RBSOLDTION N0. 3225
A RESOLIITION APPROVING AN AGREEMENT BETi~TEEN
THE CITY OF CANTON AND CRAWFORD, MURPHY 8e TILLY, INC.
WHEREAS, Legal and Ordinance Committee has determined that
it is necessary and in the best interest of the City of Canton
that the attached Agreement for Engineering Services for the
Design Phase of City of Canton Solid Handling Improvements between
the City of Canton and Crawford, Murphy & Tilly, Inc. be approved;
WSEREAS, the Canton City Council has made a similar
determination.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF CANTON, Fulton County, Illinois as follows:
1. That the Canton City Council hereby finds the foregoing
recitals to be fact.
2. That the Agreement for Engineering Services For The
Design Phase of City of Canton Solids Handling Improvements, a
copy of which is attached as Exhibit A, is hereby approved by the
Canton City Council and the Mayor is hereby directed to execute
and deliver the same on behalf of the City of Canton.
3. That this Resolution shall be in full force and effect
immediately upon its passage by the City Council of the City of
Canton, Fulton County, Illinois, and approval by the Mayor
thereof .
PASSED by the City Council of the City of Canton, Fulton
County, Illinois at a regular meeting this 3rd day of May,
1994, upon a roll call vote as follows:

FIRST AMENDMENT TO THE
AGREEMENT FOR ENGINEERING SERVICES
FOR THE
DESIGN PHASE OF
CITY OF CANTON SOLIDS HANDLING IMPROVEMENTS
WHEREAS, the CITY OF CANTON, hereinafter referred to as the "OWNER", and
CRAWFORD, MURPHY & TILLY, INC., Consulting Engineers, Springfield, Illinois,
hereinafter referred to as the "ENGINEER," entered into an Agreement for Engineering
Services dated September 21, 1993, hereinafter referred to as the "ORIGINAL
AGREEMENT," and
WHEREAS the ORIGINAL AGREEMENT provides that payment for the work
outlined in Section 1.3 of the ORIGINAL AGREEMENT shall be negotiated after the
Amendment to the Facilities Plan is sufficiently completed to allow a determination of the
scope of work and estimated level of engineering effort and that said work is now nearly
completed,
NOW THEREFORE, the ORIGINAL AGREEMENT is hereby amended as follows:
"1.3 -Design Phase -Upon written notice to proceed with the design phase, the
ENGINEER will prepare detailed plans, specifications, attend all necessary meetings and
conferences, submit documents to the OWNER for review and approval, and assist the
OWNER in obtaining necessary permits.
It is understood that the OWNER will not be seeking competitive bids but instead
will be negotiating the construction contract with yet to be named parties. Costs for
preparing bidding documents (front end contractual documents) are not included at this time.

_1,3.1 -Plans and Specifications -The ENGINEER shall prepare plans and
specifications for construction. Sufficient sets of Plans and Specifications shall be prepared
to afford review by the OWNER plus ten (10) sets for use by the construction personnel.
Intermediate reviews by the OWNER shall be scheduled at approximately the 50% and 95%
or prefinal stages of design completion.
It is understood that the OWNER intends to construct facilities capable of achieving
Class B sludge criteria as regulated in 40 CFR Part 503. The ENGINEER shall specify an
equipment system capable of achieving Class B sludge, and the design shall be flexible
enough to allow production of Class A sludge, if desired by the City, without major retrofit.
The specifications shall require the equipment manufacturers to warrant that the equipment
system shall be capable of producing Class B quality sludge as defined above.
The preparation of plans and specifications shall include but not be limited to the
following activities:
A. Confirming topographic and site utility information.
B. Arranging, scheduling, and coordinating the services of a competent
geotechnical Engineer to investigate the site and make recommendations on
foundation and design requirements for any new facilities. The cost for soil
borings and geotechnical engineering is not included in the costs presented in
Section 3, but an estimate is included in Revised Exhibit A for OWNER'S use.
1.3.2 -The ENGINEER will assist the OWNER in obtaining the permits necessary
to construct the proposed facilities. At this time, it is anticipated that only Illinois
Environmental Protection Agency permits are required. Not included are any local permits
under local ordinance or jurisdiction.

1.3.3 -Probable Project Cost -The ENGINEER shall prepare ENGINEER'S opinion
of probable construction cost based on final plans and specifications for the purpose of
comparison with proposals obtained by the City.
Section 3 -PAYMENT
Paragraph 3.4. Change Paragraph 3.4 to read as follows:
"The services outlined in Section 1.3 shall not begin without written authorization
from the OWNER
Payment for the services outlined in Sections 1.3.1 and 1.3.3 shall be made on a lump
sum basis for $65,000.00, unless a change or addition to the scope of work is required in
which case an amendment to this agreement will be negotiated by the ENGINEER and the
OWNER
Payment for the services outlined in Section 1.3.2 shall be made on a time and
expense basis in accordance with the attached or current Schedule of Hourly Charges
attached to the ORIGINAL AGREEMENT as Exhibit B.
Attached is a Revised Exhibit A which shall be included in this amendment. The
costs shown in Revised Exhibit A to be paid to the ENGINEER for the services in
paragraph 1.3.2 shall not be exceeded without authorization by the OWNER
All other provisions of the ORIGINAL AGREEMENT remain in full force and effect.

To the amount charged at rates shown will be added the actual cost of blueprints, supplies, transportation and
subsistence and other miscellaneous job related expenses directly incidental to the pertormance of services. A rental
charge will be made when flow monitoring, sampling or level recording equipment, nuclear density equipment or
other similar specialized equipment are used directly on assignment. In the event that additional services such as
exploratory drilling, materials testing, aerial photogrammetry, foundation studies or other specialized services are
furnished to the ENGINEER by another organization, reimbursement for such services shall be at actual cost plus
ten percent.
If assignment requires payment of premium for overtime hours, the fee will be adjusted to include premium costs.
These rates are subject to change upon reasonable and proper notice. In any event this schedule will expire and
be superseded by a new schedule on or about January 1, 1995.

ATTACHMENT "A"
SCOPE OF WORK
CITY OF CANTON
This Scope of Work provides for engineering services to be completed for the water
treatment plant.
1. Preparation of the IEPA disinfectant contact time analysis for Giardia and Virus
reduction to comply with the Safe Drinking Water Act. This analysis is due to a
change in the disinfection methods from chlorine dioxide to free chlorine.
Estimated Cost .................................... $ 3,000.00
2. Preliminary design and IEPA Permitting for the installation of activated carbon,
potassium permanganate, and cationic polymer feed systems and building enclosure.
These chemicals are for coagulation, taste and odor and the control of zebra mussels.
The installation work will be completed by the City.
Estimated Cost .................................... $ 8,000.00
3. Filter underdrain equipment investigation, filter design, and IEPA permitting. The
installation work will be completed by the City.
Estimated Cost .................................... $ 6,000.00
