AN ORDINANCE ANNEXING AND RE-ZONING CERTAIN TERRITORY TO THE CITY
OF CANTON, FULTON COUNTY, ILLINOIS,
WHEREAS, a Petition for Annexation and Re-Zoning, signed by the
owners of record, contract sellers and contract purchaser of all the
land within the territory hereinafter described, was filed before the
Planning and Zoning Commission of the City of Canton, Illinois, req-
uesting that said territory be annexed to the City of Canton and
re-zoned; and
WHEREAS, the real estate which is the subject matter of this
Petition is legally described in Exhibit A, which is attached hereto
and made a part of this Ordinance by reference, and is located at
931 East Oak Street, Canton, Illinois; and
WHEREAS, George Bolling is the owner of record and contract
seller and George Bolling is the contract purchaser of the real
estate to be annexed and re-zoned and there are no other owners of
record; and
WHEREAS, the real estate to be annexed and re-zoned is not with-
in the corporate limits of any municipality, but is contiguous to
the City of Canton, Illinois; and
WHEREAS, the real estate to be annexed and re-zoned is part of
the Canton Community Fire Protection District, but is not a part of
any Public Library District; and
WHEREAS, proper notice of the filing of the Petition for
Annexation and Re-Zoning has been given to the Trustees of the Can-
ton Community Fire Protection District 'as provided by law arid~an
affidavit that service of notice has been made as provided by law
has been filed with the Fulton County Recorder of Deeds; and
WHEREAS, all petitions, documents and other necessary legal
requirements are in full compliance with the statutes of the State
of Illinois; and
WHEREAS, a public hearing was held before the Planning and
Zoning Commission of the City of Canton, Illinois on June 1~ 1984,
pursuant to proper notice published in the Canton Daily Ledger; and
WHEREAS, on June 11, 1984, the Planning and Zoning Commission of
the City of Canton, Illinois recommended to the City Council of the
City of Canton, Illinois that the real estate described in Exhibit A
be annexed to the City of Canton, Illinois in an I-1 (.Light Industrial
District) Zoning Classification, pursuant to the provisions of
Chapter 24, Section 7-1-8 of the Illinois Municipal Code; and
WHEREAS, the real estate to be annexed and re-zoned has been
used for many years as agriculture and home sites, is well suited
for industrial use and should be annexed to the City of Canton in an
I-1 (Light Industrial District) Zoning Classification; and
WHEREAS, the highest and best use of the real estate to be
annexed and re-zoned is its present use; and
WHEREAS, it is in the best interests of the City of Canton,
Illinois that said territory 6e annexed to the City of Canton,
Illinois in an I-1 (.Light Industrial District) Zoning Classification.
NOW, THEREFORE, BE TT ORDAINED BY TH:E CI'TY' COUNCIL OF THE CITY
OF CANTON, ILLINOIS, AS FOLLOWS:
1. That the City Council finds as facts the recitals herein
above set forth.
2. That the territory described in Exhibit A., which is attached
hereto and made a part of this Ordinance by reference, be and the
same is hereby annexed to the City of Canton, Illinois.
3. That this property shall be annexed in an I-1 (.Light
Industrial District) Zoning Classification.
4. That the Zoning Administrator of the City of Canton, Lllinois
is hereby directed to make the appropriate changes to the zoning maps
of the City of Canton to reflect this annexation and rezoning.
5. That the City Clerk of the City of Canton, Illinois is
hereby directed to record with the Recorder of Deeds of Fulton County
and to filewith the County Clerk of Fulton County a certified copy
of this Ordinance, together with an accurate map of the annexed
territory.
6. That this Ordinance shall be in full force and effect upon
its passage by the City Council of the City of Canton, Illinois and
approval by the Mayor thereof.
PASSED by a majority vote of the City Council of the City of
Canton, Illinois and APPROVED by the Mayor thereof this ~_day of

EXHIBIT A
Beginning at the corner of the intersection of
the East R.O.W, line of S. 9th St, with the
North R.O.W, line of Oak St. thence Northerly
along the East R.O.W, line of S. 9th St, a
distance of 377 feet; thence Easterly a distance
of 200 feet; thence Southerly a distance of 377
feet; to the N. R.O.W. line of Oak St.; thence
Westerly along said R.O.W. line to the point of
beginning, said tract of ground containing 1.73
acres, more or less and all 6ei'ng in Fulton County
in Illinois.
