CONSENT AGENDA APPROVAL OF THE COUNCIL MEETING MINUTES HELD JUNE 18, 2019 BILL LIST TREASURER'S REPORT COMPROLLER'S REPORT Motion and second were made by Aldermen Nelson/Lingenfelter to approve the consent agenda The motion carried COMMITTEE REPORTS: FINANCE ALDERMAN RYAN MAYHEW, CHAIRMAN DISCUSS CONSIDER AND VOTE ON THE SALE OF A 1999 DODGE RAM 3500 DUMP TRUCK The City previously approved the sale of the 1999 Dump Truck. Since the approval of the sale - Alderman Quin Mayhew has expressed an interest in purchasing the truck. Attorney Lane explained that since an Alderman is interested in the purchase, this item is being brought back to Council for their consideration. Motion and second were made by Aldermen Ryan Mayhew/West to approve the sale to Alderman Quin Mayhew for the 1999 Dodge Ram 3500 dump truck. LEGAL AND ORDINANCE ALDERMAN CRAIG WEST, CHAIRMAN DISCUSS AND CONSIDER CHANGES TO THE BURNING REGULATIONS Alderman West explained that he received a request to change the current burning regulations (by adding additional days). Since the request was made, Alderman West would like to have the Council review the burning ordinance to see if any modification needs to be made. The current ordinance allows for burning on Monday, Wednesday, Friday and Saturday between 9:OOam and sunset. This section was last revised in 2002. This will be brought back to the next Council meeting for further discussion and consideration. DISCUSS, CONSIDER AND VOTE ON A POSSIBLE ADDENDUM TO THE REAL ESTATE SALE AGREEMENT WITH THE CITY OF CANTON AND ROYAL HOSPITALITY LLC RELATIVE TO OLD SIESTA HOTEL SITE AND DEVELOPMENT Attorney Lane explained that Royal Hospitality LLC requested a revision to the real estate sale agreement. The revision includes a change that would allow them to only purchase the physical real estate—not the property itself. They also want a credit for what they already purchased the property for. The original purchase price was $25,000.00. The agreement includes a 15 month provision to have the project completed. If it is not completed in the 15 months,they would buy back the physical ground. Attorney Lane said the City does not have an obligation to do anything further. The City already declared default. The City could either accept the revisions or move on to find a new developer. Attorney Lane said he is not aware of anyone else interested in the property and Royal Hospitality plans to build a hotel with a swimming pool—which would be a nice addition for Canton. Further discussion took place regarding concerns about the possibility of the developer not completing the project once it is started—due to the delays that has already taken place. Alderman Fritz suggested following up on other projects by the company to see if there are any problems with prior projects. Engineer Plavec suggested requiring a performance bond. Alderman Nelson said that the City lacks enough hotel rooms to be able to accommodate large events being held in town. People end up going to Peoria or other areas because of not enough hotel rooms. If the City could have another hotel with a swimming pool this could be good for the community. The City does not have any other offers for development on the property, so it could be beneficial to make the requested revisions. Alderman Lovell said he thinks this is a big enough project and it would be a mistake to disregard the project. Alderman Lovell said he would like to further look into their other projects and the reputation of the company. Attorney Lane said he could prepare a revised document and send it to them. The City will further look into the possibility of a performance bond and also look at other projects the company has built. Motion and second were made by Nelson/West to place on the next agenda. DISCUSS, CONSIDER AND VOTE ON PROCEEDING WITH JUDICIAL REVIEW OF ARBITRATION AWARD INVOLVING FIREFIGHTERS HOLIDAY PAY GRIEVANCE. Attorney Lane explained that the firefighters previously filed a grievance regarding holiday pay. The contract states that you get paid holiday pay if you work the day before and the day after the holiday, unless excused by the chief. The City had an arbitration hearing on the grievance and the City received the ruling on June 10, 2019. The arbitrator claimed that the language in the contract for providing excuse by the chief was not clear. The ruling came back on June 10, 2019. The arbitrator said that it was not clear on providing the excuse. The arbitrator looked at what was historically done. Attorney Lane said that you don't look at what was historically done when you have clear language. The contract clearly states that you have to work the day before and the day after the holiday—you get the holiday pay---- unless excused by the Chief. Attorney Lane would like to appeal with the Circuit Court. This would be under the uniform arbitration act. He would have 90 days to appeal from when the decision was issued. Attorney Lane further explained that he does not feel that the arbitrator was correct. Attorney Lane said the court could award attorney fees however; Attorney Lane feels they would not. The City would not hire an outside attorney. This would be handled under Attorney Lanes current scope of work. Alderman Ryan Mayhew said he is in favor of moving forward with the appeal. Motion and second were made by Alderman West/Ryan Mayhew to allow Attorney Lane to file judicial review of the arbitration award. Alderman Fritz said he would like to take a different perspective—since he was a Chief of Police for the Canton Police Department and also an officer at another municipality. As an officer--- if he submits a benefit sheet to take time off for a vacation, and if the Chief signs it and approves it—your vacation is approved and you are excused from anything that takes place during that timeframe. As a Chief of Police—when an officer submits a time off sheet- he was under that same perspective. He would be approving the time off and what is going on during that timeframe. An unexcused absence would be calling in sick and not getting the chiefs approval Alderman Fritz said he would have to go along with what the arbitrator was saying--- because this has been the past practice for over 25 years. Alderman Fritz said he sees where the arbitrator is coming from. Alderman Fritz further explained that in leadership training that he has done--- it is up to the leader (that implements policies and procedures) to properly advise people in their department of any changes. Alderman Fritz said this was not done. Attorney Lane further explained that there would not be any charges to file the appeal. DISCUSS, CONSIDER AND VOTE ON AN ORDINANCE APPROVING TWO LAKESHORE LEASES WITH DENNIS AND ALLEN RABE FOR LOTS 3 AND 4 NORTHSHORE ADDITION TO CANTON LAKE (2ND READING)#4151 Due to some health issues in the family, the father (Dennis) wanted to have the son's (Allen) name put on the lease. Motion and second were made by West/Lovell to approve the ordinance and place it on file. DISCUSS AND CONSIDER DEBRIS AND WASTE AND THE STREETS A copy of the current debris and waste on streets ordinance was reviewed by the Council. Alderman West explained that people are putting grass clippings on streets. This creates a safety issue, but also issues with the grass clippings getting into the City sewers. Attorney Lane explained that if a citation is going to be issued for grass clippings on the streets, he would like to have photos to go along with the citation. If a citation is issued, the citation would go to the person that is mowing and blowing the clippings into the street--- not necessarily the home owner. If anyone witnesses clippings in the road, individuals need to contact the police department for enforcement. NEGOTIATIONS, GRIEVANCE & PERSONNEL ALDERMAN JUSTIN NELSON, CHAIRMAN COMMUNITY& INDUSTRIAL DEVELOPMENT ALDERMAN JOHN LOVELL, CHAIRMAN DISCUSS, CONSIDER AND VOTE ON A SPECIAL EVENT AND ROAD CLOSURE SUBMITTED BY THE YMCA FOR THE CANTON HALF MARATHON TO BE HELD SEPTEMBER 2, 2019 FROM 8:OOAM TO NOON A special event request and road closure was submitted by the YMCA for the Canton Half Marathon to be held September 2, 2019. The route was submitted along with a copy of the certificate of insurance. UPDATE FROM SRPED, MISSY TOWERY GENERAL ECONOMIC DEVELOPMENT POINTS • Attended Illinois Economic Development Association conference in Bloomington June 19th & 20th • We are working on Canton Area Guide to Development (CAGD) updates and IEDC Site Selection Data Standards Table updates. The CAGD we use to send out in mailed and emailed recruitment packets and the guide is posted on-line. The Site Selection tables are posted on the website under the Developers and Site Selectors tab under the economic development portion of cantonillinois.org. • Attended public hearing for the Canton/Fulton County Enterprise Zone and paid for the court reporter's time. • Phone conference with Alex Armour from the Illinois State Treasurer's office to discuss our scores for the Charitable Trust—workforce development grant application. We did not receive the grant. We were close in our scores and we know the committees comments to help us improve our application for the next round if we would so choose to reapply. • Coordinated WHOI interview for an"Around Town" segment featuring the Historic Depot and with Mayor McDowell being interviewed at the depot. It aired on Thursday, June 13th • Prepared for and attended Recruitment of Business (ROB) Committee meeting where we reviewed and finalized FY 20 Action Plans. The finalized version was then emailed to all of the participants. • Transportation and ROB Committees are working together to attempt to schedule a Legislative Luncheon with Senator Koehler and Representative Unes. • Prepared for and attended Impact of the Arts in Communities event with Dustin Lewis. Event was at the Majestic Theatre so I checked in with Jeff Eisentraut to see how things were going. He shared very well in Canton and actually Canton is becoming their model for all of their other theatres. • We are wrapping up our last Call for information connections for the fultoncountyoutdoor.org website. Hope is to have the website live by early July. BUSINESS DEVELOPMENT,ATTRACTION AND SUPPORT • Communication with Ashok Patel (Royal Hospitality) on addendum changes shared the information with Attorney Lane. • Continuing to work with downtown business owner exploring the potential purchase of a downtown building for a new location. Coordinated and attended a meeting with Steve Kline, Mayor McDowell and the business owners regarding all of their potential TIF options. They were instructed