HomeMy WebLinkAboutResolution #3236 ~~3236 RESOLUTION WHEREAS, the City of Canton located in the County of Fulton, State of Illinois, wishes to install a 203.2mm (8") waterline along the south side of IL Route 9 which, by law, comes under the jurisdiction and control of the Department of Transportation of the State of Illinois, and WHEREAS, a permit from said Department is required before said work can be legally undertaken by said City; now THEREFORE, be it resolved by the City of Canton, County of Fulton, State of Illinois, First: That we do hereby request from the Department of Transportation, State of Illinois, a permit authorizing the City of Canton to proceed with the work herein described. Second: That we hereby pledge the good faith of the City of Canton and guarantee that all work shall be performed in accordance with the conditions of the permit to be granted by the Department of Transportation, State of Illinois, and to hold the State of Illinois, Department of Transportation harmless, on account of any damage that may occur to persons or property, during the prosecution of such work, and assume all liability for damage to persons or property, due to accidents or otherwise, by reason of the work which is to be performed under the provisions of said permit. This permit allowing occupancy and work on state right-of-way is hereby approved on this of ,19 ' Contact the appropriate District Office day Department of Transportation MAI 1113 (Rev. 2194) This permit is subject to the conditions and restrictions of Part 530 of Title 92 of the Illinois Administrative Code including but riot limited to the following: (1) The applicant represents all parties in interest and shall furnish material, do all work, pay all costs and shall in a reasonable length of time restore the damaged portions of the highway to a condition similar or equal to that exist- ing before the commencement of the described work, including any seeding or sodding necessary. (See Section 530.250.) (2) The proposed work shall be located and constructed to the satisfaction of the District Engineer or his duly autho- rized representative. No revisions or additions shall be made to the proposed work on the right-of-way without the written permission of the District Engineer or his duly authorized representative. (See Section 530.200.) (3) The applicant shall at all times conduct the work in such a manner as to minimize hazards to vehicular and pedes- trian traffic. All signs, barricades, flaggers, etc., required for traffic control shall be furnished by the applicant. (See Section 530.240.) (4) The applicant, his successors and assigns, agrees to hold harmless the State of Illinois and its duly appointed agents and employees against any action for personal injury or property damage sustained by reason of the exer- cise of this permit. (See Section 530.225.) (5) The applicant shall not trim, cut or in any way disturb any trees or shrubbery along the highway without the approval of the District Engineer or his duly authorized representative. (See Section 530.600.) (6) The State reserves the right to make such changes, additions, repairs and relocations within its statutory limits to the facilities constructed under this permit or their appurtenances on the right-of-way as may be considered neces- sary to permit the relocation, reconstruction, widening or maintaining of the highway. The applicant, upon written request by the District Engineer, shall perform such alternations or change of location of the facilities, without expense to the State. Should the applicant fail to make satisfactory arrangements to comply with this request within a reasonable time, the State reserves the right to make such alterations and the applicant agrees to pay for the cost incurred. (See Section 530.310.) (7) This permit is effective only insofar as the Department has jurisdiction and does not presume to release the appli- cantfrom compliance with the provisions of any existing statutes or local regulations relating to the construction of such work. (See Section 530.40.) (8) If the applicant and the District cannot agree either on whether the permit should be issued or on what conditions would be appropriate, the applicant may, within 30 days of the issuance of written notice of the District's position, appeal the District's determination to the Chief of the Department's Central Bureau of Operations. The work authorized by this permit shall be constructed without expense to the State of Illinois. The proposed 203.2mm (8") waterline shall run from Sta. 8+75 to Sta. 28+75 along the south side of IL Route 9 adjacent to and within 2.44m (8') of the states' right-of-way. The backfill of the trench shall be thoroughly compacted at time of backfill by tamping by mechanical means, and any depressions which may develop within the area involved in the construction operations, due to settlement of the backfilling material, shall be kept filled and the right-of-way restored to its original condition, during a period of 6 months from the date of the completion of the work authorized in this permit. All trenches within 0.61m (2') of the existing pavement, stabilized shoulder, curb, or sidewalk shall be backfilled to within .30m (1') of the surface according to Articles 210.01 and 703.05 of the "Standard Specifications for Road and Bridge Construction." The remaining 0.30m (1') shall be backfilled with material to restore the disturbed area to its original condition. The length of open trench shall be kept to the practicable minimum consistent with requirements for pipeline testing. Open trench and windrowed excavated material shall be protected as required by Chapter 6 of the Illinois "Manual