ORDINANCE NO. 1255
AN ORDINANCE AN~FIDING TITLE 8, CE3APTLR 11 OF TAE CANTON MUNICIPAL
CODE RELATING TO TAE REGULATION OF USES AT LAKE CAN'i"ON
WHEREAS, the Canton City Council has determined that it is
necessary and in the best interest of the City of Canton to amend
Title 8, Chapter 11 of the Canton Municipal Code as hereinafter
set forth; and,
WIHERFAS, the Canton City Council has determined that an
emergency situation exists at Lake Canton because of law water
levels which requires the immediate implementation and enforcement
of the following provisions pursuant to authority of Chapter 24,
Section 1-2-4, Ill. Rev. Stat.
IT IS, ACC7DRDINGLY, IlEREBY ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CANTON, Fulton County, Illinois, as follows:
1. That the foregoing recitals are hereby found to be fact.
2. That Title 8, Chapter 11 of the Canton Municipal Code is
hereby amended by adding sections to read as follows:
"8-11-19: SPRAYING OF WEEDS: No person shall spray any
weeds, grass or other vegitation which lies upon
property owned by the City of Canton at Canton Lake which
is not subject to an existing and valid lease agreement.
I~rther, any person desiring to lawfully spray any chemical
upon any such weeds, grass or vegitation upon leased ground
awned by the City of Canton shall first obtain the written
consent of the Superintendant of the Water Plant or his
designee, for each spraying.
8-11-20: OFF-ROAD VEHICLES: No vehicle, whether powered
by an internal combustion engine or othe~ise,
shall be operated upon or driven or placaed on any real
property awned by the City of Canton at Canton Lake with
the sole exceptions of property subject to a valid and
existing lease agreement and excepting roadways designed
and maintained for the public use.
8-11-21 thru 8-11-30: RESERVED.
8-11-31: PENALTY: Any person who shall violate any
provision of Chapter 11, Title 8 of this Code

shall be subject to a fine of not less than $50.00 nor more
than X500.00 for each offense."
3. Pursuant to authority of Section 1-2-4, Chapter 24, I11.
Rev. Stat., this Ordinance and each and every provision hereof,
shall, due to the urgency of implementing further measures to
control erosi~ at Lake Canton and to preserve the integrity of
the City's water supply, shall take effect immediately upon its
passage by a vote of 2/3 of the Corporate Authorities of the City
of Canton, Fulton County, Illinois and approval by the Mayor
thereof .

County, Illinois at a regular meeting this iR+h day of
July , 1989, upon a roll call vote as follows:
AYES: Aldermen Kovachevich, Zilly, Sarff, Meade, May,
Chapman.
NAYS: None.
ABSENT: Aldermen Steck, BOhler.
