canton, Fulton
County, Illinois, approval by the Mayor thereof, and publication
in pamphlet form as provided by law.
PASSED by the City Council of the City of Canton, Fulton County,
Illinois at a regular meeting this 19th day of October
1982, upon a roll call vote as follows:
AYES: Aldermen Kovachevich, Hammond, Savill, Sarff, Grant, Carl.
NAYS: None.

The pamphlet form of the aio-resaid Ordinance No. 956 including
the Ordinance and a cover sh~e~ thereof was prepared, and a copy o~ such
Ordinance was posted in the City Building, 210 E. Chestnut Street, Canton,
Illinois, commencing on October 20th 19 82 , and continuing for
at least ten (10) days ther~~~ter. Copies of such Ordinance were also
available for public inspec=icn upon request in the Office of the City
Clerk.
