ORDINANCE NO. 1600
AN ORDINANCE RE-ZONING CERTAIN PROPERTY IN THE CITY OF CANTON,
FULTON COUNTY, ILLINOIS.
WHEREAS, a Petition for Re-Zoning, signed by the contract
purchasers of the real estate hereinafter described, was filed
before the Planning and Zoning Commission of the City of Canton,
Illinois, requesting that said real estate be re-zoned from R-4
(Multiple Family Residential District) to a B-2 (General Commercial
District) zoning classification; and
WHEREAS, the real estate which is the subject of this Petition
is legally described as follows and is located at 148 West Locust
Street, in the City of Canton, Fulton County, Illinois:
A part of Lot Number Ninety-one (91) in Original Town of
Canton, Fulton County, Illinois, described as follows:
Commencing at the Northwest corner of said Lot Number
Ninety-one (91), running thence East Sixty (60) feet,
thence South 121-3/4 feet, thence West Sixty (60) feet,
thence North to the place of beginning, situated in the
County of Fulton, in the State of Illinois.
WHEREAS, MARY C. TALLON is the owner of record and contract
seller and DONNA L. CHARLESWORTH and KENT E. CHARLESWORTH, d/b/a
THE PRAIRIE SCHOONER, are the contract purchasers of the real
estate to be re-zoned and there are no other owners of record; and
WHEREAS, the real estate to be re-zoned is within the corporate
limits of the City of Canton, Illinois; and
WHEREAS, all petitions, documents and other necessary legal
requirements are in full compliance with the statutes of the State
of Illinois and the ordinances of the City of Canton, Illinois, and

proper notice of the filing of the Petition for Re-Zoning was given
as provided by law; and
WHEREAS, a public hearing was held before the Planning and
Zoning Commission of the City of Canton, Illinois on October 12,
1998, pursuant to proper notice published in the Canton Daily
Ledger, a secular newspaper having a general circulation in the
City of Canton, County of Fulton and State of Illinois; and
WHEREAS, on October 12, 1998, the Planning and Zoning
Commission of the City of Canton, Illinois recommended to the City
Council of the City of Canton, Illinois that the real estate
described above be re-zoned from R-4 (Multiple Family Residential
District) to a B-2 (General Commercial District) zoning
classification; and
WHEREAS, the highest and best use of the real estate described
above is for general commercial purposes; and
WHEREAS, it is in the best interest of the City of Canton,
Illinois that said real estate be re-zoned from R-4 (Multiple
Family Residential District) to a B-2 (General Commercial District)
zoning classification.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City
of Canton, Illinois, as follows:
1. That the City Council finds as facts the recitals
hereinabove set forth.
2. That the real estate described above be re-zoned from R-4
(Multiple Family Residential District) to a B-2 (General Commercial
District) zoning classification.
3. That the Zoning Administrator of the City of Canton,

Illinois is hereby directed to make the appropriate changes to the
zoning maps of the City of Canton to reflect this re-zoning.
4. That this Ordinance shall be in full force and effect upon
its passage by the City Council of the City of Canton, Illinois,
and approval by the Mayor thereof.
PASSED by a majority vote of the City Council of the City of
Canton, Illinois, and APPROVED by the Mayor thereof this 20th day
of October , 1998, upon a roll call vote as follows:
Ayes: Aldermen Shores, May, Nidiffer, Meade, Sarff, Phillips, Hartford.
Nays : None.
Absent: Alderman. Nblleck.
