AN ORDINANCE PROVIDING FOR THE COMPROMISE AND PAYMENT OF FINES
RESULTING FROM THE VIOLATION OF LOCAL ORDINANCES AND AMENDING
TITLE 6 OF THE CANTON MUNICIPAL CODE
WHEREAS, the Legal and Ordinance Committee has determined that
it is necessary and in the best interest of the City of Canton to
provide for the compro- mise and payment of fines for violation of
local ordinances and other offenses without the necessity of court
proceedings; and,
WHEREAS, the Canton City Council has made a similar determina-
tion.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, Fulton County, Illinois as follows:
1. That the Canton City Council hereby finds the foregoing
recitals to be fact.
2. That Title 6 of the Canton Municipal Code is hereby
amended by adding the following Chapter 11 to read as follows:
"CHAPTER 1;~..
COMPROMISE AND PAYMENT OF FINES
6-11-1: COMPROMISE AND PAYMENT. That charges for violation of
City ordinances and State traffic offenses may be
compromised and settled by the person or party charged with such
violation by pleading guilty to the charge and paying the following
standard fines and costs, inclusive, in full, at the time the plea
is submitted:
A. For plea and payment within 5 days of the date the
offense was charged, exclusive of the date on which the charge was
made:
1. Violations of Chapter 10, Title 9 of
the Canton Municipal Code, entitled
"Traffic Schedules" for which a greater
minimum fine is not otherwise pro-
vided by ordinance: $ 5.00
2. Violations of State traffic offenses
(Ch. 95~); violations of Titles 6, 7

and 9 of the Canton Municipal Code,
excluding Chapter 10, Title 9,
for which a greater minimum fine is
not otherwise provided by State
statute, law, or local ordinance: $20.00
B. For plea and payment without 5 days of the date the
offense was charged, exclusive of the date on which the charge was
made, but within 10 days thereof:
1. Violations of Chapter 10, Title 9 of
the Canton Municipal Code, entitled
"Traffic Schedules" for which a greater
minimum fine is not otherwise pro-
vided by ordinance: $10.00
2. Violations of State traffic offenses
(Ch. 95~); violations of Titles 6, 7
and 9 of the Canton Municipal Code,
excluding Chapter 10, Title 9,
for which a greater minimum fine is
not otherwise provided by State
statute, law, or local ordinance: $25.00
6-11-2: CITY STAFF. That City staff personnel are hereby
authorized and directed to compromise and settle all such
charges as above set forth, giving good receipt therefor on behalf
of the City of Canton.
6-11-3: DISPOSITION OF FINES. That all monies received thereby
are to be delivered to the City Treasurer on the same date
on which the funds are received, or, deposited to a regular,
standing City bank account on the same day the funds are received
with a copy of the deposit ticket to be delivered to the City
Treasurer on the date such deposit is made.
6-11-4: REPEALER. That to the extent that minimum fines are
increased by this Ordinance, all inconsistent prior
Ordinances, or, portions thereof, are hereby repealed.
6-11-5: MINIMUM FINES. That nothing in this Ordinance shall ever
be construed as repealing or amending any Ordinance, or, portion
thereof, which imposes a greater minimum fine than as herein set
forth, or, which requires restitution as part of the resolution of
the charge. Except as specific ordinances may otherwise provide,

the minimum and maximum fines which may be imposed, exclusive of
Court costs, for each violation of Title 6, 7 and 9 of the Canton
Municipal Code, exclusive of Title 9, Chapter 10, shall be $25.00
and $200.00, respectively."
3. That this Ordinance shall be in full force and effect ten
(10) days after its passage by the City Council of the City of
Canton, Fulton County, Illinois, approval by the Mayor thereof, and
publication in pamphlet form as provided by law.
PASSED by the City Council of the City of Canton, Fulton
County, Illinois at a regular meeting this 20th day of October,
1987, upon a roll call vote as follows:
AYES: AldermenChapman, May, Bohler, ~~eade, Sarff, Steck,
Zilly, Kovachevich.
NAYS: None.
