RESOLUTION NO. 1159
A RESOLUTION APPROVING A "MEMORANDUM OF UNDERSTANDING"
BETWEEN THE CITY OF CANTON AND BEULAH KENDRICK RELATIVE
TO FIRE TRAINING PURPOSES
WHEREAS, the Canton City Council has determined that
it is necessary and in the best interest of the City of
Canton to enter into a "Memorandum of Understanding" with
Beulah Kendrick as set forth in Exhibit "A" hereto attached.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF CANTON, Fulton County, Illinois, as follows:
1. That Exhibit "A" hereto attached and herein
incorporated by reference is hereby approved by the Canton
City Council.
2. That the Mayor and the City Clerk are hereby
authorized and directed to execute originals of Exhibit
"A" and to deliver the same to Beulah Kendrick.
3. That this Resolution shall be in full force and
effect immediately upon its passage by the City Council
of the City of Canton, Fulton County, Illinois, and approval
by the Mayor thereof.
PASSED by the City Council of the City of Canton,
Fulton County, Illinois at a regular- meeting this 3rd
day of line 1986, upon a roll call vote
as follows:
AYES: Aldermen Kovachevich, Zilly, Steck, Sarff, Work-
man, May, Chapman.
NAYS: None.
ABSENT: Alderman Bohler.

MEMORANDUM OF UNDERSTANDING
This memorandum of understanding is between the City
of Canton, an Illinois municipal corporation, and Beulah
Kendrick, of 414 North First Avenue, Canton, .Illinois and
pertains to one improved parcel of real estate in Canton,
Illinois to wit: 243 East Linn Street. Beulah Kendrick
representing herself to be, the fee simple owner of the
improvements set thereon, grants permission to the City
of Canton to use and destroy the improvements for fire
training purposes. Beulah Kendrick agrees to save the
City of Canton harmless from any claims by third persons
arising from said fire training exercises.

MEMORANDUM OF UNDERSTANDING
This memorandum of understanding is between the City
of Canton, an Illinois municipal corporation, 210 E. Chestnut
Street, Canton, Illinois, and Beulah Kendrick, of 414 North
First Avenue, Canton, Illinois and pertains to one improved
parcel of real estate in Canton, Illinois legally described
as follows, to wit: Fifty (50) feet off the West end
of Lot Number 440 in Wright's Addition to Canton, Fulton
County, Illinois, commonly known as 243 East Linn Street,
Canton, Illinois.
Beulah Kendrick respresents herself to be the fee
simple owner of the improvements situated thereon; and,
grants permission to the City of Canton to use and destroy
the improvements thereon for fire training purposes.
Beulah Kendrick hereby agrees to save the City of
Canton whole and harmless from any claims of third persons
arising from said fire training exercises. Further, Beulah
Kendrick hereby waives any claims for damages which she
might assert against the City of Canton by reason of any
claimed damage arising from such destruction and/or fire
training.
Beulah Kendrick hereby agrees to, at her sole expense,
clear any and all remaining debris from the above premises
and to backfill any basements, holes, or depressions with
suitable backfill in conformity with applicable ordinances,
laws, rules, or regulations.
