1. That the Canton City Council hereby finds the foregoing
recitals to be fact.
2. That the Agreement, a copy of which is attached as
Exhibit A, is hereby approved by the Canton City Council and the
Mayor is hereby directed to execute and deliver the same on behalf
of the City of Canton.
3. That this Resolution shall be in full force and effect
immediately upon its passage by the City Council of the City of
Canton, Fulton County, Illinois, and approval by the Mayor
thereof .
PASSED by the City Council of the City of Canton, Fulton
County, Illinois at a regular meeting this 16th day of
November, 1993, upon a roll call vote as follows:

at the end hereof and is by and between the City of Canton, an

of $38,805.75 as shown on Exhibit "B" hereto attached; and,
Whereas, the City Council of the City has agreed to waive
the requirement of Section 8-21-1 of the Canton Municipal Code
that a written agreement shall be in existence and in the City's
(ilea before any construction start;
NOW, THEREFORE it is agreed that hereafter, any person or
entity desiring to connect to the 6 inch water line herein
described before connecting shall pay to the City a tappage fee in
addition to the normal tappage fee based upon the $38,805.75 cost.
Payments shall be made to the City Treasurer for
reimbursement as hereafter provided.
This agreement shall be fora period of ten (10) years from
the issuance of the Illinois E.P.A. permit for the line.
Reimbursement shall be calculated as follows: the first
person to tap on hereafter shall pay $38,805.75 (cost) divided by
twenty-seven (properties served) plus one or $1,385.92• The money
so received shall he divided among the then current lot owners.
When the next investor wishes to tap on (s)he shall pay (original
cost) $38,805.75 divided by twenty eight properties served plus
one or $1,338.13. This sum shall then be divided among the
twenty-eight earlier invastors et seq. so that if all properties
in the area are sold, each will share equally in the extension
cost.
Each year commencing in September 1, 1993 the principal
amount shall be adjusted by the Consumer Price Index (CPI). All
CPI increases shall go to the City for maintenance and
administration.
In witness the parties have executed this agreement on this
day of October, 1993•
