ORDINANCE NO. g72
AN ORDINANCE AMENDING CHAPTER 16, TITLE 1 OF THE CANTON MUNICIPAL
CODE RELATING TO THE OFFICE OF DIRECTOR OF BUDGET AND ADMINISTRATION
WHEREAS, the Negotiations, Grievance and Personnel Committee has
determined that it is necessary and beneficial to the City of Canton
to amend Chapter 16, Title 1 of the Canton Municipal Code as herein-
after set forth; and,
WHEREAS, the City Council of the City of Canton, Fulton County,
Illinois has made a similar determination.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, Fulton County, Illinois as follows:
1. That Chapter 16, Title 1 of the Canton Municipal Code is hereby
amended to read as follows:
"1-16-1: OFFICE CREATED: The office or position, to be
known as "Director of Budget and Administration",
be and the same hereby is created and established for service
to this City. The person filling this office shall be appointed
by the Mayor by and with the advice and consent of the City
Council.
1-16-2: OATH; BOND: Any person filling and discharging the
duties of the office hereby created shall, before
entering upon the duties of such office, take and subscribe the
oath prescribed by law for City officers and shall execute a bond
to the City in the penal sum of one thousand dollars ($1,000.00)
with surety to be approved by the Council, conditioned for faith-
ful performance of the duties of his office.
1-16-3: DUTIES: The duties of any person fulfilling the
office hereby created, and the duties and responsi-
bilities of the office itself, shall be as follows:
(A) As the administrative director under the Mayor, it shall be
the duty and responsibility of this office to coordinate the
work of all departments of City government.
(B) It shall be the duty and responsibility of this office to
recommend to the Mayor the hiring and suspension of all City
employees except those under the jurisdiction of the Board
of Fire and Police Commissioners and, further, excepting those
holding appointments as department heads; the power and author-
ity of discharge is reserved for the exclusive exercise of the
Mayor, City Council or the Department Heads, as the case may
be.
(C) It shall be the duty and power of this office to supervise the
purchase of all materials, supplies and equipment, not in ex-
cess of one thousand five hundred dollars ($1,500.00) for any
single purchase or contract, provided, however, that this
office, operating in conjunction with various department heads,
shall have the authority to make purchase of all materials,
supplies and equipment not exceeding the sum of one hundred
fifty dollars ($150.00) for any single purchase or contract.
For the purpose of clarification it is hereby expressly de-
clared that no contract in excess of one thousand five hundred
dollars ($1,500.00) and no contract for new construction shall
be let except by the Mayor and City Council.

(D) It shall be the power and duty of this office to receive,
from City personnel all complaints, suggestions, requests,
applications, petitions, correspondence, or other communica-
tions directed to the corporate authorities, and, wherever
possible, to take action promptly to adjust or resolve those
matters which do not require official action of the corporate
authorities (hereby expressly reserving unto all City personnel
the right to seek redress of any grievance by the Grievance
Committee of the City Council).
(E) It shall be the power and duty of this office to collate the
functions and activities of the various City departments/divi-
sions, together with the personnel thereof.
(F) It shall be the power and duty of this office to have direct
supervision and control over the day to day operations of the
Department of Community Development and to administer all
present and future programs touching thereon and to make
written report thereof monthly to the Mayor and the City
Council. It shall be the further duty of this office to be-
come and remain continually advised relative to the nature
and availability of both Federal and State grant programs
(or, similar programs) to do research thereof, and to prepare,
present and further to completion all applications for bene-
fits thereunder. When exercising such function, the Director
of Budget and Administration shall be known as the Director
of Community Development.
(G) It shall be the power and duty of this office to oversee the
City of Canton's Redevelopment Plan and Redevelopment Project
within the City's Real Proeprty Tax Increment area. In over-
seeing the Plan and Project, the Director shall take care to
given written reports to the City Council concerning the same
and shall in a timely manner, at least annually, not later
than April 30, prepare and present to the City Council a
written report setting forth anticipated tax increment re-
venues to be received in the next succeeding fiscal year.
(H) It shall be the further power and duty of this office to oversee
and prepare a City wide budget of all City departments and
offices consonant to the Annual Appropriation Ordinance of the
City. In the implementation thereof this office shall have
the further power and duty to administer all necessary book-
keeping procedure, assure compliance with the budget and re-
commend implementation of cost cutting measures in all depart-
ments. It shall be the further duty of this office to prepare
the budget herein contemplated within thirty (30) days prior
to approval of the Annual Appropriation Ordinance by this City
and to thereafter make the same available to the Mayor and
each member of the City Council, and with copy thereof to be
filed with the City Clerk of this City. In the interest of
the budget and control of the finances of this City it shall
be the further duty of this office to timely assist in the
preparation of the Annual Levy Ordinance of this City for
presentment to and adoption by the corporate authorities of
this City.
(I) It shall be the power and duty of this office to prepare a
written report showing the financial conditions and expenses
of all offices and departments of the City covering the pre-
ceeding twelve (12) month period and to provide a copy there-
of to the Mayor, each Council member and the City Clerk, in
the month of April of each year.
(J) It shall be the further power and duty of this

1-16-4: LIMITATION OF AUTHORITY: Nothing herein shall be
construed as placing the Director of Budget and
Administration in the Chain of Command between the various City
departments/divisions and the Mayor, as the Chief Executive Offi-
cer of the City. The Director of Budget and Administration shall
derive all power and authority either from this Chapter or from
lawful power and authority vested in the Mayor and lawfully dele-
gated by the Mayor to the Director of Budger and Administration.
1-16-5: SALARY; CONDITIONS OF EMPLOYMENT: The salary to be
paid to and conditions of employment of any person
filling the office hereby created shall be separately determined
in writing by the corporate authorities of this City and formally
determined by incorporation in such ordinance or resolution of
this City which determines salaries and conditions of employment
for employees generally, of this City.
1-16-6: AUTHORITY OVER OFFICE: The intendments of the office
hereby created shall be implemented forthwith and
thereafter maintained by the corporate authorities of this City.
1-16-7: ASSISTANTS: The office hereby created shall be
allowed such assistants and other clerks and sub-
ordinate help as the necessities of the office may require, and
the Council by ordinance or resolution shall from time to time
authorize employment by such office."
2. That this Ordinance shall be in full force and effect immedia-
tely upon its passage by the City Council of the City of Canton, Fulton
County, Illinois and approval by the Mayor thereof.

Illinois at a regular meeting this 1.9th day of Anril
1981 upon a roll call vote as follows:
