Edwards Way-50 North 4th Avenue, Canton, Illinois 61520. STAFF IN ATTENDANCE Mayor Kent McDowell, City Attorney Curtis Lane, City Clerk Diana Pavley-Rock, Treasurer Crystal Wilkinson, Public Safety Director Richard Fairburn, System Maintenance Superintendent Dash Wilson, Street Superintendent Ron Robinson, WTP Superintendent Greg Pollitt, Comptroller Lou Ann Armstrong MEDIA IN ATTENDANCE: Daily Ledger, Fulton Democrat VIDEO SERVICES BY JOE GINGER PLEDGE OF ALLEGIANCE OPENED THE MEETING INVOCATION—Pastor Glen Nestelrode, First Christian Church PUBLIC PARTICIPATION— Marsha Livers addressed the Council during public participation. Marsha lives on Canton Lake and wanted to discuss concerns regarding the proposal at the Canton Lake. Marsha said that the City may have forgotten or neglected Canton Lake but she has not. It is where she has her home and spends her free time and money. She loves Canton Lake and takes care of it the best way that she can-without much assistance from the City. Marsha explained that she is not upset with the Herman Brother's but instead is more upset with the City. Marsha further explained that the City issued a request for proposal with very little thought in what they are actually looking for in the way of development. She is upset that the City would even consider such a low ball offer with only one bid. She is upset that the City would allow the over development of land by crowding 44 homes onto such a small amount of usable space. There is only 45 homes on the east side of the lake which has an area four times larger than what the Herman Brothers wish to purchase. She is upset that the proposal would allow the possibility of 60 more boats and jet ski's to an already overcrowded lake. She further explained that she is upset that the current lease holders can't extend docks more than 15 feet into the lake, but new lease holders will be allowed to have their docks 32 feet into the lake. Marsha doesn't think the City should allow 44 new septic tanks into a new subdivision without an environmental impact study. She is also upset about the City allowing the closure of a road knowing that everyone in Canton enjoys a drive around the lake. Marsha said this proposal only benefits the Herman Brothers with little regard to what is in the best interest of the citizens of Canton. Marsha asked that the Council vote down the proposal or until there is some due diligence and meaningful thought on what is in the best interest of Canton. Marsha said that she would like to see this on a referendum so citizens could decide what is best for our community. Heidi Yerbic also addressed the Council during the public participation session. Heidi explained that they own a boat with a 454 motor and is 22 1/2 feet long and will not fit on Canton Lake. It is too much for the size of Canton Lake. Heidi said she is a concerned boater and wants to know who is going to enforce the State boating laws. She asked if it would be the City, the DNR, Privately enforced or the County. Heidi wanted to know who will be at Canton Lake to keep them safe. Heidi said that if you allow docks to go 32 feet out into the lake it will make the channel area too narrow. COMMUNITY AND INDUSTRIAL DEVELOPMENT ALDERMAN JOHN LOVELL, CHAIRMAN PRESENTATION BY BOB SENNEFF, PRESIDENT/CEO OF GRAHAM HOSPITAL AND PRESIDENT OF THE BOARD OF DIRECTORS FOR SPOON RIVER PARTNERSHIP FOR ECONOMIC DEVELPMENT ISRPED) REGARDING RESIDENTIAL HOUSING DEVELOPMENT IN THE CITY OF CANTON Bob Senneff said that Graham Hospital has invested $75,000,000 back into the community. This amount includes Canton, Farmington and Lewistown. Graham currently has plans to add another clinic in the market. Bob stated that he has seen significant growth in terms of the number of staff members they employ or contract with through a variety of relationships as well as in the number of physicians they have on staff. Bob hopes to announce later this month a unique scholarship program which supports local kids getting the post high school education they want and deserve-whether that be through Spoon River Community College or another local community college through a local trade school, or through a 4 year university with support up to and including professional studies in a healthcare related field. The key to Graham Health System's long term success and independence will be the ability to recruit professionals back to this area to live, work, raise a family and become ingrained in our local community. A significant hurdle they face not only today, but in the future as well is accessible housing. They simply don't have the inventory/option of available housing which is attractive and essential for folks with lots of career options and little or no geographical boundaries. They really need the types of housing options that are being proposed by the Herman Brothers in their Canton Lake proposal. Bob said he recognizes and appreciates the concerns raised relative to the Canton Lake proposal, he supports the overall concept and hopes the Council will take action so they see the project come to fruition. Bob said that as the largest employer in the area they desperately need more housing options to ensure their ongoing success. Motion and second were made by Aldermen Putrich/Mayhew to table the vote on items#2 and #3 under the Legal and Ordinance Committee, but allow the discussion on these items. COMMITTEE REPORTS: FINANCE ALDERMAN RYAN MAYHEW, CHAIRMAN DISCUSS, CONSIDER AND VOTE ON ADDITIONAL INSURANCE COVERAGE FOR CYBER LIABILITY SEXUAL HARASSMENT, K-9, SALES TAX INTERRUPTION AND UNINSURED/UNDERINSURED AUTO LIABILITY INSURANCE FROM DAN KIESEWETTER The City's insurance agent Dan Kiesewetter addressed the council regarding the additional quotes for insurance coverage that Council previously requested. The City received the following proposed rates • $1,000,000 Cyber Liability—have confirmed quotes at$4,567 and$5,531 annual premium • Increase Sexual Abuse General Liability from$100,000 to$250,000—addtl.$207 annual premium • Increase Sexual Abuse General Liability from$100,000 to $1,000,000—addtl.$413 annual premium • Increase Uninsured/Underinsured Motorist Auto Liability from$100,000 to$500,000—addtl. $1,263 annual premium • Increase Uninsured/Underinsured Motorist Auto Liability from$100,000 to$1,000,000—addtl. $1,895 annual premium • Sales Tax Interruption coverage-$2,000,000 is$2,500 annual premium (current coverage) $1,110,000 is $1,388 annual premium $ 830,000 is $1,038 annual premium Discussion took place regarding the proposed rates/changes. Motion and second were made by Aldermen Jump/Putrich to offer the cyber liability insurance in the amount of$4,964.00 and increase the sexual abuse general liability insurance from $100,000 to$250,000.00 and not increase the uninsured and underinsured auto liability insurance and not continue any sales tax interruption. Discussion The K-9 was already added on at the last meeting and should come out of the forfeiture fund. Alderman Mayhew reported that a budget meeting will be held on January 23, 2018 at 5:30 pm in the Director's Room at City Hall. LEGAL AND ORDINANCE ALDERMAN CRAIG WEST, CHAIRMAN DISCUSS, CONSIDER AND VOTE ON A RESOLUTION APPROVING A LEASE AGREEMENT BETWEEN BRENDA NUTTALL AND THE CITY OF CANTON The proposed resolution is for the rental of the space at the old Ace Hardware building for the Bloomin Crazy business. The term of the agreement is thru December 31, 2018. The prior agreement terminated in March 2018. Motion and second were made by Aldermen West/Lovell to approve the resolution and place it on file. Alderman Jump explained that he previously represented this business as an Attorney so he will be abstaining from the vote. DISCUSS, CONSIDER AND VOTE ON AN ORDINANCE AUTHORIZING A LEASE OF CITY OF CANTON OWNED REAL PROPERTY LOCATED AT: APPROXIMATELY 13.5 ACRES OF 189.16 ACRES AND PARCEL 10-09-30-100-007 LOCATED IN THE NORTHWEST QUARTER, SECTION 30 TOWNSHIP 7N RANGE SE Alderman West explained that area pertains to the campground and the beach at Canton Lake. Alderman Putrich said that he needed some clarification concerning the people that must abstain on the vote as well as what percentage of the aldermen need to vote. Alderman Putrich further explained that he thought that every aldermen on the Council would need to abstain from the vote due to various reasons. Attorney Lane explained that the reasons Alderman Putrich gave would not be considered conflicts and everyone could vote. Attorney Lane said he has a concern and spoke to Alderwoman Hale about the individual going into her business, but would like to look into this situation more before determining if Alderwoman Hale should be abstaining from this vote. Alderman Putrich further explained that he believes the actual maintenance and management agreement needs a lot of work. Alderman Putrich explained that he had some concerns with the size of homes that could be built on the proposed lots. Putrich said that he does not believe the lots would be large enough to build the types of homes that doctors would be interested in building on. Putrich said he also does not think that an individual would be interested in building a home on the lots with such shallow water that kids would not be able to dive into for swimming. Alderman Putrich said he is not in favor of the proposal due to so many unknowns. Putrich said he does not believe the City could ever forecast every unknown for the term of the lease over the next 25 years. Alderman Putrich said he does not want the Council to make a bad decision in voting for the proposal and have future Councils trying to deal with a mistake. If the proposal is approved he would admit to messing up in his vote, but would be happy with any success for the community. Alderman Jump agrees that there is currently a lot of unknowns and a lot of questions that need answered. Alderman Jump said he has not made up his mind on how he will ultimately vote. Alderman Jump said we all have to agree that we need to change the way that Canton does business. This is his first term as Alderman and when he ran he made a promise to use his best effort to push for further development and to serve as a voice not only for his generation, but for all generations. Alderman Jump said that he believes he can speak for everyone and that we can't continue to kick the can and problems down the road for future generations to inherit. If we do not start to address our issues now, we will continue to lose younger families and fail to attract new families, businesses and tourism to the area. Unfortunately a lot of the aspects regarding the proposal were either misinterpreted or are not true. The Canton Lake is not for sale or for lease. The sale is for a proposed 241/2 acres which the developer intends on selling for the construction of taxable homes- not cabins. The lease is for the main boat ramp, the beach and the campground. For this to earn Alderman Jumps support, the City will need to remain in control over the fees, charges, rates, rules and regulations and ordinances of the lake, campground, beach and boat ramp. As we continue this process Alderman Jump believes it is important that this Council remain transparent to ensure that all Citizens have the opportunity to have their concerns and ideas expressed so we can incorporate them into a counter proposal that best protects the interest of our citizens while improving our City. Transparency is required regardless if we support or oppose the project. We owe it to the citizens to keep them informed. Alderman Jump said he believes that Attorney Lane should be directed to conduct a further investigation regarding the issues brought up with Alderwoman Hale and decide if any wrong doings took place. Alderman Jump further explained that it is very important that we remember the issues we are facing as a community. We are faced with a serious lack of housing in the City of Canton. During the last three years the City of Canton has only issued 5 new residential housing permits. This is unacceptable. The old beach is now run down and closed. The restrooms at the main boat ramp are chained shut after being kicked in. Many of the docks along the lake are crumbling and unsafe. Our assets have been neglected for years. We need to start addressing these issues. There is so much left that needs to be cleaned up and fixed up. The revenues from the camping and boating hardly cover the expenses associated with the lake. We are hardly breaking even. Utilities for the campground alone cost the City nearly$20,000.00 per year. This is nearly 2/3 of all of the camping revenue that is brought in without taking into account labor, maintenance, supplies and other improvements. At this point we bring in zero dollars from property taxes from the proposed area to be sold. As long as the City retains ownership of these lots this will continue to be the case. Alderman Jump said that as the current proposal is drafted it does not meet his approval, but it does not mean that he wants to push this proposal aside. We need to keep an open mind. To outright reject this opportunity without negotiating in good faith would be irresponsible. For many years Alderman Jump said that he hears people say that Canton is not business friendly. If the City does not consider this proposal seriously then this would just be another example of the City not being friendly to businesses. We have the opportunity to develop housing, increase property revenue without increases taxes on our other residents,to create jobs, to draw in tourism,to develop infrastructure such as water lines that the City does not have the resources now to take out to the lake. We have the opportunity to enhance the amenities we have available to our citizens. We can't just simply dismiss this idea. We need to continue this conversation to ensure that we are doing something. Alderman Jump said he tabled this item to allow for further discussion and a counter proposal-- and to make sure our citizens remain in control of our lake, campground and beach. To ensure that we have affordable and safe amenities as well as a safe lake. To make sure that the decisions does not adversely affect the environment and to make sure we enhance all that Canton has to offer. All of the Citizens need to keep engaged so we can continue to work together to try to do something to better our community. Alderwoman Lingenfelter said that she received numerous phone calls and emails from citizens in Canton regarding the proposed lease for the City of Canton. The top 12 concerns are: * Too much boat traffic * Too many boat ramps and no place to water ski * All of the boats and increased boat speed will make it hard to fish and will destroy the shoreline. * If the new development of the 44 houses are approved-there will not be any place for people to just walk in and fish off of the banks * This development will destroy the natural habitat * The lake road will be blocked off and people will not be able to drive around the lake * The new development will increase property taxes ` The natures view at the Canton Lake will be destroyed * This is a public lake, not a private lake ` There needs to be more public hearings before a vote is taken ` This vote should be on a ballot as a referendum * The Herman Brothers wants too much control and it sounds too expensive Alderwoman said she wants the City to contact a realtor and have the property appraised to make sure that it meets fair market value. Alderwoman Lingenfelter said she is also concerned about environmental protection provisions being implemented in the proposal regarding sea walls, wells, sewage and yard waste. Alderwoman Lingenfelter said she would also like to see in the proposal a 5-10% profit to the City on any profits generated. She also wants to make sure the Illinois Department of Natural Resources is involved in the process of stocking the lake. The City of Canton already has a fundraiser that they use for the fireworks, but Alderman Lingenfelter said that she would like to see the businesses and citizens get involved and do a fundraising day for the campground. The City will need to have another public meeting to get all of the questions answered before a final vote is made. Alderman Lovell said that one of the complaints that he hears is the potential guest fees. Alderman Lovell said he is not in favor of this fee. He spoke to the Herman Brothers about this fee and they are willing to work with the City on this issue. The Herman Brothers now realize that if they close the road it will be a hassle and does not believe it will actually take place. People like to drive around the lake and the Herman Brothers understand this. Alderman Lovell further explained that he wants language in the agreement that does not discriminate against who is allowed at the lake area. The City will have control over the rates by the ordinances. The Herman Brothers wants to make sure the campground area is clean since they are investing the money in building the homes around the lake. Alderman Lovell said the Herman Brothers are not opposed to someone else managing the campground as long as improvements are made. Alderman Putrich asked the City comptroller what expenses were tied directly to the campground and the boat dock. Putrich also asked about specific cost for mowing and utilities. Comptroller Lou Ann Armstrong explained that as revenue comes in it is separated out. Some of the revenue sources is from the lot leases. Most of the expenses that come out is for the campground. Lou Ann further stated that she is not aware of any situation where the money from this fund up in the general fund. Alderman Putrich said he would like to have a detailed report that shows where the money is going into the various areas such as the beach, boat docks, campground etc. Alderman Mayhew explained that he believes we need to put money into the lake area to make it better. If we have an opportunity to grow our City limits to add water customers this would help pay off the bond and expand our services. This proposal could bring in more residents to our community and is a very positive thing. The lake needs cleaned up. Alderman Mayhew said it is fantastic that we have this many people at the meeting that is interested in what is being discussed for Canton Lake, but people should be interested in most of the things that is discussed in all meetings. Alderman Nelson said that he believes developing 7-10 lots at the lake would be adequate, but developing 44 lots will be too much. The smaller lots will not be able to have a home built that would be of high value. The beach and the bathrooms are in horrible shape and will need a considerable amount of money. The City does not have the money needed. If we are going to make the community grow we need to allow outsiders to come in. The proposal will need to further discussed and have changes made that works for both parties. Superintendent Greg Pollitt explained that it would cost$175,000.00 to upgrade the electrical system at the campground. There would be several thousands of dollars required to upgrade the other areas as well. Mayor McDowell explained that originally he was approached by a citizen that wanted to build a house on the lake. The City has previously discussed the desire to not continue to lease land at the lake. There are currently lots on Del Bar that were surveyed and are now for sale. After further discussion with Council about the lots at the lake Attorney Lane was authorized to put a bid out. The process started on October 30, 2017 and a meeting was held December 19, 2017. When the proposal was opened it included language to lease the campground. It was a surprise to the City because the original discussion was only about the development of the land. The bid/proposal was