to get their numbers and then submit the TIF application so Steve Kline could run them some initial projections. • Answered downtown businesses questions on their potential expansion project concerning the Enterprise Zone Sales Tax Exemption incentive through the state. • Worked with Snowman's to communicate the updates for the blades on the downtown directional signage. They were able to get the work done before the Cruise-In. • Amanda Atchley and I met with the owner of Billy's Furniture (moving into the 1611 East Chestnut property owned by Jerry Jamigan). I discussed SRPED services and our economic incentives and Amanda discussed CACC membership with him. • Canton Main Street is providing a Micro grant for the new owner of Mel's Sporting Goods. • Working with Baum Realty representative who has a client that is a restaurant(they won't disclose who) who is looking for space 3/4 of an acre to 3 acres. I provided several different options to her. We are in competition with another city in IA. • Communicated with person looking to open a CBD oil store on White Court. This was referral from Carol Kohler who had received a contact us request from the website. I also provided his information to Amanda for potential CACC membership. • Women in need of shopping(W.I.N.O.) Tours Communication with several downtown businesses so they are aware that this tour bus will be here on Saturday, August 3`a and Saturday, August 10th We are offering for them to put information in our Unique Shopping and Dining Guides that are being sent to the tour company, Burlington Trailways, prior to the tours. OTHER Prepared for and attended Canton Main Street Board Meeting Prepared for and attended SRPED Board meeting. Submitted monthly Chamber Courier and CMS Newsletter Articles. Attended a Promotion Committee meetings for CMS —working on Kids Fest to do's. Volunteered at the Canton Cruise-In. Provided a brief FY 19 report for the Canton Area Chamber board meeting. PUBLIC WORKS, WATER AND SEWER ALDERWOMAN ANGIE LINGENFELTER, CHAIRMAN WTP SLUDGE REMOVAL AND DISPOSAL BID RESULTS The City received four bids for the WTP Sludge removal and disposal. The City received bids from Metro Ag Inc, Customized Environmental Solutions, Synagro, J. Oros Environmental. The low bidder was Metro Ag Inc with a base bid of $93,024.00. The Alternate #1 bid was $93,936.00. The Alternate bid #2 was $93,936.00. Motion and second were made by Alderman Lingenfelter/Nelson to accept the lowest bid from Metro Ago Inc alternate#2. DISCUSS, CONSIDER AND VOTE ON PAYMENT NO 2 &3 FROM WESTERN SPECIALITY CONTRACTORS The City received the final payment for the replacement of the roof at the historic depot. The final amount is $28,000.00 (pay application #2) The City submitted the claim to the insurance company from the hail storm damages. The City received an additional $4,700.00 that was not needed for completion. When the gutters were removed, they found that there was not anything behind the guttering. The City installed copper in the amount of$4,760.00. This amount resulted in the City paying $760.00 from non- insurance money for the repairs. The pay application #3 and final is for the $760.00 Motion and second were made by Lingenfelter/Nelson to make final payment to Western Speciality Contractors for the project in the amount of$28,000.00 and for pay application #3 in the amount of$760.00. PUBLIC SAFETY AND TRAFFIC ALDERWOMAN ANGELA HALE STREETS AND GARBAGE ALDERMAN JEFF FRITZ, CHAIRMAN DISCUSS, CONSIDER AND VOTE ON AN IDOT RESOLUTION FOR MAINTENANCE 2013 MFT- SECTION 13-00000-00-GM #5196 The City had the MFT program in 2013 and at that time there was a project in TIF 1. The plan in 2013 was to reimburse the MFT fund with TIF money. The audit conducted by MOT showed the City did not pay this in 2013. The money has been paid out of MFT, but MOT wants a resolution that shows it will be paid out of the MFT account. This is a formality to complete this portion of the audit. Motion and second were made by Fritz/Nelson to approve the IDOT resolution for maintenance 2013 MFT section 13-00000-00-GM. LAKE, BUILDINGS AND GROUNDS ALDERMAN QUIN MAYHEW MAYOR COMMUNICATION APPOINTMENT OF MICHAEL COURTNEY AS THE WWTP SUPERINTENDENT Mayor McDowell said he would like to appoint Michael Courtney to the WWTP Superintendent. Michael is currently working on his licensing that is required. The appointment will be until November 2019- which will allow him time to see if this is a good fit and also gives them an opportunity to be licensed. Motion and second were made by Aldermen West/Lovell to approve the appointment. The motion carried by voice vote. DONATION Rick McLaren framed a flag to be on display at the historic depot. HISTORIC DEPOT Former City employee Chuck Jarvis has been donating his time in cleaning up and doing some repairs to the depot. GM Mechanical just repaired the depot air conditioner and heating unit. Kevin Stevenson has also been donating time in the cleanup and repairs of the depot. 4T"OF JULY FIREWORKS RECOGNITION OF CITY CLERK Mayor McDowell congratulated City Clerk Diana Pavley Rock for her studies with the Society of Human Resource Management (SHRM) over the last several months and most recently for passing her SHRM exam. SHRM is the most recognized program worldwide for human resource professionals.
