the CITY OF CANTON, FULTON COUNTY, ILLINOIS.
I further certify that on AUGUST 20, 2019 , the City Council of such
municipality passed and approved Ordinance No 4161 entitled:
AN ORDINANCE REZONING PROPERTY ON 100 WEST ELM STREET FROM A B-1
ZONING CLASSIFICATION TO A B-2 ZONING CLASSIFICATION
which proved by its terms that it should be published in pamphlet form.
The pamphlet for Ordinance No. 4161 including the Ordinance and a cover
sheet thereof, was prepared, and a copy of such Ordinance was posted at City Hall,
2 North Main Street Canton IL, commencing on AUGUST 20, 2019 , and continuing
for at least ten days thereafter. Copies of such Ordinance were also available for public
inspection upon request in the Office of the City Clerk.

ORDINANCE NO. 4161
AN ORDINANCE REZONING PROPERTY ON 100 WEST ELM STREET FROM A B-1
ZONING CLASSIFICATION TO A B-2 ZONING CLASSIFICATION
WHEREAS, Petitioner, MidAmerica National Bank, filed a petition with the Joint Planning &
Zoning Commission for the re-zoning of the real property described below, said property being
within the corporate limits of the City of Canton, Illinois; and
WHEREAS, the current zoning classification of the property is B-1 and it is the petitioner's
intent for the property to change to a B-2 zoning classification; and
WHEREAS, after proper notice, a public hearing on said Petition was conducted by the
Planning and Zoning Commission of the City of Canton on August 12, 2019; and
WHEREAS, on August 12, 2019, the Planning and Zoning Commission recommended to the
City Council that the real property described below be rezoned pursuant to 65 ILCS 5/11-13-1
et.seq.; and
WHEREAS, it is in the best interest of the City of Canton, Illinois that said property be rezoned
within the City of Canton, to meet future business growth and fit within the, City's
comprehensive plan.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Canton, Illinois
as follows:
1. That the Canton City Council hereby finds as facts the assertions set forth above.
2. That the described real property be and is hereby rezoned from B-1 to B-2 as follows:
Lot Number Eleven (11) in Nathan Jones' Third Addition, to the City of Canton,
situated in the County of Fulton, and State of Illinois.
Lot Number Twelve (12) in Nathan Jones' Third Addition, to the City of Canton,
situated in the County of Fulton,in the State of Illinois.
Lot Thirteen (13) in Nathan Jones' Third Addition to the Town, (now City) of
Canton, Illinois, situated in the County of Fulton, in the State of Illinois.
A part of Lot 22 in Jones Third Addition to the City of Canton, Fulton County,
Illinois, described as follows:
Commencing at a point 76 feet West of the Southeast corner of said Lot 22 in
Jones Third Addition, thence North 57 feet, thence West 60 feet, more or less, to
the West side of said Lot 22, thence South 57 feet, thence East 60 feet, more or
less, to the place of beginning, situated in the County of Fulton, in the State of
Illinois.
Lot 22 in Jones Third Addition to the City of Canton, Fulton County, Illinois,
except 57 feet of even width off the South side thereof, situated in the County of
Fulton, in the State of Illinois.
Part of Lot 22 in Jones Third Addition to the City of Canton, Fulton County,
Illinois, more particularly described as follows: Commencing at the Southeast
corner of said Lot 22, thence West 76 feet, thence North 57 feet, thence East 76
feet, and thence South 57 feet to the place of beginning, situated in the County of
Fulton, in the State of Illinois.
PART OF LOT 14
The South 100 feet of the West 50 feet of the East 100 feet of Lot 14, Jones Third
Addition to Canton.
Part of Lot 14 in Jones Third Addition to the City of Canton, commencing at the
Southeast Corner of said Lot, running thence West 50 Feet, thence North 7 Rods
and 22 Links, thence East 50 Feet, thence South 7 Rods and 22 Links to the place
of beginning, excepting 50 Feet of even width off the North end thereof, situated
in Fulton County, Illinois.
A part of Lot 14 in Jones Third Addition to the City of Canton, Fulton County,
Illinois, described as follows, to wit: Beginning at the Northeast corner of said Lot
14, thence South 148.5 feet, thence West 90.75 feet, thence North 148.5 feet, and
thence East 90.75 feet to the place of beginning.
Part of Lot 14 in Jones Third Addition to Canton, described as follows:
Commencing 7 rods and 22 links North of the Southeast corner of said lot,
running thence West 50 feet, thence South 50 feet, thence East 50 feet, thence
North 50 feet to the place of beginning; EXCEPT that part of Lot14 in Jones
Third Addition beginning at a point 130.8 feet, more or less, North of the
Southeast corner of said Lot 14, being the same point of beginning described in
Volume 732, page 38, of the Fulton County Land Records, thence South 6.24 feet
to a steel rod, thence West 49.60 feet to a-steel rod, thence North 5.50 feet to a
steel rod in the North line of the property described in Volume 732, Page 38,
thence East 49.60 feet to the point of beginning, situated in the County of Fulton,
in the State of Illinois.
The South 54 feet of the North 202.5 feet of the East 90.75 feet of Lot 14 in Jones
Third Addition to Canton, Illinois, except a parcel 12 feet North and South by 6
feet East and West in the Northwest corner thereof.
Together with an adjoining parcel described as:
Beginning at a point 202.5 feet South of the Northeast corner of said Lot 14,
thence South 6.24 feet to a steel rod, thence West 49.6 feet to a steel rod, thence
North 5.5 feet, thence East about 49.6 feet to the place of beginning, all situated in
the City of Canton, County of Fulton and State of Illinois.
3. That MidAmerica National Bank will pay to the City of Canton the fees required to file a
certified copy of this Ordinance with the Fulton County Clerk and Recorder of Deeds, no later
than ninety (90) days from the date of this Ordinance.
4. Upon proof of filing of a certified copy of this Ordinance, the Zoning Administrator is
directed to make the appropriate map amendments to the City of Canton to reflect said re-zoning.
5. That this Ordinance shall be in full force and effect upon its passage by the City Council of
the City of Canton and approval by its Mayor.
PASSED by the City Council of the City of Canton, Illinois and approved by the Mayor thereof
this 20TH day of August, 2019 upon a roll call vote as follows:
