ORDINANCE AMENDING PROVISION 8-10-7 PERTAINING TO APPLICATIONS
AND PAYMENTS OF CITY WATER BILLS IN THE CITY OF CANTON, ILLINOIS
WHEREAS, pursuant to the Illinois Municipal Code and the City of Canton Municipal
Code and specifically Section 8-10-7, the City has a process relative to application requirements
and payment of certain billings related to the use of water provided by the City of Canton;
WHEREAS, the City has encountered issues with individuals not paying their bills and
attempting to re-establish accounts at different locations than the location affiliated with the
outstanding balance;
WHEREAS, the City Council of the City of Canton has determined that it is in the best
interest of the City to modify Provision 8-10-7 to clarify what occurs if there are outstanding
water balances of those who try to re-establish water accounts.
NOW, THEREFORE, BE IT ORDAINED, by the City Council for the City of Canton,
Fulton County, Illinois, as follows:
SECTION 1: Section 8-10-7: Application Required; Owner Responsible of the Code of
Ordinances of the City of Canton is hereby amended to read as follows: "8-10-7: Application
required; Owner Responsible: No water shall be turned on for use in or upon any premises until
an application therefor in writing has been made for that purpose and filed with the city water
department stating the purpose for which the water is to be used. Every application for water
services shall constitute an agreement by the applicant to pay for all water used on the premises
through said service and to comply with all ordinances, rules, and regulations then in effect or that
may thereafter be adopted. The City may deny water service to any applicant when such
applicant owes the City through the water department for a delinquent bill for service to another
premise. Should the city become aware that the turnoff request by a landlord is being utilized as
a punitive matter in a dispute with a tenant who is current in payment of his or her water charges,
the city will not become an arbitrator of the dispute, but may in its discretion deny or grant such
request"
SECTION 2 —That upon passage of this amendment, the City Clerk shall be instructed
to submit to the Codifiers or Municipal Ordinance the said Ordinance amendment for insertion in
its proper place and each copy of this Code within thirty(30) days of its final passage.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular
meeting this 7TH day of November, 2017 upon a roll call vote as follows:
