R E S 0 L U T I 0 N
WHEREAS, numerous installments of special assessments against
tracts of land in the several paving districts of the City of Canton
have been unpaid and are now delinquent and have been forfeited to
the people of the State of Illinois ; and
WHEREAS, the States Attorney of Fulton County has filed a suit
in the Circuit Court of said county entitled, "The People of the
State of Illinois vs The County of Fulton, et al, in Chancery No.
26142", in which said suit action is brought to foreclose the lien
for general taxes upon divers tracts of real estate in said County
of Fulton and in the City of Canton which have been unpaid and for-
feited to the State of Illinois for the past five ( 5 ) years; and
in said suit divers parcels of real estate are included upon which
there remains unpaid installments of special assessments in the
several paving districts in said city, which have been forfeited
to the State ; and, WHEREAS,
The lien of said unpaid special assessments has equal force
and effect and is coextensive with the lien against the premises
against which the same is assessed as the lien for general taxes
levied and assessed against such premises and should be foreclosed
• in the same suit; and, WHEREAS,
Numerous installments, of such special assessments which are
delinquent and, unpaid and have been forfeited to the State are
upon divers tracts of real estate not mentioned or included in the
above mentioned suit, but are liens upon the respecitive premises
against which the same have been assessed and ought to be collected
or foreclosed for the benefit of the holders of bonds issued by
the City of Canton to defray the cost of the local improvements for
which said special assessments have been made; MI THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS,
that the City Attorney be, and he is hereby, authorized and directed
to enter the appearance of the City of Canton and file an answer or
counter-claim on behalf of said City of Canton, as trustee for the
holders of said local improvement bonds, requesting that the lien
for said delinquent installments of special assessments levied by
said City of Canton for local improvements against any of the parcels
of real estate mentioned in said suit be foreclosed in said suit and
that the lien of said City of Canton for said special assessments be
held and declared to be coextensive and of equal priority with the
liens for general taxes against such properties; and,
BE IT FURTHER RESOLVED that said City Attorney also be authorized
and directed to cooperate with the States Attorney of said County of
Fulton in filing such other or further suits to foreclose the liens
for unpaid delinquent installments of special assessments levied and
assessed against any other parcels of real estate within said City of

Canton, which are not included or mentioned in the above mentioned
bending suit; and that the City Attorney be empowered, and authorized
to take any and all such action in the premises as in his judgment
may be necessary or expedient to enforce the collection of all
delinquent installments of special assessments in the several
paving districts in said City of Canton to the end that the col-
lection of said special assessments may be made for the benefit of
the holders of local improve,dent bonds issued by said city.
