Home My WebLink AboutResolution 10-21-1941 RESOLUTION with respect to the delivery of *690500 Judgment runding bonds of the City of Canton, in Fulton County, Illinois. * * * * * * * * WHEREAS, heretofore, on Tuesday, October 7, 1941, the City Council of the City of Canton, in the County of Fulton and State of Illinois, adopted an ordinance providing for the issuance of Sixty- nine Thousand rive Hundred Dollars ($69,500) Judgment runding bonds, and which said ordinance has been duly approved by the tvna.yor of said City and published in a regular issue of The Canton Daily Ledger on the 10th day of October, 1941, and which said newspaper is a secu lar newspaper of general circulation in said city and has been duly published therein for at least six (6) months prior to the date of such publication, proof of which such publication is hereto attached and made a part of this resolution; and WHEREAS, this city has no funds with ;.hick to pay said jud ments except that portion thereof in excess of the sale price of sal, bonds, which is not less than the par value thereof; and WHEREAS, it is for the best interests of this city that said Judgment runding bonds be delivered at once and said judgments be paid. NOW, 'T'HEREYORE, Be It Resolved by the City Council of the City of canton, in the 'ounty of Fulton and state of Illinois: - I Section 1. That the recitals above set forth are true and correct. Section ,. That the officials of this City are directed to cause said bonds to be prepared, executed and, delivered as soon as possible to Barcus, Kindred & company, Chicago, Illinois, the pur- chaser thereof, pursuant to their offer to purchase said bonds, said offer being not less than the par value thereof, and such contract of purchase is hereby ratified, approved and confirmed, and that -1- ..._..... .. simultaneously with the delivery of said bonds said judgments des- cribed in said bond ordinance be paid in full using the proceeds of said bonds in full to pay said judgments and any small additional amounts be paid out of the treasury of the City. section Z. That the officials of this city are directed to execute any proper certificate or other documents to evidence the legality of said bonds and the City Attorney is directed to take ap- propriate satisfaction piece from the attorney for the judgment creditors and to record the same promptly upon its receipt and pro- cure a certificate from the Clerk of the Circuit Court of rulton County, Illinois, evidencing the satisfaction of said judgments. Section 4. That a certified copy of this resolution be filed with the Treasurer of this City. Section 5. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed, and this resolution shall be in full force and effect forthwith upon its adoption. / Approved:, p Mayor Attest.