then shared with the Council in January. The property one was the purchase area and the property two was the lease area. Mayor McDowell further explained that if this project is approved they would still be paying leases to the City because we will not ever relinquish our rights to the shore. Even though they own the land they will still pay a lease for 10 feet of shoreline. Conservation police at the lake can't enforce local ordinances, but instead have to go from state law. Mayor McDowell discussed having a lake patrol officer on staff. The lake patrol officer would be checking for boat stickers and making sure other ordinances and codes are obeyed. This would also help control vandalism that takes place. Mayor McDowell said that he would not ever give up the rights to Canton Lake. In 2016 there was only 1 new house permit issued. This is not acceptable. The City of Canton needs business back in this town. If we do something positive at the lake the City could look at getting a gas station on the east side of Canton and further develop the City. The motivation behind the entire proposal and development at the lake is to help the City of Canton and the residents by growing and brining business. The City will continue to make the rules and regulations by ordinances. Mayor McDowell said there has been a lot of miss-information about the development and the proposal. We have not given away our authority on anything. The City will ultimately be in control. The City received a proposal. The City is looking at new ways of doing things because the old way of doing things is not working. IH is not coming back. We are not going to have coal mines again. Caterpillar left Peoria. We must be more inventive and build the businesses that we have and utilize the resources that we have the best way that we can. People must understand that the City will not relinquish the rules or the rights to the lake. Everything will be looked at and reviewed. The City has been very transparent through the entire process. Mayor McDowell encouraged the residents to contact their aldermen or stop into his office with any questions or concerns. Mayor McDowell said he is here to assist people in any way that he can. The City will do the best they can to make it right for the majority. DISCUSS, CONSIDER AND VOTE ON DIRECTING JACOB & KLINE LTD AND/OR THE ECONOMIC DEVELOPMENT GROUP LTD (STEVE KLINE) TO DRAFT A TIF REDEVELOPMENT AGREEMENT FOR TIF 1 DISTRICT 1 BETWEEN THE CITY OF CANTON AND MARK HUGHES FOR THE MAJESTIC THEATER Alderman Jump said that he has been involved several years with the theater project. This will be managed and called Majestic Theater. Mark Hughes is the developer involved in remodeling the theater. The Spoon River Partnership signed a letter to try to raise funds for the roof, the remodeling of the restrooms and the HVAC. $135,970.00 was raised towards the project. The estimated total expected expense is $263,000.00. The remaining project is the HVAC and some misc expenses for the bathrooms. The roof has been replaced and process has been made on the renovation of the bathrooms. They would like the City to attribute to some of the expenses. TIF 1 alone has uncertainty .....TIF 2 is performing very well. There is money and the money could be transferred to TIF 1 to cover these expenses. Alderman Jump said this is a perfect example of how the TIF funds should be used. The bid is $73,000.00 for the HVAC from GM Mechanical. They are also seeking assistance with the fees associated with the restrooms of approx$4,000.00. There are 10 years remaining in TIF 1. This is the longest that we can use the TIF. Alderman Jump said he would like to use the 10 years and have them draft a redevelop mental agreement for each year that they stay in business they will get 1/10 of their loan forgiven. Alderman Jump said he has been very impressed with the developer. Alderman Jump said he would like to suggest directing the Kline group to draft a redevelopment agreement. They have a target date of spring of 2018 to re-open. Time is of the essence. Alderman Nelson asked if we have money in the hotel/motel tax fund that isn't used by SRPED. We have approx $35,000.00 in that fund but one quarterly payment of around $13,000.00 will need to come out of it. They anticipate hiring approximately 3 employees. They have been very upfront about the low number of people they will hire. Missy Towery said the movie theater movement became very strong and has become the number one community request. Alderman Lovell said he agrees that it would be a good use of TIF funds. Motion and second were made by Aldermen Jump/Nelson to direct Jacob and Kline to draft a redevelopment agreement as needed between TIF 1 and TIF 2 between the City of Canton and the property developer for the Majestic Theater. PUBLIC WORKS, WATER AND SEWER ALDERWOMAN ANGIE LINGENFELTER, CHAIRMAN Alderwoman Lingenfelter congratulated the Street Department for their good work.
