.RESOLUTION
WHEREAS, the City of Canton located in the
County of Fulton ~ State of Illinois, wishes to locate,

which, by law, comes under the jurisdiction and control__of the

- WHEREAS, a permit from=said Department is required before.

THEREFORE, be it resolved by the ( City of Canton ), County of
Fulton State of Illinois,
First: That we do hereby request from the Department of
Transportation, State of Illinois, a permit authorizing the
( City of Canton ) to proceed with the work herein described.
Second: That we hereby pledge the good faith of the
( City of Canton ) and guarantee that all work shall be performed in
accordance with the conditions of the permit to be granted by the
Department of Transportation, State of Illinois, and to hold the State of
Illinois, Department of Transportation harmless, on account of any damage
that may occur to persons or property, during the prosecution of such
work, and assume all liability for damage to persons or property, due- to
accidents or otherwise, by reason of the work which is to be performed
under the provisions of said permit.

work scheduled along the above-captioned route and
section. Please have an authorized ofificial ofi the City of
Canton sign these copies on the line marked Applicant and
have the signature witnessed at the location indicated on
the permit. Please date the permit copies and be sure that
they are signed in ink. Return all copies to this office
for further processing.
Also attached are two copies of a RESOLUTION which is
required as a part of this permit. Please have an
authorized official of the City of Canton sign the attached
RESOLUTION forms and return all copies to this office along
with the permit forms. After the permit has been approved
by officials of this Department, a fully executed copy will
be returned to you for your files.

request permission and authority to do certain work herein described on the right-of-way of the State highway
(SBI 78)
known as IL Route 78 ,Section 134,135RS ,from Station 260+82 to Station 262+32
Fulton - County. The work is described in detail.on the attached sketch and/or as follows:
-k?er-missian and_authority are~iereby granted to the Applicant to locate,
construct, and maintain an eight (i3") inch diameter sanitary sewer rnain
along the above described route in accordance with the- attached drawing
which is made a part of this permit. All costs in the construction work
authorized by this permit shall be at the expense of the Applicant.
The proposed sewer line is being constructed along the same route as an
existing sewer line, which this new line is replacing. Manholes #1 and
#2 shall be removed and reconstructed to accommodate the lower elevation
of the proposed sewer line.
The limits of the pavement removal on the Edmar Drive approach to North
Main Street shall be defined by a sawed joint having sufficient depth to
sever the reinforcement steel in the existing concrete pavement.

It is understood that the work authorized by this permit shall be completed within 6 months after the date this
permit is approved, otherwise the permit becomes null and void.
This permit is subject to the conditions and restrictions printed on the reverse side of this sheet.

The backfill of the open hole shall consist of trench backfill
material (sand) and shall be compacted in eight (8") inch lifts by
ramming or tamping by mechanical means. The trench backfill
material shall be brought up to an elevation level with the bottom
of the existing concrete pavement.
The pavement replacement shall consist of eight (B") inches of -
Portland cement concrete and three (3") inches of bituminous
concrete surface course material. The pavemen-t replacement shall be
_ placed on the compacted trench backfill plus one (1') foot of -
undist~rbed earth on each side of the open cut. _ - -_-
The backfill of the remainder of the trench along North Main Street
shall be thoroughly compacted at time of backfill by tamping by
mechanical means, and any depressions which may develop within the
area involved in the construction operations, due to settlement of
the backfilling material, shall be kept filled and the right-of-way
restored to its original condition, during a period of six (6)
months from the date of the completion of the work authorized in
this permit.
All trenches within two (2') feet of the existing pavement,
stabilized shoulder, curb, or sidewalk shall be backfilled to within
twelve (12") inches of the surface according to Articles 210.01 and
703.05 of the "Standard Specifications for Road and Bridge
Construction." The remaining twelve (12") inches shall be
backfilled with material to restore the disturbed area to its
original condition.
Open trench and windrowed excavated material shall be protected as
required by Chapter 6 of the Illinois "Manual of Uniform Traffic
Control Devices." Where practicable, the excavated material shall
be deposited between the roadway and the trench as added protection.
Excavated material shall not be allowed to remain on the paved
portion of the roadway. Where right-of-way width does not allow for
windrowing excavated material off the paved portion of the roadway,
excavated material shall be hauled to an off-road location.
All pipe, conduit, wire, poles, cross arms, or other materials
distributed along the highway prior to installation shall be placed
as remote as practicable from the edge of the pavement in a manner
to minimize its being a hazard to errant vehicles or an obstacle to
highway maintenance. If material is to be stored on highway
right-of-way for more than two (2) weeks prior to installation,
approval must be obtained from the Department.
This permit is issued only with the express understanding that the
Applicant has satisfied the land and water pollution requirements of
the Illinois Environmental Protection Agency, Division of Water
Pollution Control. Sewer lines shall be installed to meet or exceed
the recommendations of the current "Standard Specifications for'
Water and Sewer Main Construction in Illinois."

