HomeMy WebLinkAboutOrdinance #1073e .~ ORDINANCE N0. 10 7 3 AN ORDINANCE PROVIDING FOR THE Lr'VY OF A SERVICE CHARGE TO BE COT.T.Fx'_~n FROM PERSONS, FIRMS AND CORPORATIONS .RECEIVING GARBAGE SERVICE IN THE CITY OF CANTON, ILLINOIS. WHEREAS, Section 11-19-4 of Chapter 24, Illinois Revised Statues (1983) provides that the corporate authorites may, in addition to the levy of a garbage tax, finance the establishment and maintenance of systems or plants for the collection and disposal or solely for the collection or solely for the disposal of garbage, refuse and ashes by service charges to be collected from persons, firms and corporations receiving the service; and, WHEREAS, the standing committees of the Canton City Council, meeting as a committee of the whole, have determined that it is necessary and in the best interest of the City of Canton to levy such a service charge; and, WHEREAS, the Canton City Council hereby formally makes a similar determina- tion. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the Canton City Council hereby finds the foregoing recitals to be fact. 2. That Title 8 of the Canton Municipal Code is hereby amended by adding thereto the following Chapter 18 to be entitled: Garbage Service Charge. 3. "SERVICE CHARGE: That the Canton City Council hereby establishes a service charge, in addition to the levy of a garbage tax, to finance the establishment and maintenance of systems or plants for the collection and disposal or solely for the _ __ collection or solely for the disposal of garbage, refuse and ashes by a service charge of one dollar fifty cents ($1.50) per month to be collected from persons, firms and corporations receiving such service. 4. PAYN~l'I' OF BILLS: Said service charge shall be billable bi-monthly and payable by the tenth day of the month following the month of billing. "I'he owner of the premises, the occupant thereof or the user of the service shall be liable to pay for the service to such premises and the service furnished to the premises by the City, upon the condition that the owner of the premises, occupant of the premises or user of the service: is liable therefor to the City. All bills for service shall be mailed bi-monthly no later than the last day of the billing month and shall be payable not later than the close of business on the tenth day thereafter following. If payment of the full amount of the bill is made after said tenth day, a penalty of ten percent (10~) of the amount of the bill shall be added to the outstanding balance. An additional charge of five dollars ($5.00) shall be charged to accounts paid by check, draft or other negotiable instrument when such check, draft or other negotiable instnament is returned and not honored for payment. In the event that said service charge is billed together with City water and sewer service charges, the aggregate payment(s) received from any such user.. or customer shall be first applied to the full payment of the service charge, plus. r all penalties and other charges accrued thereon; the remaining balance of any such aggregate pyament(s) shall be then applied to the water and sewer charges. 5. DISCONTINUANCE OF SERVICE: If the service charge for such services are not paid by the twenty fifth day of the month following the month of mailing of the bill for such service, such service shall be immediately discontinued without further notice and shall not be reinstated until all past due bills, including the penalties .thereon, are paid in full. The service charge may be voluntarily discontinued by the user or customex for periods of not less than 30 consecutive days by making written request to the City of Canton. Such request must state the address affected, service stop date, service start date, and City account number,-as applicable. If the rates or charges for such services are not paid by the twenty fifth day of the month after the mailing of the bill, there shall be an additional charge of ten dollars ($10.00) for discontinuing said service. 6. BILLING AND COLLECTION: Qualified personnel appointed by the Mayor and Council shall render bills and collect moneys for service for all rates and charges in connection therewith. All revenues and moneys derived from said service charge shall be kept separate and apart from his private funds and said sum, without any deducting whatever, shall be delivered to the City Treasurer not more than fifteen (15) days after receipt of the same, or at such more frequent intervals as may from time to time be directed by the Mayor and Council. 7. DUTY OF CITY TREASURER: The City Treasurer shall receive all such revenues Pram said service charges and all other funds and moneys incident thereto as the same may be delivered to him and deposit the same in the general fund, Garbage Department, of the City and said Treasurer shall administer such fund in every respect in the manner provided by the provisions of the Illinois Municipal Code, effective July 1, 1961, and all laws amendatory thereof and supplementary thereto. Revenues so received. shall be used solely to defray the cost of operation, maintenance, and .service of a depreciation fund of the City of Canton, Garbage Department. The City Treasurer shall establish a proper system of accounts and shall keep proper books, records and accounts in which complete and correct entries shall be made of all transactions relative to the Garbage Department Fund, and at regular annual intervals he shall cause to be made an audit by an independent auditing concern of the books to show the receipts and disbursements of the fund. 8 GUIDELINES, RULES AND REGULATIONS: The Streets and Garbage Committee is hereby tasked with the responsibility of developing and promulgating written guide- lines, rules and regulations to be used in the implementation and perpetuation of said service charge. 9. That the Levy of such a service charge to be collected from persons, firms and corporations receiving garbage service is reasonable expected to yield revenues not in excess of the cost of operation, maintenance, and an adequate depreciation fund for the City of Canton Garbage Departm~azt." 10. That the City Clerk, in cooperation with the City of Canton Water and Sewer Department, shall, immediately upon the passage of this ordinance, cause a copy of this ordinance to be furnished to each customer receiving garbage. service. 11. That this ordinance shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof.
