ORDINANCE N0. 1070
AN ORDINANCE REDUCING SPEED LIMITS ON EAST BIRCH STREET BETWEEN THE EAST RIGHT-
OF-WAY LINE OF NORTH MAIN STREET TO A POINT 500 FEET EAST OF THE EAST RIGHT-OF-
WAY LINE OF NORTH FIFTH AVENUE.
WHEREAS, the Canton Police Department has made a traffic investigation of
a section of East Birch Street within the City of Canton, Fulton County, Illinois
between the East right-of-way line of North Main Street to a point 500 feet East
of the East right-of-way line of North Fifth Avenue, all in conformity with
Chapter 95~, sl1-604 of Illinois Revised Statutes (1983); and,
WHEREAS, such traffic investigation has shown that the existing 30 MPH speed
limit on East Birch Street is greater than is reasonable or safe with respect to
conditions existing on East Birch Street; and,
WHEREAS, the Legal and Ordinance Committee has determined that it is necessary
and in the best interest of the City of Canton to reduce speed limits on East Birch
Street in the City of Canton; and,
WHEREAS, the Canton City Council has made a similar determination.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON,
Fulton County, Illinois as follows:
1. That the Canton City Council hereby finds and determines the foregoing
recitals to be fact.
2. That, accordingly, Title 9, Chapter 3, Section 17 of the Canton Municipal
Code is hereby amended by adding the following section thereto:
"9-3-17.2 SPECIAL SPEED LIMIT ON EAST BIRCH STREET: It shall be unlawtul
for any vehicle to be driven or operated on East Birch Street in
the City of Canton between the East right-of-way line of North Main Street
to a point 500 feet East of the East right-of-way line of North Fifth Avenue
at a speed greater than twenty-five (25) miles per hour. Penalties for
violations of this section shall be as established for speed violations in
Chapter. 95~, Illinois Revised Statutes."
3. That the Street Superintendent shall post appropriate speed signs informing
the public of this Ordinance.
4. That this Ordinance shall be in full force and effect ten.(10) days after
its passage by the City Council of the City of Canton, Fulton County, Illinois,
approval by the Mayor thereof, and publication in pamphlet form as provided by law.
PASSED by the City Council of the City of Canton, Fulton County, Illinois
at a regular meeting this 18th _ day of ,~~rie , 1985 upon a roll call vote
