Mayor McDowell asked to move part of his communications to the beginning of the meeting.

Mayor McDowell stated that he would like to appoint Andra Chamberlin to the vacant seat left
by Alderman Ryan Mayhew.

City Clerk Diana Pavley Rock administered the Oath of Office to Andra Chamberlin.
Andra was born and raised in Canton- left for college and received a degree in the medical field
and then returned to Canton. Andra has two children and is married to Dr. Jason Chamberlin.
Andra most recently worked at Rise in Canton, and hopes to return to substitute teaching in the
fall.
CONSENT AGENDA
APPROVAL OF THE COUNCIL MEETING MINUTES HELD JULY 21, 2020,
TREASURER'S REPORT
Alderman Fritz asked Treasurer Wilkinson to go over a few areas on the Treasurer's Report.
One area of concern is the May receipts from 2019 to 2020 are down 50% on income tax and
55% on replacement tax. The June receipts are down this year from 2019 by 6% on the City's
sales tax- these areas represent 36% of the total general fund revenues.
Treasurer Wilkinson explained that replacement tax is only paid out 9 times per year. The City
will closely monitor this and hope that it will flatten out. Part of this has to do with income tax
filing. This year people were filing their income taxes in July- so hopefully we will see some
increases in not only replacement tax, but also with the income tax. Treasurer Wilkinson
stated that the sales tax is down- which represents what the businesses collected in March.
This area will also be closely monitored in the coming months.
Comptroller Beka Schultz further explained that part of the sales tax figures represents a delay
due to businesses being shut down. Fulton County was late in sending out property tax bills-
which will also create a delay. The first installment of property tax payments usually represents
the larger portion received. The City received the first distribution from the property taxes
from the County on of July 31, 2020. This will be reflected on the July Treasurer's Report. The
City also received a payment from the State for the prison's water bill of approximately
$140,000.00 and another large payment of $540,000.00 in June. The City should also see a
payment from the marijuana dispensary in October from the sales tax.

LEGAL AND ORDINANCE
ALDERMAN CRAIG WEST, CHAIRMAN
ALDERMAN JUSTIN NELSON (ACTING CHAIR)
DISCUSS, CONSIDER AND VOTE ON A RESOLUTION APPROVING AN AGREEMENT BETWEEN
THE TRI COUNTY REGIONAL PLANNING COMMISSION (GRANTOR) AND THE CITY OF
CANTON(GRANTEE) FOR THE CENSUS GRANT PROGRAM IN THE AMOUNT OF $5,000.00
RESOLUTION #5274
City Clerk Diana Pavley Rock explained that the Council previously approved an agreement with
Tri County for a $15,000.00 grant. The City is eligible for an additional $5,000.00 grant with Tri-
County for the census outreach. This additional grant could be used between now and the end
of October.

between Tri County Regional Planning Commission and the City of Canton for the Census grant
program in the amount of$5,000.00

City Clerk Diana Pavley Rock explained that the City is current at a 71% response rate. Diana
and a few others on the committee will be going to Wal-Mart and Hy-Vee to do some census
outreach and try to get some of the citizens that has not yet completed their census to do so.
Diana further explained that she just received word today that the Census Bureau is going to
close their census work one month early due to the pandemic. This will make it even more
important for the citizens to get their census completed.
Diana said that it is so important that we capture the remaining 30% of the population that has
not completed their census. The results of this census will impact our community for the next
10 years- and we simply can't afford to have an undercount.

