AN ORDINANCE REDUCING SPEED LIMITS ON NORTH FOURTH AVENUE BETWEEN THE NORTH
MIGHT-OF-WAY LINE OF EAST BIRCH STREET TO A POINT 500 FEET NORTH OF THE
NORTH RIGHT-OF-WAY LINE OF LINDEN STREET
WHEREAS, the Canton Police Department has made a traffic investigation
of a section of North Fourth Avenue within the City of Canton, Fulton County,
Illinois from the North right-of-way line of East Birch Street to a point
500 feet North of the North right-of-way line of Linden Street, all in conformity
with Chapter 95~, sl1-604 of Illinois Revised Statutes (1983); and,
WHEREAS, such traffic investigation has shown that the existing 30 MPH speed
limit on North Fourth Avenue is greater than is reasonable or safe with respect
to conditions existing on North Fourth Avenue; and,
WHEREAS, the Legal and Ordinance Committee has determined that it is necessary
and in the best interest of the City of Canton to reduce speed limits on North
Fourth Avenue in the City of Canton; and,
WHEREAS, the Canton City Council has made a similar determination.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON,
Fulton County, Illinois as follows:
1. That the Canton City Council hereby finds and determines the foregoing
recitals to be fact.
2. That, accordingly, Title 9, Chapter 3, Section 17 of the Canton Municipal
Code is hereby amended by adding the following section thereto:
"9-3-17.3 SPECIAL SPEED LIMIT ON NORTH FOURTH AVENUE: It shall be
unlawful for any vehicle to be driven or operated on North
Fourth Avenue in the City of Canton between the North right-of-way line
of East Birch Street to a point 500 feet North of the North right-of-way
line of Linden Street at a speed greater than twenty-five (25) miles per
hour. Penalties for violations of this section shall be as established
for speed violations in Chapter 9512, Illinois Revised Statutes."
3. That the Street Superintendent shall post appropriate speed signs informing
the public of this Ordinance.
4. That this Ordinance shall be in full force and effect ten (10.) days after
its passage by the City Council of the City of Canton, Fulton County, Illinois,
approval by the Mayor thereof, and publication in pamplet form as provided by law.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at
a regular meeting this 4th day of June 1985 upon a roll call
vote as follows:
AYES: Aldermen Kovachevich, Zilly, Falcone, Sarff, Bohler, May,
Chapman .
NAYS : None .
