Lon Henderson was at the meeting to introduce his nephew Joshua Henderson and Haley
Nichols-which are the parents of the child that will be discussed later in the meeting regarding
the burial at Greenwood Cemetery.

DISCUSS, CONSIDER AND VOTE ON A RESOLUTION APPROVING A RELEASE AGREEMENT
BETWEEN THE CITY OF CANTON AND THE HENDERSON FAMILY REGARDING A BURIAL AND
SECOND INTERMENT RIGHTS AT GREENWOOD CEMETERY.
Attorney Jump explained that he discussed the agreement with the Henderson family's
attorney. All documents requested by Attorney Jump were received. The file stamped wills
were also reviewed by Attorney Jump. A formal request was received from the child's
mother/father-Haley Nichols/Joshua Henderson requesting the burial in the spot. Attorney
Jump prepared a resolution and a release agreement. Attorney Jump said the council will need
to determine if they want to approve the agreement and proceed with the burial.
Alderman Ryan Mayhew asked if Attorney Jumps legal opinion changed after reviewing the
documents.
Attorney Jump said his legal opinion did not change after reviewing the documents and his legal
opinion remains the same from the last meeting it was discussed. Thie Henderson family and
their attorney were very cooperative in supplying the documents requested by Attorney Jump.
Attorney Jump explained that the child's remains are subject to the disposition of remains act.
Legally the parents have the right to control this. The real issue is the rights of Gerald and Ann
Henderson—and the rights they had.

DISCUSS. CONSIDER AND VOTE ON AN ORDINANCE AUTHORIZING THE LEASE OF
MUNICIPALLY OWNED REAL PROPERTY LOCATED AT 26046 NORTH LAKE WIND DRIVE,
CANTON ILLINOIS. (Is'Reading) ORDINANCE#4181
Attorney Jump explained that the realtor reached out to the City and they are wanting to close
the loan as soon as possible.
Motion and second were made by Aldermen West/Quin Mayhew to waive the rules for two
readings of the ordinance.
The motion carried by voice vote and was unanimous.
Motion and second were made by Aldermen West/Hale to approve the ordinance and place it
on file with the changes discussed.

Attorney Jump asked to have a motion to move this item to the end of the agenda. This item
will be discussed in closed session and then will come back into open session for a vote.
Motion and second were made by Aldermen West/Quin Mayhew to hold this item until the end
of the meeting.

DISCUSS, CONSIDER AND VOTE ON A RESOLUTION APPROVING A RAASTER SERVICE ORDER
AGREEMENT WITH CALL ONE INC. RESOLUTION#5225
Call one provides the telephone services to the City. The master service;:agreement expired and
additional fees are being assessed to our phone bill. Treasurer Wilkinson has worked with Call
One and they have agreed to refund the fees. They are asking for the master service
agreement in exchange for the waiver of the fees. The agreement is fo;r a one-year period

IMPROVEMENTS
The City received three bids for the Van Buren Street Improvements. -1 i'Xree bids were received
from.
The following submitted bids:
Advanced Asphalt,Auto Baum and RA Cullinan.
The low bid received was from Advanced Asphalt in the amount of$1P?;432.00. The engineer's
estimate was $173,000.00. Engineer Plavec explained that he is seeing bids across the board
coming in higher than the engineers estimate.
The project includes a mill and overlay on Van Buren Street between Elm Street and Maple
Street. The existing sidewalk ramps would be removed to make ther.n ADA compliant. Curb
and guttering would be replaced as needed. The project was origin,,-.'fly budgeted using TIF 1

funds and sidewalk funds. The breakdown of the cost is approximately $65,000.00 for the
sidewalk project and $118,000.00 for pavement and curbing. The proposal is to take
$65,000.00 from the sidewalk account and then have TIF 2 reimburse TIF 1 for $100,000.00.
The City would then take $18,000.00 from the sales tax fund. The first pay request would not
come until after May.
The City currently has approximately $200,000.00 in the sidewalk fund. The project should be
completed by the end of July.
Motion and second were made by Aldermen Fritz/Hale to approve the low bid of$182,432.00
from Advanced Asphalt. $65,000.00 would come from the sidewalk fund, TIF 1 would account
for $100,000.00 and the remaining $18,000.00 would either come from TIF 1 or the sales tax
fund.

PUBLIC SAFETY AND TRAFFIC
ALDERWOMAN ANGELA HALE, CHAIRMAN
LAKE, BUILDINGS AND GROUNDS

DICUSS, CONSIDER AND VOTE ON AN ORDINANCE AMENDING SECTION 8-11-2 (BOATING
LICENSE REQUIRED). (1St READING)
The current ordinance has a 90 horse-limit on boats at Canton Lake. The City is considering
taking the limit off of the boat motors. The speed limit of 30 miles per hour would remain. The
lake patrol would continue to enforce the speed limit. The City was receiving complaints about
boats with larger motors and being denied access to the lake due to the larger motor. There
would continue to be restrictions on different types of boats.
A fee schedule was presented with gradual increases in prices. The fere schedule includes both
in-town and out of town rates. Mayor McDowell said that if the proper fee is not paid a fine
will be assessed and the boat sticker will be revoked.
If anyone has any requested changes in the ordinance, they should notify Attorney Jump prior
to the 2nd reading of the ordinance.

MAYOR COMMUNICATION
RECOGNITION OF JOE GINGER
Mayor McDowell presented a plaque to Joe Ginger for his 25 years of!service with the City. Joe
started video taping the City Council meetings in March 1995. Joe has .missed only 2 meetings
in the 25 years of service to the City and has demonstrated outstanding dedication to the City
with the services he provides.
SCAMS
Mayor McDowell explained that the City was notified that some robo calls are going out to
residents about the fire department asking for funds. The City is not requesting any funds and
has not authorized any calls requesting for funds for the fire department. This is a scam and
residents should not respond to this call.
GREENWOOD CEMETER CLEANUP
Greenwood Cemetery started their cleanup that will go until the 15th of the month. If anyone
has any shepherd hooks people are encouraged to claim them.
WWTP SUPERINTENDENT MICHAEL COURTNEY CLASS 1 LICENSE
Mayor McDowell congratulated WWTP Superintendent Michael Courtney for successfully
passing his exam and receiving the Class 1 license.

session for review of closed session minutes. Action will be taken in open session after the
closed session meeting.
