ORDINANCE NO. 12 36
Rezoning certain property at 1320 North Main Street
Canton, Illinois 61520
Wf~REAS, it appears to the City Council of the City of Canton,
Illinois, that the territory hereinafter described is located within the
corporate limits of the City of Canton, said premises being generally
located at 1320 North Main Street, in the City of Canton, Fulton County,
State of Illinois; and,
Wf~REA.S, it further appearing to said City Council that a
Petition for Rezoning was duly filed and due and proper notice thereof was
published in the Canton Daily Ledger, a secular newspaper having a general
circulation in the City of Canton, County of Fulton and State of Illinois,
said notice being made and published according to the statutes of the State
of Illinois and the ordinances of the City of Canton, Illinois; and
WfISREAS, a public hearing was held before the Planning & Zoning
Omission of the City of Canton, Illinois, on the 13th day of March, 1989,
concerning the request of Fran Pusey to rezone the hereinafter described
real estate frcan an R-2 zoning configuration to a B-2 PUD zoning
configuration with the following restrictions:
1. The property shall be used for a day-time business and
apartrr~ents such as blueprinting, photocopying, printing, carpet, rug,
electrical, grazing, heating, painting, paper hanging, plumbing, roofing or
ventilation contractor's establishments, excluding outside storage yards,
exterminators, interior decorating establishments, medical or dental
laboratories for research or testing, not involving any danger of
explosion, nor of offensive noise, vibration, smoke, odorous matter, heat,
humidity, glare, or other objectionable effect, musical instnunent repair
shops, office or business machine stores, sales or rental, photographic
developing or printing establishments and studios, radio and television
studios, typewriter or other small business machine repair shops, venetian
blind, window shade, or awning shops, including repairs, limited to 2,500
square feet of floor area per establishment, any service establishment of
an office-showroom or workshop in the nature of an electrician, decorator,
dressmaker, tailor, shoemaker, baker, printer, upholsterer, photographic
reproduction, and similar establishments that require a retail adjunct and
of no more objectionable character than the aforementioned, subject to the
provision that no more than five (5) persons shall be employed at any time
in the fabrication of goods.
2. All business establishments shall be day-time retail or
service establishments dealing with customers which are low volume retail
or service establishments consistent with the available parking.
3. Lighting shall be consistent with the existing business and
shall not involve any lighting that would be disruptive to the residential
areas.
4. The location shall not be used for establishments involving
the retail sale of food or alcohol.
5. There shall not be any manufacturing process with
substantial noise, dues, or noxious odors involved or involving any
business in the treatment, care or grooming of animals.
6. The present location will not be expanded.
7. There will be no outside storage of raw materials or refuse
except in closed containers.
4JHERF.AS, it further appearing to said City Council that the
Planning & Zoning Commission has reviewed the request of FRAN PUSSY
according to law and that the Planning & Zoning Commission has filed its
written recommendation with the said City Council recommending that the
property hereinafter described be rezoned to a B-2 PUD zoning
configuration subject to the above restrictions;
Ti~REFORE, BE IT ORDAINID BY THE CITY COUNCIL OF THE CITY OF
CANTON, ILLINOIS:
SECTION 1. That the territory hereinafter described be, and the
same is hereby rezoned from an R-2 zoning configuration to a B-2 PUD
configuration subject to the restrictions as set forth above, said premises
being more particularly described as follows to-wit:
Lot Number Six (6) in Van Dyke Subdivision, being part
of the South Half of Section 22, Township 7 North,
Range 4 East of the Fourth Principal Meridian, Canton,
Fulton County, Illinois.
SDGTION 2. That the City of Canton zoning maps, documents, and
related regulations be, and the same are hereby amended so that the
territory hereinabove described shall be, and the same is hereby made a B-2
PUD zoning configuration with the above restrictions according to the
statutes of the State of Illinois and the ordinances of the City of Canton,
Illinois.
SECTION 3. That this ordinance shall be in effect from and after
a majority vote of the City Council of the City of Canton, Illinois, and
approval by the Mayor thereof.

It is the recommendation of the Planning and Zoning Comission to annex ~~,~
into the City of Canton Outlot "C" in Bar-Mac Subdivison with a zoning ~~
classificaiton of R-2 (Single Family Residential). (See attached)
It is the recommendation of the Planning and Zoning Commission to
rezone from CO-1 (Conservation District) to R-2 (Single Family Resident-
ial) the property belonging to Thomas S. and Linda Skuse Jr. located
north of Sycamore and 16th Ave. (See attached)
It is the recommendation of the Planning and Zoning Commission to
rezone from R-4 (Multiple Family) to B-2 (General Commercial) for the ~~~
property described as follows: Part of lot 72 in Original Town of ~ ~~ ~~~`~
Canton, Fulton County, Illinois, described as follows: commencing at '"'
the Southeast corner of said lot, thence running North 123-3/4 feet,
thence West 60 feet 9 inches, thence South 123-3/4 feet, and thence
East 60 feet and 9 inches to the place of beginning. (See attached)
It is the recommendation of the Planning and Zoning Commission to
rezone from nonconforming use to B-2 with a Planned Unit Development
as follows:

The Planning and Zoning Commissiong accepted the preliminary plat for
the property commonly known as Hulit School Property located at the
corner of N. Ave. C and Chestnut Street. This property has been pur-
chased by Frances H. Martin and Anna Leigh Wolf.
