ORDINANCE NO. 4227
AN ORDINANCE REZONING PROPERTY AT EAST WALNUT/S. 2ND AND VAN
BUREN FROM A I-2 ZONING CLASSIFICATION TO A R-4 ZONING
CLASSIFICATION
WHEREAS, Bluebird Avenue, LLC filed a petition with the Joint Planning & Zoning
Commission for the re-zoning of the real property described below, said property being within
the corporate limits of the City of Canton, Illinois; and
WHEREAS, Bluebird Avenue, LLC plans to purchase the real property described below from
the City of Canton on or about May 2021; and
WHEREAS,the current zoning classification of the property is 1-2 and it is the petitioner's
intent for the property to change to a R-4 zoning classification; and
WHEREAS, after proper notice, a public hearing on said Petition was conducted by the
Planning and Zoning Commission of the City of Canton on April 12, 2021.
WHEREAS, on April 12, 2021, the Planning and Zoning Commission recommended to the City
Council that the real property described below be rezoned pursuant to 65 ILCS 5/11-13-1 et. seq
WHEREAS, it is in the best interest of the City of Canton, Illinois that said property be rezoned
within the City of Canton, to meet future business growth and fit within the City's
comprehensive plan.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Canton, Illinois
as follows:
1. That the Canton City Council hereby finds as facts the assertions set forth above.
2. That the described real property be and is hereby rezoned from I-2 to R-4 as follows:
SECT/LOT: 73 JONES 2ND ADD S37
SECT/LOT: 74 JONES 2ND ADD N25 W 82
SECT/LOT: 74 JONES 2ND ADD S 57 1,2 W 1,2
SECT/LOT: 74 JONES 2ND ADD E1,2 6 E END N25 W1,2
SECT/LOT: 75 JONES 2ND ADD 16.5 X 161 S LT 75 ALL
3. That Bluebird Avenue, LLC will pay to the City of Canton the fees required to file a certified
copy of this Ordinance with the Fulton County Clerk and Recorder of Deeds, no later than ninety
(90) days from the date of this Ordinance.
4. Upon proof of filing of a certified copy of this Ordinance, the Zoning Administrator is
directed to make the appropriate map amendments to the City of Canton to reflect said re-zoning.
5. That this Ordinance shall be in full force and effect upon its passage by the City Council of
the City of Canton and approval by its Mayor.
PASSED by the City Council of the City of Canton, Illinois and approved by the Mayor thereof
this 4TH_day of May, 2021 upon a roll call vote as follows:
AYES: Alderman Justin Nelson,Angela Lingenfelter,Jeff Fritz, Angela Hale, Craig
