AN ORDINANCE REZONING PROPERTY AT 529 N. AVENUE A,
539 N. AVENUE A, AND 551 N. AVENUE A FROM R-2
ZONING CLASSIFICATION TO B-2 ZONING CLASSIFICATION
WHEREAS, Petitioner Fulton County Rehabilitation Center filed a petition with
the Joint Planning and Zoning Commission for the re-zoning of the real property
described below, said property being within the corporate limits of the City of
Canton, Illinois; and
WHEREAS, the Petitioner has owned the property located at 529 N. Avenue A for
several years and recently purchased the properties located at 539 N. Avenue A and
551 N. Avenue A; and
WHEREAS, the current zoning classification of the property is R-2 and the
Petitioner intends for the property to change to a B-2 zoning classification; and
WHEREAS, after proper notice, a public hearing on the Petition was conducting by
the Planning and Zoning Commission of the City of Canton on June 10, 2019; and
WHEREAS, on June 10, 2019, the Planning and Zoning Commission voted to
recommend to the City Council that the real property described below be rezoned
pursuant to 65 ILCS 5/11-13-1 et seq.; and
WHEREAS,it is in the best interest of the City of Canton, Illinois, that the property
be rezoned within the City of Canton, to have the existing houses demolished.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
Canton, Illinois, as follows:
1. The Canton City Council hereby finds as facts the assertions.set forth above.
2. The following-described real property be and is hereby rezoned from R-2 to
B-2:
PARCEL 1:
A part of the Northeast Quarter of Section 27, Township 7 North, Range 4 East of
the Fourth Principal Meridian, Canton, Fulton County, Illinois described as follows:
Commencing at the Northwest corner of Lot #2, Block #1, in Smith & Johnson's
Addition to the City of Canton, in said quarter, running thence North 63 feet, thence
East 146 feet, thence South 63 feet, and thence West to the place of beginning, 146
feet; also known as Lot#3,Block#4 in Joseph Zwisler's Addition to Canton,Illinois.

PARCEL 2:
Lot Number Two (2) in Block Number Four (4) in Joseph Zwisler's Addition to the
City of Canton, situated in the County of Fulton and State of Illinois.

Address: 539 N. Avenue A, Canton, IL 61520
PARCEL 3:
Lot Number One (1) in Block Number Four (4) in Zwisler's Addition to Canton,
Fulton County, Illinois.

3. Fulton County Rehabilitation Center will pay to the City of Canton the fees
required to file a certified copy of this Ordinance with the Fulton County Clerk
and Recorder of Deeds, no later than ninety (90) days from the date of this
Ordinance.
4. Upon proof of filing of a certified copy of this Ordinance, the Zoning
Administrator is directed to make the appropriate map amendments to the City
of Canton to reflect this re-zoning.
5. This Ordinance shall be in full force and effect upon its passage by the City
Council of the City of Canton and approval by its Mayor.
PASSED by the City Council of the City of Canton, Illinois, and approved by the
Mayor this 18 day of June 2019, upon a roll call vote as follows:
