AN ORDINANCE PROVIDING FOR AND REQUIRING THE SUBMISSION OF THE
QUESTION OF ISSUING SEWER BONDS IN AN AMOUNT NOT TO EXCEED $2,000,000
TO THE VOTERS OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS AT THE
NONPARTISAN ELECTION TO BE HELD ON THE 8th DAY OF NOVEMBER, 1983.
WHEREAS, the City Council of the City of Canton, Fulton County,
Illinois (the "City"), has found and determined and does hereby find
and determine that it is necessary and in the best interests of the
City in order to promote, protect and safeguard the public health of
the inhabitants of the City that the combined sewer system and the
sanitary sewer system of the City be improved by increasing capacity
thus reducing incidents of basement flooding and overflows to water-
ways, by constructing relief sewers, intercepting sewers, pumping
station improvements, and the rehabilitation of sewers and manholes,
and by improvements to sewage treatment facilities to provide addi-
tional treatment capacity and increased removal of ammonia nitrogen,
BOD and suspended solids, all at an estimated cost of $7,857,300, and
in accordance with the plans and estimate of cost heretofore approved
by the City and now on file in the Office of the City Clerk, to include
all necessary controls and other appurtenances needed to provide a
complete operating sewer collection and treatment facility meeting
requirements of Illinois Pollution Control Regulation; and,
WHEREAS, before the City can borrow such money and issue bonds
for such purpose, a question therefore must be submitted to the voters
of the City and be approved by a majority of the voters of the City
voting upon said question, and it is deemed adviseable, necessary and
in the best interests of the City that the question therefore be sub-
mitted to the voters of the City at an election to be held and con-
ducted in accordance with the general election law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CANTON, Fulton County, Illinois, as follows:
1. That it is necessary and in the best interests of the City
that the combined sewer system and the sanitary sewer system of the
City be improved by increasing capacity thus reducing incidents of
basement flooding and overflows to waterways, by constructing relief
sewers, intercepting sewers, pumping station improvements, and the
rehabilitation of sewers and manholes, and by improvements to sewage
treatment facilities to provide additional treatment capacity and
increased removal of nitrogen, BOD and suspended solids;~.and, that
it is necessary and in the best interests of the City that money be
borrowed for the purpose of paying part of the cost of such construc-
tion and in evidence therof bonds of the City be issued therefore in an
amount not to exceed $2,000,000.

2. That there shall be borrowed for, by and on behalf of the City
a sum not to exceed $2,000,000 for the purpose of paying part of the
cost of constructing sewer improvements as hereinabove described, and
to evidence said loan negotiable bonds of the City shall be issued not
to exceed said amount. Each of said bonds shall be designated "Sewer
Bond" and bear interest from the date thereof at a rate or rates not
to exceed the maximum permitted by law, the same being the greater of
9~ per annum or 125 of the rate for the most recent date shown in the
20 G.O. Bonds Index of average municipal bond yields as published in
the most recent edition of The Bond Buyer, published in New York, New
York, at the time the contract is made for the sale of the bonds.
3. That the question hereinabove referred to be submitted to the
voters of the City in accordance with the general election law at the
nonpartisan election to be held Tuesday, the 8th day of November, 1983,
between the hours of 6:00 o'clock A.M. and 7:00 o'clock P.M. on said
day (the "Election").
4. That the Election shall be held in the voting precincts and at
the polling places established by the County Board (the "County Board")
of Fulton County, Illinois (the "County"), for voters of the City at
said nonpartisan election.
5. That the County Clerk of Fulton County, Illinois (the "County
Clerk") shall give notice of the Election in accordance with the general
election law by publishing notice thereof once in one or more local,
community newspapers published in the City, and also once in a news-
paper published in the County, the date of such publications of said
notice to be not more than 30 nor less than 10 days prior to the date
set for the Election.
6. That it is hereby found and determined that the Canton Daily
Ledger is a local, community newspaper published and having general
circulation in the City, as required by Sections 12-4 and 12-5 of the
Election Code of the State of Illinois.
7. That said notice shall include the following:

to be held on Tuesday, the 8th day of November, 1983, the
following question will be submitted to the voters of the
City of Canton, Fulton County, Illinois:
Shall bonds in the amount of not to exceed $2,000,000 be
issued by the City of Canton, Fulton County, Illinois, for
the purpose of paying part of the cost of constructing imp-
rovements to the City of Canton's combined sewer system and
sanitary sewer system, bearing interest at the rate of•not
to exceed the greater of 9~ per annum or 1250 of the rate
for the most recent date shown in the 20 G.O. Bonds Index
of average municipal bond yields as published in the most
recent edition of The Bond Buyer, published in New York,
New York, at the time the contract is made for the sale of
the bonds?
The polls at said election will be open at 6:00 o'clock A.M.
and continued open until 7:00 o'clock P.M. of that .day.

9. That the election shall be conducted by the election judges
appointed by the County Board to act in the voting precincts at which
said question will be submitted to the voters of the City.
10. That after the adoption hereof and not less than 61 days
prior to the date of the Election, the City Clerk of the City of
Canton, Fulton County, Illinois, shall certify a copy hereof to the
County Clerk in order that the question set forth herein may be sub-
mitted to the voters of the City at the Election.

11. That the Election shall be held and conducted and the returns
thereof duly canvassed, all in the manner and time as provided by the
general election law.
12. That all ordinances, orders and resolutions and parts thereof
in conflict herewith be and the same hereby are repealed, and that
this Ordinance shall be in full force and effect immediately upon its
passage by the City Council of the City of Canton, Fulton County,
Illinois, and approval by the Mayor thereof.