of Uniform Traffic Control Devices." Where practicable, the excavated material shall be deposited between the roadway and the trench as added protection. Excavated material shall not be allowed to remain on the paved portion of the roadway nor the shoulder area. Where right-of-way width does not allow for windrowing excavated material off the paved portion of the roadway, excavated material shall be hauled to an off-road location. Utility poles, manholes, handholes, fire hydrants or any other obstruction shall not be placed in the ditch flowline of any state highway. All pipe, conduit, wire, poles, cross arms, or other materials distributed along the highway prior to installation shall be placed as remote as practicable from the edge of the pavement in a manner to minimize its being a hazard to errant vehicles or an obstacle to highway maintenance. If material is to be stored on highway right-of-way for more than 2 weeks prior to installation, approval must be obtained from the Department. Page 2 Water main cover shall be sufficient to provide freeze protection and preferably should be a minimum of 1.37m (4.5'). The installation shall be located as near as practicable to the right-of-way line and not more than 2.44m (8') from and parallel to the right-of-way. This permit is issued only with the express understanding that the Applicant has satisfied all requirements of the Illinois Environmental Protection Agency, Division of Public Water Supplies. Water lines shall be installed to meet or exceed the recommendations of the current "Standard Specifications for Water and Sewer Main Construction in Illinois." Any tree trimming, tree removal, or root disturbance required for the installation of utility facilities covered by this permit shall ng~ be considered normal maintenance operations. Tree trimming, tree removal, and/or root disturbance shall require the application for, and issuance of, a separate permit. This permit shall be submitted for approval to the District Landscape Architect, Bureau of Operations (Merle Krause at 309-671-4483). The backfill for trenches and excavation made in the subgrade of the proposed State improvements, and for all trenches outside of the subgrade where the inner edge of the trench is within 0.61m (2') of the edge of the proposed pavement, curb, gutter, curb and gutter, stabilized shoulder, or sidewalk, shall be made with trench backfill material, unless the excavated material meets the requirements of Articles 703.01 and 703.05. The backfill of the open hole shall consist of trench backfill material (sand) and shall be compacted in 203.20mm (8") lifts by ramming or tamping by mechanical means. The trench backfill material shall be brought up to an elevation level with the bottom of the existing concrete pavement. All underground facilities shall be located prior to construction. Call J.U.L.I.E. at 1-800-892-0123 at least 48-hours in advance. Traffic on the highway shall be protected by use of signs, barricades, flagmen, lights, and watchmen as may be required during progress of work. Applicable traffic control standards are included as a part of this permit. All costs in the location and/or adjustment of utilities shall be at the expense of the Applicant. The Applicant must notify this office 48 hours prior to the start of any work on State right of way. This permit is valid only for those facilities located upon State right-of-way and precludes installation upon non-State right-of-way without acquisition of any required and/or necessary easements. Page 3 It must be understood that everyone working on this project shall indemnify and save harmless the State of Illinois, its officers, and employees, from all suits, actions, or damages received or sustained by any person or property on account of or in consequence of any act of omission, neglect, or misconduct, by your organization or anyone working with your organization. The Applicant shall require his Contractor (or Contractors) to perform his (or their) work in accordance with the "Standard Specifications for Road and Bridge Construction," adopted July 1, 1988, and the "Supplemental Specifications" in effect on the date of construction. All material incorporated into the project shall be obtained from a Department approved source and shall be in accordance with Section 700 of said "Specifications." Work is not to be started on the project until the permit has been approved by this Department. This permit should be available at the jobsite at all times for inspection by a duly authorized representative of the Department of Transportation or the Illinois State Police. Upon completion of all construction or maintenance work on state highway rights-of-way, the Contractor and/or the Applicant shall remove all excess material and restore all turf and terrain to the satisfaction of the Department. Such cleanup and repair may consist of backfilling, regrading, reseeding, resodding, or any other requirement to restore the right-of-way to a condition equivalent to that which existed prior to the commencement of the project. No deviations will be allowed without approval from this office. If the applicant deviates without approval from this office, the facility may be required to be relocated off of State right-of-way at the applicant's expense. The Applicant or his Contractor (or Contractors) shall control and protect all vehicular and pedestrian traffic by use of signs, barricades, flagmen, lights, watchmen and by any other means as required in the "Manual on Uniform Traffic Control Devices for Streets and Highways" during the progress of the work as described within this permit. Minimum desirable standards are attached for normal situations.
