HomeMy WebLinkAboutResolution #3235y Y s P RESOLUTION N0. 3235 A RESOLUTION ASCERTAINING THE PREVAILING RATE OF WAGES FOR LABORERS, MECHANICS AND OTHER WORKMEN EMPLOYED IN ANY PUBLIC WORKS BY THE CITY OF CANTON, ILLINOIS WHEREAS, the State of Illinois had enacted "AN ACT regulating wages of laborers, mechanics and other workmen employed in any public works by the State, county, city or any public body or any political subdivision or by anyone under contract for public works," (hereinafter referred to as the "Act") as set forth in Chapter 48, Section 39s-1 through 39s-12 of the Illinois Revised Statutes, 1991; and, WHEREAS, said Act requires the City of Canton, Illinois to investigate and ascertain the prevailing rate of wages as defined in said Act for laborers, mechanics and other workmen in the locality of the City of Canton, employed in the construction of public works for said City, exclusive of maintenance work. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS. 1. The prevailing rate of wages in this locality for laborers, mechanics and other workmen engaged in the construction of public works coming under the jurisdiction of the City of Canton is hereby ascertained to be the same as the prevailing rate of wages for construction work in the Fulton County area as determined by the Department of Labor of the State of Illinois as of June 1, 199., a copy of which is attached hereto and made a part by reference as Exhibit "A". 2. Nothing herein contained shall be construed to apply said prevailing rate of wages to any work or employment except public works construction of the City of Canton to the extent required by the Act. 3. The City Clerk of the City of Canton, Illinois shall publicly post and keep available for inspection by any interested party in the main office of this City of Canton this determination of the prevailing rate of wages. 4. The City Clerk of the City of Canton, Illinois shall mail a copy of this determination to any employer, and to any association of employers and to the person or association of employees who have filed, or file, their names and addresses, requesting copies of any determination stating the particular rates and the particular class of workmen whose wages will be affected by such rates. 5. The City Clerk of the City of Canton, Illinois shall promptly file a certified copy of this Resolution with both the Secretary of State of the State of Illinois and the Department of Labor of the State of Illinois. 6. The City Clerk of the City of Canton, Illinois shall cause to be published in the Canton Daily Ledger a notice of this determination of the prevailing rate of wage is effective and that this is the determination of this public body. 7. This Resolution shall be in full force and effect upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof. 4 PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 7th day of June, 1994, upon a roll call vote as follows: AYES: Aldermen Chapman, P?ay, Sarff, Phillips, Mc~lleck, Coay. The following list is considered as those days for which holiday rates of wages for work performed apply: New Years Day, Memorial/Decoration Day, Fourth of July, Labor Dey, Veterans Day, Thanksgiving Day, Christmas Day. Generally, any of these holidays which fall on a Sunday is celebrated on the following Monday. This then makes work performed on that Monday payable at the appropriate overtime rate for holiday pay. Common practice in a given local may alter certain days of celebration such as the day after Thanksgiving for Veterans Day. If in doubt, please check with IDOL. EXPLANATION OF CLASSES TRUCK DRIVER - BUILDING, HEAVY AND HIGHWAY CONSTRUCTION Clare 1. Drivers on 2 axle trucks hauling lase than 9 ton. Air compressor and welding machines and brooms, including those pulled by separate unite, truck driver helpers, warehousemen, mechanic helpers, greasers end firemen, pickup trucks when hauling materials, tools, or men to and from and on-the-job site, and fork lifts up to 6,000 lb. capacity. Class 2. Two or three axle trucks hauling more than 9 ton but hauling lase than 16 ton. A-frame winch trucks, hydrolift trucks, or similar equipment when used for transportation purposes. Other Classifications of Work: For definitions of clasaificatlonn not otherwise set out, the Department generally has on file such definitions which are available. If there 1s no such definition on file, the Bureau of Labor Statistics SIC list will be used. If a task to be performed is not subject to one of the classifications of pay set out, the Department will upon being contacted state which neighboring county has such a claeellication and provide such rate, such rate being deemed to exist by reference in this document. Further, if no such neighboring county rate applies to the task, the Department shall undertake a special determination, such special determination being then deemed to have existed under this determination. LANDSCAPING Landscaping work falls under the existing classifications for laborer, operating engineer and truck driver. The work performed by landscape plantsmen and landscape laborer is covered by the existing classification of laborer. The work performed by landscape operators (regardless of equipment used or its size) is covered by the classifications of operating engineer. The work performed by landscape truck drivers (regardless of size of truck driven) ie covered by the classifications of truck driver. Page 2 of 2
