ORDINANCE AMENDING PROVISION 8-9-10 REGARDING THE CANTON LAKE
DAM AND REVOLVING FUND AND THE CITY OF CANTON, ILLINOIS
WHEREAS, the City of Canton has a dam regulated by certain statutory provisions and
Illinois Administrative Code, which has been codified through the City of Canton Municipal
Code found within Section 8-9-19 entitled Canton Lake Dam; Revolving Funds; Operation of
Maintenance; and
WHEREAS, the maintenance and construction of dams were previously regulated by the
Illinois Department of Transportation through the Illinois Administrative Code namely, 92
I11.Adm. 3702, et seq; and
WHEREAS, the Illinois Department of Natural Resources has now been charged with
the requirement to regulate the maintenance and construction of dams, such as the one located at
Canton Lake and Section 8-9-10 needs to be modified to be regulated by the appropriate Illinois
Administrative Code Regulations through the Illinois Department of Regulations
NOW,THEREFORE, BE IT ORDAINED, by the City Council for the City of Canton,
Fulton County, Illinois, as follows:
Section 8-9-10 shall now state as follows:
8-9-10: CANTON LAKE DAM; REVOLVING FUNDS; OPERATION OF MAINTENANCE:
"There is hereby established a revolving fund to be utilized solely for the operation and
maintenance of Canton Lake Dam and, if necessary, for breaching of the structure. Said fund
shall be maintained at an amount of money not less than twenty-five thousand dollars
($25,000.00). Said maintenance and construction of Canton Lake Damn shall be regulated by
the Illinois Department of Natural Resources Rules for construction and maintenance of dams
(17 III.Adm. 3702)or as hereinafter may be amended."
That upon passage of this amendment, the City Clerk shall be instructed to submit to the
Codifiers of Municipal Ordinance the said Ordinance amendment for insertion in its proper place
and each copy of this Code within thirty (30)days of its final passage.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular
meeting this 1st day of May,2018 upon a roll call vote as follows:
