X055 A RESOLIITION INDICATING THE WILLINGNESS OF THE CITY OF CANTON TO PARTICIPATE IN J.II.L.I.E., INC., WITHOIIT SIGNING A MEMBERSHIP AGREEMENT WHEREAS, Chapter 111 2/3, Paragraph 1605, I11. Rev. Stat., requires the City of Canton and other Illinois municipalities to join the State-Wide One-Call Notice System on or before July 1, 1991 ; and, WHEREAS, J.U.L.I.E., Inc. is an Illinois not-for-profit corporation established pursuant to statute to receive and transmit information to and from persons, firms, corporations and other entities intending to undertake activities in connection with excavation in the area of underground utilities; and, WHEREAS, J.U.L.I.E., Inc. has provided the City of Canton with a membership agreement which the City of Canton finds to be unacceptable. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. That the Canton City Council hereby find the foregoing recitals to be fact and further finds that the statutory requirement that the City join J.U.L.I.E., Inc. is an unfunded state mandate which relieves the City of Canton from its obligations under the aforesaid statute. 2. Nevertheless, the Canton City Council has determined its willingness and desire to participate in J.U.L.I.E., Inc. without signing a membership agreement. 3. The City of Canton will respond to calls from J.U.L.I.E., Inc. and from the J.U.L.I.E. system regarding proposed utility excavations if contacted. 1,.. The City of Canton shall participate in J.U.L.I.E., Inc without signing the membership agreement and the Mayor is hereby authorized and instructed to take such other and further actions in the premises as may to him seem appropriate to effectuate the intent of this Resolution. 5. This Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois.
