ORDINANCE NO. 1862 -~
An Ordinance annexing certain property of Amber Smudge Corporation to the City
of Canton, re-zoning the entire parcel to B-2, and granting a Special Use Permit for
construction of a multifamily residential dwelling on the parcel.
WHEREAS, the northern portion of the property described on Exhibit A, which is attached
hereto and made a part hereof ("Amber Smudge Property"), is located within the corporate limits of
the City of Canton, Fulton County, Illinois; and
WHEREAS, the southern portion of the Amber Smudge Property is not located within the
corporate limits of the City of Canton; and
WHEREAS, the northwestern portion of the Amber Smudge Property is currently zoned R-2
and the northeastern portion is zoned B-2 under the Canton City Code; and
WHEREAS, the southern portion of the Amber Smudge Property, which is located within
limits of the County of Fulton, is zoned B under the Fulton County Zoning Code; and
WHEREAS, Amber Smudge Corporation is the owner of the Amber Smudge Property and
has petitioned the City Council of the City of Canton, Illinois, that the portion of the property not
currently within the corporate limits of the City of Canton be annexed into the corporate limits of
the City of Canton, that the entire parcel be re-zoned to a B-2 zoning configuration, and that a
Special Use Permit be granted in order to accommodate the construction of a multifamily residential
dwelling; and
WHEREAS, the surrounding neighborhood consists ofboth business and residential uses and
the re-zoning of the Amber Smudge Property to B-2, with a Special Use Permit for construction of
a multifamily residential dwelling, would be consistent with the current uses in the area and would
be a benefit to the surrounding area; and

WHEREAS, on March 13, 2006, the Planning and Zoning Commission of the City of Canton
met, pursuant to notice as required by law, and held a public hearing concerning the Petitioner's
requests to annex that portion of the Amber Smudge Property not currently within the corporate
limits of the City of Canton, to re-zone the entire parcel to a B-2 zoning configuration and to issue
a Special Use Permit for construction of a multifamily residential dwelling, and, at the meeting, no
objectors were present and no objections to the Petitioner's requests were voiced, and, after said
hearing, the Planning and Zoning Commission unanimously recommended to the City Council of
the City of Canton, Illinois, the annexation of that portion of the Amber Smudge Property not
currently within the corporate limits of the City of Canton, the re-zoning of the entire parcel to a B-2
zoning configuration, and the issuance of a Special Use Permit for construction of a multifamily
residential dwelling;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CANTON, ILLINOIS, A MUNICIPAL CORPORATION:
1. That the portion of the property described on Exhibit A and known as the Amber
Smudge Property that is not currently within the corporate limits of the City of Canton shall be and
the same is hereby annexed to the City of Canton; that the entire parcel shall be and the same hereby
is re-zoned to a B-2 zoning configuration, and that a Special Use Permit shall be and the same hereby
is issued to Amber Smudge Corporation for construction of a multifamily residential dwelling on
the Property.
2. That the corporate authorities of the City of Canton, Illinois, and their respective
officers and agents shall be and they are hereby authorized to amend the applicable maps of the City

of Canton, Illinois, to so reflect the annexation of the Amber Smudge Property, its re-zoning to a B-2
zoning configuration and its Special Use Permit.
3. That a copy of this Ordinance shall be filed with the appropriate authorities of the
County of Fulton and State of Illinois, to reflect the annexation, re-zoning and Special Use Permit,
all as made and provided for by law.
4. That the Mayor of the City of Canton, Illinois, shall be and he is hereby authorized
to affix his signature as the Mayor of said City to this Ordinance and the City Clerk of the City of
Canton, Illinois, shall be and she is hereby authorized to attest such signature thereto.
Passed by a vote of the City Council of the City of Canton, Illinois, this 4th day of April,
2006, by a vote of 8 ayes and 0 nays, with 0 Aldermen absent.
