I further certify that on February 16, 2021 , the City Council of such municipality passed and approved Ordinance #4213 entitled: The ordinance attached is a true and correct copy of the ordinance adopted by Canton City Council. DATED AT CANTON, ILLINOIS, THIS 6th ��. 0' F BRUARY 2021 a Diana Pavley-Rock, CMC, City Clerk Seal City of Canton, Illinois ORDINANCE NO. 4213 AN ORDINANCE REZONING PROPERTY ON 42 WEST SPRUCE FROM A R-4 ZONING CLASSIFICATION TO A B-2 ZONING CLASSIFICATION WHEREAS, Heartland Investments, LLC filed a petition with the Joint Planning & Zoning Commission for the re-zoning of the real property described below, said property being within the corporate limits of the City of Canton, Illinois; and WHEREAS, Heartland Investments, LLC purchased the real property described below from Stuart A. Harrison, Sr. on or about 1/7/2021 ; and WHEREAS,the current zoning classification of the property is R-4 and it is the petitioner's intent for the property to change to a B-2 zoning classification; and WHEREAS, after proper notice, a public hearing on said Petition was conducted by the Planning and Zoning Commission of the City of Canton on February 8, 2021. WHEREAS, on February 8, 2021, the Planning and Zoning Commission recommended to the City Council that the real property described below be rezoned pursuant to 65 ILCS 5/11-13-1 et. seq WHEREAS, it is in the best interest of the City of Canton, Illinois that said property be rezoned within the City of Canton,to meet future business growth and fit within the City's comprehensive plan. NOW, THEREFORE,BE IT ORDAINED by the City Council of the City of Canton, Illinois as follows: 1. That the Canton City Council hereby finds as facts the assertions set forth above. 2. That the described real property be and is hereby rezoned from R-4 to B-2 as follows: Lot Number Seventy-five (75) in the Original Town, now City of Canton, situated in the County of Fulton and State of Illinois 3. That Heartland Investment, LLC will pay to the City of Canton the fees required to file a certified copy of this Ordinance with the Fulton County Clerk and Recorder of Deeds, no later than ninety (90) days from the date of this Ordinance. 4. Upon proof of filing of a certified copy of this Ordinance, the Zoning Administrator is directed to make the appropriate map amendments to the City of Canton to reflect said re-zoning. 5. That this Ordinance shall be in full force and effect upon its passage by the City Council of the City of Canton and approval by its Mayor.
