HomeMy WebLinkAboutOrdinance #1121ORDINANCB NO. 11.21 AN ORDINANCE AMENDING TITLE 9, CHAPTER 5 OF THE CANTON MUNICIPAL CODE AND AMENDING TITLE 9, CHAPTER 10 OF THE CANTON MUNICIPAL CODE RELATING TO HANDICAP PARKING. Whereas, the Legal and Ordinance Committee has determined that it is in the best interest of the City of Canton to Amend Chapters 5 and 10, title 9 of the Canton Municipal Code relating to handicap parking; and, Whereas, the Canton City Council has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY CITY COUNCIL, OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That Title 9, Chapter 5, Section 14 of the Canton Municipal Code be, and the same hereby is, amended to read as follows: "9-5-14: HANDICAP PARKING: (A) Handicap parking spaces shall be provided in all City owned, leased or operated parking lots in a ratio of not less than four percent (4$) of the total of all parking spaces in each such lot but with not less than two (2) such handicap parking spaces per lot. (B) That no motor vehicle shall be parked in a handicapped parking space on either public or private property in violation of this Ordinance, of Section 3-616, or of Section 11-1301.2 of the Illinois Vehicle Code (Ch. 95~, 111. Rev. Stat.). (C) That the use of such handicap parking spaces shall be reserved to the exclusive use of handicap persons subject, however, to all other restrictions placed upon the parking of motor vehicles in such lots. Identification of handicap persons using such spaces shall be made in one of the following ways: 1. By reference to the display on a parked motor vehicle of a handicap vehicle license plate issued by one of the several states and displayed on a currently registered motor vehicle; or, 2. By reference to the display of a permanent City handicap motor vehicle decal or device displayed as hereinafter set forth; or, 3. By reference to the display of a temporary City handicap motor vehicle decal or device as hereinafter set forth. (D) The Canton Police Department shall issue to the registered owner of a currently licensed motor vehicle registered to an address within the corporate limits one temporary/permanent handicap motor vehicle decal or device for such handicap person's personal use and one temporary/permanent handicap motor vehicle decal or device for each motor vehicle currently registered to such person which such motor vehicle is also currently licensed by the State of Illinois. (E) Prior to the issuance of any such handicap decal or device, the applicant shall present to the Police Department a current certification signed by such applicant's physician, stating that such applicant is temporarily or permanently handicapped and stating the nature of such handicap. (F) A City permanent handicap motor vehicle decal or device shall be issued for a period of not less than six (6) months nor more than twelve (12) months; and, a City temporary handicap motor vehicle decal or device shall be issued for a period not to exceed six (6) months but in no case shall such temporary decal or device be issued for a period longer than the period of handicap certified by the physician. (G) Permanent and temporary City handicap motor vehicle decals or devices shall be affixed to the lower right hand corner of the front windshield of the motor vehicle. The only exception shall be in the case of a decal issued to a handicap person for his personal use, which such decal or device shall be prominantly displayed either on the dash or from the inside rear view mirror of the vehicle in which such handicap person is a passenger. (H) Motor vehicles displaying a current City handicap motor vehicle decal or device shall be allowed to part with the rear or end of such motor vehicle facing the front or interior end of any marked handicap parking space. (I) The construction and layout of handicap parking spaces shall be in conformity with the requirements set forth in State of Illinois Capital Development Board publication , "Accessibility Standards (illustrated)" [June 1978], as the same may be amended. Each such handicap parking space shall be clearly marked and identified as such. (J) Handicap persons selling or transferring motor vehicles shall remove the decal or device affixed to such vehicle prior to the sale or transfer. No replacement decal or device shall be issued unless the remains or acrapings from the prior decal or device are presented to the Police Department at the time the request for replacement is made. (K) Use of a handicap parking space by a motor vehicle not being then used for the transportation of handicap persons shall subject the operator of such motor vehicle to a fine of not less than fifty dollars ($50.00) nor more than two hundred dollars ($200.00) for each such occurrence. The parking of a motor vehicle not displaying a valid handicap marking as set -2- forth in subparagraphs (B)1, (B)2 or (B)3, above, in a handicap parking space shall be prima facie evidence of a violation of this Section of the Canton Municipal Code." 2. That Title 9, Chapter 10, Section 2(F) of the Canton Municipal Code be, and the same ehreby is, amended to read as follows: "9-10-2(F): PARKING BY HANDICAPPED DRIVERS: (A) The south side of Elm Street, commencing at the intersection of the center line of Third Avenue with the south curb line of Elm Street in the City, thence west sixty feet (60'), thence north twenty feet (20'), thence east to the center line of Third Avenue extended, thence south to the point of beginning be, and the same is hereby designated as parking to be used by handicapped drivers. (B) No parking of any motor vehicle, other than by a handicapped driver, shall be permitted on the south side of East Elm Street, commencing at the intersection of the center line of Third Avenue with the south sure line of Elm Street in the City; thence west sixty feet (60'), thence north twenty feet (20'), thence east to the center line of Third Avenue extended, thence south to the Point of Beginning. (C) The appropriate officials of the City shall post appropriate signs and make appropriate markings designating this area for parking by handicapped drivers and informing people of this Ordinance. (D) Any person who violates this Ordinance shall, upon conviction, be subject to a fine of not less than fifty dollars ($50.00), nor more than two hundred dollars ($200.00) for each offense." 3. That this Ordinance shall be in full force and effect ten (10) days after its passage by the City Council of the City of Canton, Fulton County, Illinois, approval by the Mayor thereof, and publication in pamphlet form as provided by law. PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 18th day of November 1986, upon a roll call vote as follows: AYES: Aldermen KoYachevich, Zi:lly, Steck, Sarf~, Workman, Bohler, May, Chapman, NAYES: None.