Sewer and drainage piping shall have a minimum cover of thirty (30")
inches and preferably sufficient cover for freeze protection.
No person, firm, corporation or institution, public or private,
shall discharge or empty any type of sewage, including the effluent
from septic tanks or other sewage treatment devices, or any other
domestic, commercial or industrial waste, or any putrescible
liquids, or cause the same to be discharged or emptied, in any
manner, into open ditches along any public street or highway, or
into any drain or drainage structure installed solely for-street or
highway drainage purposes.
Traffic on the highway shall be protected by use of signs,
barricades, flagmen, lights, and watchmen_as may be required during
progress of work. Applicable traffic control standards are included-
as a part of this permit.
All costs in the location and/or adjustment of utilities shall be at
the expense of the Applicant.
An authorized official of the City of Canton shall approve all
copies of the attached Resolutions to do the previously described
work.
It must be understood that everyone working on this project shall
indemnify and save harmless the State of Illinois,_its officers,. and
employees, from all suits, actions, or damages received or sustained
by any person or property on account of or in consequence of any act
of omission, neglect, or misconduct, by your organization or anyone
working with your organization.
The Applicant shall require his contractor (or contractors) to
perform his (or their) work in accordance with the "Standard
Specifications for Road and Bridge Construction," adopted July 1,
1988, and the "Supplemental Specifications" in effect on the date of
construction.
No work is to be started on the project until the permit has been
approved by this Department. This permit should be available at the
jobsite at all times for inspection by a duly authorized
representative of the Department of Transportation or the State
Police.
Upon completion of all construction or maintenance work on state
highway rights-of-way, the contractor and/or the Applicant shall
remove all excess material and restore all turf and terrain to the
satisfaction of the Department. Such cleanup and repair may consist
of backfilling, regrading, reseeding, resodding, or any other
requirement to restore the right-of-way to a condition equivalent to
that which existed prior to the commencement of the project.

First: The Applicant represents all parties in interest and shall furnish material, do all work, pay
all costs, and shall in a reasonable length of time restore the damaged portions of the highway to a
condition similar or equal to that existing before the commencement of the described work, including
any seeding or sodding necessary.
Second: The proposed work shall be located and constructed to the satisfaction of the District
Engineer or his duly authorized representative. No revisions or additions shall be made to the pro-
posed work on the right-of-way without the written permission of the District Engineer.
Third: The Applicant shall at all times conduct the work in such a manner as to minimize hazards
- to vehicular and pedestrian traffic. Traffic controls and work site protection shall be in accordance
- with theapplicable requirements of Chapter 6 (Traffic Controls for Highway Construction and Mainte-
-- Hance Operations) otthe Illinois Manual on Uniform Traffic Control Devices for Streets and Highways-
-- and with the traffic control plan ii one is required elsewhere in the-permit. All signs, barricades, flag-
- gers, etc., required for traffic control shall be furnished by the Applicant. The work may be done on
any day except Sunday, New Year's Day, Memorial Day, Independence Day, LaborDay, Thanksgiving
Day, and Christmas Day. Work shall be done only during daylight hours. -
Fourth: The work performed by the Applicant is for the bona fide purpose expressed and not for
the purpose of, nor will it result in, the parking or servicing of vehicles on the highway right-of-way.
Signs located on or overhanging the right-of-way shall be prohibited.
Fifth: The Applicant, his successors or assigns, agrees to hold harmless the State of Illinois and
its duly appointed agents and employees against any action for personal injury or property damage
sustained by reason of the exercise of this permit.
Sixth: The Applicant shall not trim, cut, or in any way disturb any trees or shrubbery along the
highway without the approval of the District Engineer or his duly authorized representative.
Seventh: The State reserves the right to make such changes, additions, repairs, and relocations
within its statutory limits to the facilities constructed under this permit or their appurtenances on the
right-of-way as may at any time be considered necessary to permit the relocation, reconstruction,
widening, or maintaining of the highway and/or to provide proper protection to life and property on or
adjacent to the State right-of-way. However, in the event this permit is granted to construct, locate,
operate, and maintain utility facilities on the State right-or-way, the Applicant, upon written request
by the District Engineer, shall perform such alterations or change of location of the facilities, without
expense to the State, and should the Applicant fail to make satisfactory arrangements to comply with
this request within a reasonable time, the State reserves the right to make such alterations or change
of location or remove the work, and the Applicant agrees to pay for the cost incurred.
Eight: This permit is effective only insofar as the Department has jurisdiction and does not pre-
sume to release the Applicant from compliance with the provisions of any existing statutes or local
regulations relating to the construction of such work.
Ninth: The construction of access driveways is subject to the regulations listed in the "Policy on
Permits for Access Driveways to State Highways." If, in the future, the land use of property served by
an access driveway described and constructed in accordance with this permit changes so as to re-
quire ahigher driveway type as defined in that policy, the owner shall apply for a new permit and bear
the costs for such revisions as may be required to conform to the regulations listed in the policy. Utili-
ty installations shall be subject to the "Policy on the Accommodation of Utilities on Rights-of-Way of
the Illinois State Highway System."
Tenth: The Applicant affirms that the property lines shown on the attached sheet(s) are true and
correct and binds and obligates himself to perform the operation in accordance with the description
and attached sketch and to abide by the policy regulations.
