Vu-Q-ZEAS, the Lega I and Ordinance Com~ni ttee has determined that it is necessary and in the best interest of the City of Canton to amend Title 5, Chapter 8 of the Canton vlunicipal Code as hereinafter set forth; and, VI+F~.AS, the Canton City Council has made a similar determination. NUN, TFEREFORE , BE I T ORDA I Nm BY Ti-E CITY OOI~VC I L OF TI-E CITY OF CANTON, FUlton County, Illinois, as follows: 1. That the Canton City Council hereby finds the foregoing recitals to be fact. 2. That Title 5, Chapter 8 of the Canton ~.~unicipal Code is hereby amended to read as follows: "Chapter 8 BURN I (~, REGULATIONS 5 - 8 -1 : BURN I Na TRASH, PAPERS , RUBE I SI-I, VJ I RE OR GARBPGE : (a) Outdoor burning prohibited. No person shall burn any processed 4vood, trash, paper, rubbish, wire or garbage out of doors anywhere in the city. This section shall not prohibit the use of constantly attended outdoor fires for cooking or recreational purposes if participants are present. This section shall also not prohibit the burning by a commercial operator as long as said business is in an area properly zoned for business and the burning does not othe revise create a fire hazard. R, (b) Other burning prohibited. No person shall burn any trash, paper, rubbish, wire, or garbage indoors in the city except in an incinerator complying with all applicable laws and ordinances. (c) Heating and cooking stoves. Nothing in this ordinance shall be deemed to prohibit the use of wood in stoves used for cooking, the use of wood in fireplaces for decorative fire or the use of wood in fireplaces or stoves designed for heating. 5-8-2: BURNIN3 OF YARD CLIPPINaS: Open burning of leaves, grass cuttings, shrubbery cuttings, tree limbs, and other materials accumulated as the result of the care of lawns, shrubbery, vines and trees (hereinafter referred to as landscape waste). The open burning of landscape waste is prohibited within the city of limits of Canton except as follows: (1) The open burning of landscape waste shall be permitted only on Tuesdays, Wednesdays, Thursdays, Fridays, Saturdays, and Sundays between the hours of 9:00 a.m. and sunset. (2) The open burning of landscape waste shall be permitted on private property, with the consent of the owner or person in charge of the property. (3) The open burning of landscape waste is not permitted on lanes, parking areas, alleys and all paved areas. The smoke emitted from such burning shall not inhibit the flow of smooth and safe vehicular or pedestrian traffic passage. (4) No person shall burn any landscape waste unless such fire is at least 20 feet from any structure. (5) Any fire resulting from the open burning of landscape waste shall be constantly attended by a competent person until such fire is extinguished. (6) The Fire Chief shall prohibit any open burning of landscape waste when the atmospheric conditions or other conditions at the location of the fire constitute a hazard. 5-8-3: PEN4LTY: Any person, firm or corporation violating any provision of this ordinance shall be fined not less than $25.00 nor more than $500.00 for each offense, and a separate offense shall be deemed con•mitted on each day during or on which a violation occurs or continues." 3. The provisions of this Ordinance are severable and if any sentence, section or other part of this ordinance should be found to be invalid, such invalidity shall not affect the remaining provisions, and the remaining provisions shall continue in full force and effect. 4. This Ordinance shall be in full force and effect (10) days after its passage by the City Council of the City of Canton, Fulton County, Illinois, approval by the t~~ayor thereof, and publication in pamphlet form as provided by law. PASSED by the City Council of the City of Canton, Fulton County, Illinois, at a regular meeting this 3rd day of July 1990, upon a roll call vote as follows: AYES: Aldermen Kovachevich, Fuller, Sarff, Meade, Bohler, May, Chapman.
