AN ORDINANCE AMENDING 3-7-6 PERTAINING TO THE SALE TO MINORS OF
TOBACCO AND RELATED MATTERS
WHEREAS, the Illinois Municipal Code allows for the City Council for the City of
Canton to regulate certain uses involving tobacco and possession thereof within the City of
Canton municipal boundaries; and
WHEREAS, the City Council of the City of Canton has determined that the current
ordinance for Code 3-7-6 does not properly cover the possession of tobacco by minors and said
ordinance needs to be revised to reflect the appropriate law of the State of Illinois and the intent
of the City of Canton Code;
NOW, THEREFORE, BE IT ORDAINED, by and the City Council for the City of
Canton, Fulton County, Illinois, as follows:
SECTION 1: SECTION 3-7-6: SALE TO MINORS: of the code of ordinances of the
City of Canton is hereby amended to read as follows:
3-7-6: SALE OF TOBACCO AND POSSESSION OF TOBACCO INVOLVING
MINORS:
No person, either as principal, clerk or agent, shall sell, buy for or give away, either directly or
indirectly, any cigarette, electronic cigarette, cigar or tobacco (including smokeless tobacco), in
any form, to any minor person under the age of eighteen (18) years, within the city. Additionally,
it shall be unlawful for any minor person under the age of eighteen (18) years, within the city
limits, to possess any cigarette, electronic cigarette, cigar or tobacco (including
smokeless tobacco) or tobacco in any of its forms.
SECTION 2: This Ordinance shall be in full force and effect ten (10) days from and
after its publication as required by law. Said publication must take place within thirty (30) days
after passage of this ordinance.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting
this 5TH day of July, 2017 upon a roll call vote as follows:
