A RESOLUTION AUTHORIZING REQUESTS FOR PROPOSALS FOR THE SALE OF
OUTLOT 1 OF THE ENTERPRISE INDUSTRIAL DISTRICT
WHEREAS,the City of Canton, Fulton County, Illinois ("City"), is a non-home rule unit
of government;
WHEREAS, Section 11-74.4-4(c) of the Illinois Municipal Code (65 ILCS 5/11-74.4-
4(c))provides, in part:
Within a redevelopment project area, acquire by purchase, donation, lease or eminent
domain; own, convey, lease, mortgage or dispose of land and other property, real or
personal,or rights or interests therein, and grant or acquire licenses, easements and options
with respect thereto, all in the manner and at such price the municipality determines is
reasonably necessary to achieve the objectives of the redevelopment plan and project. No
conveyance, lease, mortgage, disposition of land or other property owned by a
municipality, or agreement relating to the development of such municipal property shall be
made except upon the adoption of an ordinance by the corporate authorities of the
municipality. Furthermore, no conveyance, lease, mortgage, or other disposition of land
owned by a municipality or agreement relating to the development of such municipal
property shall be made without making public disclosure of the terms of the disposition
and all bids and proposals made in response to the municipality's request. The procedures
for obtaining such bids and proposals shall provide reasonable opportunity for any person
to submit alternative proposals or bids.
WHEREAS, the City currently owns real estate described as: Outlot 1 of the Subdivision
of Enterprise Industrial District, as set forth in the plat recorded in the Recorder's Office of Fulton
County, Illinois, as Document No. 84-8960, containing 6.529 acres, more or less, subject to all
present and future easements,covenants,and restrictions,all situated in the City of Canton,County
of Fulton, State of Illinois (P.I.N. 09-08-29-402-009) (hereinafter"Outlot 1");
WHEREAS, the corporate authorities, by this Resolution, have determined that Outlot 1
is no longer necessary, appropriate, required for the use of, profitable to, or for the best interests
of the City;
WHEREAS,Outlot 1 is located within the corporate boundaries of the City and within the
boundary of the City of Canton Tax Increment Financing (TIF) District I (hereinafter the "TIF
District");
WHEREAS,the corporate authorities have determined that it is in the best interests of the
City to obtain proposals from interested parties for the purchase of Outlot 1.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS AS FOLLOWS:
1. The Legal Notice, substantially in the form as attached hereto as "Exhibit 1", shall be
published, subject to any final revisions by the City's TIF attorneys or the City Attorney,
to request proposals for the purchase of Outlot 1;
2. The Legal Notice shall allow at least thirty (30) days from the first date of publication to
submit sealed proposals for the purchase of Outlot 1, which shall be submitted via U.S.
Mail to the City of Canton, ATTN: Mr. Christopher J. Jump, City Attorney, 2 North Main
Street, Canton, Illinois 61520. All proposals will be opened at the regular meeting of the
City Council on April 20, 2021 at 6:30 p.m. The proposals will be opened during the
meeting.
3. The proposals shall contain the offered price and proposed terms of acquisition. The City
requires the property to be acquired for a commercial and/or industrial manufacturing use
that is consistent with current City zoning and land use ordinances. The subject property is
currently zoned 1-2 Heavy Industrial. Proposals should, at minimum, contain:
a) Description of planned use;
b) Site plan;
c) Project financials including any incentives being requested from the City; and
d) Description of the project team.
4. The City shall retain the right to select any proposal received in accordance with the
requirements of the TIF Act,to waive any requirements or formalities, and further to reject
any or all proposals received. The City shall further reserve the right to request alternative
bids/proposals or to negotiate terms of the proposal after the deadline for the submission
of proposals has passed.
5. This Resolution shall be in full force and effective immediately upon its passage by the
City Council of the City of Canton and approval by the Mayor thereof.

LEGAL NOTICE
Requests for Proposals to Acquire City Owned Real Estate
by City of Canton
The City of Canton, Fulton County, Illinois (hereinafter the "City") owns a tract of real estate within the
corporate boundaries of the City and within the boundary of the City of Canton Tax Increment Financing(TIF)
District I(hereinafter the"TIF District").
The Illinois Tax Increment Allocation Redevelopment Act(hereinafter the"TIF Act")authorizes the conveyance
of municipal owned real estate in a manner and at such price as the municipality determines is reasonable and
necessary to achieve the objectives of the TIF Redevelopment Plan and Project(65 ILCS 5/11-74.4-4).
The TIF Act further provides that said conveyance must be made after approval of an ordinance by the corporate
authorities and after public disclosure of the terms of such disposition and all bids and proposals received in
response to the City's Request for Proposals.
Therefore, it is authorized by the Mayor and City Council of the City of Canton, as follows:
1. The City intends to convey all or a portion of the following described real estate known as Outlot 1 within the
Canton Industrial Park along Enterprise Lane (PIN#09-08-29-402-009), and is hereby accepting Requests for
Proposals from any party interested in acquiring such real estate. The full legal description for Outlot 1 is set
forth below. Said legal description shall be subject to final approval by the City prior to any closing on the sale
of the real estate intended to be transferred by the City.
2.Any party who is interested in acquiring such real estate shall submit a sealed proposal for said acquisition on
or before 5:00 P.M. on April 9,2021 via personal delivery or via U.S. Mail to the City of Canton,ATTN: Mr.
Christopher J. Jump, City Attorney, 2 North Main Street, Canton, Illinois 61520. The sealed proposal must be
personally delivered to the City Attorney's Office by 5:00 p.m.on April 9,2021 or postmarked by April 9,2021
to be considered. Any questions regarding this matter shall be directed to the City Attorney, Christopher Jump
of Davis&Campbell L.L.C., at(309)673-1681.
3. All proposals will be opened at the regular meeting of the City Council on April 20, 2021 at 6:30 p.m. The
proposals will be opened during said meeting.