DISCUSS AND CONSIDER THE DEVELOPMENT OF A PARCEL OF PROPERTY FOR RESIDENTIAL
PURPOSE OWNED BY THE CITY NEW CANTON LAKE
Discussion took place regarding the location of the proposed development. Alderman Quin
Mayhew explained that he went out to the lake to view this area. Alderman Mayhew said he is
a little concerned about the location of the spillway and the safety concerns. Utility Director
Joe Carruthers said that he was asked if there is a regulation on the footage on the buoys with
the spillway. This area has a tendency to be dangerous- so it is a good idea to keep people back
from this area. Engineer Plavec will be bringing additional information back on this topic. A
recommendation is that anytime you have a concrete spillway, the City would need to have
proper signage, buoys and barriers to protect the citizens.
Jed Rhoades said that he did some measurements. For what they are proposing on the
southwest corner of the 11.3 acres is about 415 feet to the dam and about 470 feet to the
closest portion of the spillway. On the west side of the lake where the buoys are at—is only
around 312 feet to the dam. Jed said they would still be another 100 feet away from the dam,
where the buoys are on the west side, and about 470 feet to the spillway. The property
extends 300-400 feet past the buoys.
Alderwoman Lingenfelter asked if each of the proposed residential properties would be allowed
to have a boat dock. Jed explained that the six lots that are located on Dal Bar would be
allowed- if within the City guidelines. The other six on Old Beach Road would have a shared
beach access, but boat slips in this area has not been discussed.
Mayor McDowell said he discussed with Jed the possibility of purchasing some boat slips on the
Old Beach Road for the community to be identical to the others recently placed. These slips
could then be rented for those building houses. The City is wanting to get the existing boat
slips at the old beach area paid for before putting in any additional slips.
Mayor McDowell further discussed annexing the properties so the City could get the tax money
instead of the county or the township.
Attorney Jump said the City could do a sale of surplus land- but a certified appraisal would be
required. A few publishing requirements would also be required. A resolution would be
presented to Council with certain terms of the sale with a 2/3 approval of the corporate
authorities. The price would need to be at least 80% of the appraised value.
The other option would be opening this for bid, where the City would dictate the terms they
would want to see in the bids. The City could accept a bid that would be found to be in the best
interest of the City.
Ultimately it is up to the Council on how to proceed. Attorney Jump would either need to draft
an ordinance putting it up for bid, or a resolution regarding a potential sale of surplus real
estate.
Jed said he would be willing to absorb the cost of the appraisal.
Alderman Mayhew said that there is a lot of property at the lake to be developed, but is very
concerned about the proposed area due to how close it is to the spillway.
Alderman Nelson said that the City currently does not have a place for development that would
be desirable to professionals and thinks this would be a good thing for the community.
Engineer Plavec will bring back additional information for review. A committee meeting will be
scheduled to further discuss prior to being brought back to council.
DISCUSS, CONSIDER AND VOTE ON THE PURCHASE OF A UTILITY EQUIPMENT HAULER FOR
CEMETERY OPERATIONS
The City is considering purchasing a John Deere Gator in the amount of $6,700.00 for the
cemetery. This will be used to help haul equipment around the cemetery. The City currently
has a 1982 International tractor and a 4-door truck from the street department. Sexton Kyle
Jansen further explained that both of the older vehicles have some repair issues and he is
needing something more reliable. There is currently money in the budget for this purchase and
the cemetery will also be doing some projects in-house that will free up some extra money to
go toward this purchase.

utility hauler for cemetery operations.

MAYOR COMMUNICATION
John Barclay passed away this past week and a visitation will be held tomorrow at Sedgwick
Funeral Home from 10:00-11:30. A private graveside will be held in Elmwood. The City
previously honored Mr. Barclay on February 4, 2020 on his 103rd birthday.
Fulton County currently has a total of 28 positive COVID cases with 4 cases currently active. 24
cases are recovered. There have been approximately 50 tests per day through the month of
July. There were approximately 100 tests administered within the first three days of August.
Mayor McDowell said the numbers are low in Fulton County compared to surrounding
communities and contributes this to the citizens taking proper precautions by social distancing,
wearing masks and washing hands. The Canton Union School District will be going to an E-
Learning platform. Teachers begin on August 12th and students will begin on August 19, 2020
with E-Learning.
Fulton County does not currently have an open COVID testing site -however this is something
that is being worked on.
The City is working together with the CURE funds and getting items together that could be
reimbursed.
