RESOLUTION N0. 3221
A RESOLUTION APPROVING AN AMENDMENT TO AN INTERGOVERNMENTAL
AGREEMENT BETWEEN THE CITY OF CANTON AND THE ILLINOIS
ENVIRONMENTAL PROTECTION AGENCY
WHEREAS, Legal and Ordinance Committee has determined that
it is necessary and in the best interest of the City of Canton
that the attached Intergovernmental Agreement between the City of
Canton and the Illinois Environmental Protection Agency regarding
the "Clean Lakes Program" be amended; and,
WHEREAS, the Canton City Council has made a similar
determination.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF CANTON, Fulton County, Illinois as follows:
1. That the Canton City Council hereby finds the foregoing
recitals to be fact.
2. That Amendment Number 1 to the Intergovernmental
Agreement, a copy of which is attached as Exhibit A, is hereby
approved by the Canton City Council and the Mayor is hereby
directed to execute and deliver the same on behalf of the City of
Canton.
3. That this Resolution shall be in full force and effect
immediately upon its passage by the City Council of the City of
Canton, Fulton County, Illinois, and approval by the Mayor
thereof .
PASSED by the City Council of the City of Canton, Fulton
County, Illinois at a regular meeting this 19rh day of April,
1994 upon a roll call vote as follows:
AYES Aldermen. Chapman, May, Meade, Sarff, Phillips, N1Qlleck,
Coay.
NAYS: None.
ABSENT: Alderman Bohler.

AMENDMENT NUMBER 1 TO
INTERGOVERNMENTAL AGREEMENT
The Illinois Environmental Protection Agency and the City of Canton, whose address
is 210 East Chestnut Street, Canton, Illinois 61520 hereby agree to the amendment
of Intergovernmental Agreement Number FWC-2023, dated November 1, 1991, executed
as follows:
1. In Section B. PURPOSE AND SCOPE OF WORK, item 2.d., "...by June 30, 1994." is
changed to "...by August 31, 1994."
2. In Section D. AGREEMENT PERIOD, "... through June 30, 1994." is changed to
"...through August 31, 1994."
3. In Section G. AUDIT: ACCESS TO RECORDS, item 1. is hereby deleted in its
entirety and replaced as follows:
1. The City shall maintain, for a minimum of five (5) years after the com-
pletion of the contract, adequate books, records, and supporting documents to
verify the amounts, receipts, and uses of all disbursements of funds passing
in conjunction with the contract; the contract and all books, records, and
supporting documents related to the contract shall be available for review,
copying and audit by the Auditor General, the U. S. Environmental Protection
Agency, Comptroller General of the United States, the U.S. Department of
Labor, the Agency or any of their duly authorized representatives; and the
City agrees to cooperate fully with any audit conducted by the Auditor
General, the U.S. Environmental Protection Agency, Comptroller General of the
United States, the U. S. Department of Labor, or the Agency, and to provide
full access to all relevant materials and to provide proper facilities for
such assess and inspection. Failure to maintain the books, records, and
supporting documents required by this Section shall establish a presumption in
favor of the State for the recovery of any funds paid by the State under the
contract for which adequate books, records, and supporting documentation are
not available to support their purported disbursement.
4. All other agreements shall remain in force.
